       Senator Constantine moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 811 and 812
    4  insert:
    5         Section 10. Subsection (4) is added to section 57.081,
    6  Florida Statutes, to read:
    7         57.081 Costs; right to proceed where prepayment of costs
    8  waived.—
    9         (4)Notwithstanding any other provision of law to the
   10  contrary, effective October 1, 2009, through September 30, 2012,
   11  the clerk of court may not impose on or collect from a person
   12  determined to be indigent pursuant to s. 57.082 any civil filing
   13  fees or costs as described in subsection (1), excluding court
   14  appointed counsel fees. This subsection shall expire on October
   15  1, 2012.
