    1                        A bill to be entitled                      
    2         An act relating to notification of school personnel;
    3         amending s. 985.04, F.S.; requiring that specified
    4         school personnel be notified when a child of any age
    5         is formally charged by a state attorney with a felony
    6         or a delinquent act that would be a felony if
    7         committed by an adult; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (b) of subsection (4) of section
   12  985.04, Florida Statutes, is amended to read:
   13         985.04 Oaths; records; confidential information.—
   14         (4)
   15         (b) Notwithstanding paragraph (a) or any other provision of
   16  this section, when a child of any age is formally charged by a
   17  state attorney with a felony or a delinquent act that would be a
   18  felony if committed by an adult, the state attorney shall notify
   19  the superintendent of the child's school that the child has been
   20  charged with such felony or delinquent act. The information
   21  obtained by the superintendent of schools under this section
   22  must be released within 48 hours after receipt to appropriate
   23  school personnel, including the principal of the school of the
   24  child and the director of transportation. The principal must
   25  immediately notify the child's immediate classroom teachers, the
   26  child's assigned bus driver, and any other school personnel
   27  whose duties include direct supervision of the child. Upon
   28  notification, the principal is authorized to begin disciplinary
   29  actions under s. 1006.09(1)-(4).
   30         Section 2. This act shall take effect July 1, 2009.
