       Senator Detert moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 4747 and 4748
    4  insert:
    5         Section 187. Subsections (24), (25), and (26) of section
    6  1001.42, Florida Statutes, as amended by section 2 of chapter
    7  2009-3, Laws of Florida, are amended to read:
    8         1001.42 Powers and duties of district school board.—The
    9  district school board, acting as a board, shall exercise all
   10  powers and perform all duties listed below:
   11         (24)REDUCE PAPERWORK AND DATA COLLECTION AND REPORTING
   12  REQUIREMENTS.—Beginning with the 2006-2007 school year:
   13         (a)Each district school board shall designate a classroom
   14  teacher to serve as the teacher representative to speak on
   15  behalf of the district’s teachers regarding paperwork and data
   16  collection reduction.
   17         (b)Each district school board must provide the school
   18  community with an efficient method for the school community to
   19  communicate with the classroom teacher designee regarding
   20  possible paperwork and data collection burdens and potential
   21  solutions.
   22         (c)The teacher designee shall annually report his or her
   23  findings and potential solutions to the school board.
   24         (d)Each district school board must submit its findings and
   25  potential solutions to the State Board of Education by September
   26  1 of each year.
   27         (e)The State Board of Education shall prepare a report of
   28  the statewide paperwork and data collection findings and
   29  potential solutions and submit the report to the Governor, the
   30  President of the Senate, and the Speaker of the House of
   31  Representatives by October 1 of each year.
   32         (24)(25) EMPLOYMENT CONTRACTS.—On or after February 1,
   33  2009, a district school board may not enter into an employment
   34  contract that is funded from state funds and that requires the
   35  district to pay an employee an amount in excess of 1 year of the
   36  employee’s annual salary for termination, buy-out, or any other
   37  type of contract settlement.
   38         (25)(26) ADOPT RULES.—Adopt rules pursuant to ss.
   39  120.536(1) and 120.54 to implement this section.
   40         Section 188. Present paragraph (c) of subsection (3) of
   41  section 1008.31, Florida Statutes, is redesignated as paragraph
   42  (e), and new paragraphs (c) and (d) are added to that
   43  subsection, to read:
   44         1008.31 Florida’s K-20 education performance accountability
   45  system; legislative intent; mission, goals, and systemwide
   46  measures; data quality improvements.—
   47         (3) K-20 EDUCATION DATA QUALITY IMPROVEMENTS.—To provide
   48  data required to implement education performance accountability
   49  measures in state and federal law, the Commissioner of Education
   50  shall initiate and maintain strategies to improve data quality
   51  and timeliness. All data collected from state universities
   52  shall, as determined by the commissioner, be integrated into the
   53  K-20 data warehouse. The commissioner shall have unlimited
   54  access to such data solely for the purposes of conducting
   55  studies, reporting annual and longitudinal student outcomes, and
   56  improving college readiness and articulation. All public
   57  educational institutions shall provide data to the K-20 data
   58  warehouse in a format specified by the commissioner.
   59         (c)The commissioner shall continuously monitor and review
   60  the collection of paperwork, data, and reports by school
   61  districts and complete an annual review of such collection no
   62  later than June 1 of each year. The annual review must include
   63  recommendations for consolidating paperwork, data, and reports,
   64  wherever feasible, in order to reduce the burdens on school
   65  districts.
   66         (d)By July 1 of each year, the commissioner shall prepare
   67  a report assisting the school districts in eliminating or
   68  consolidating paperwork, data, and reports by providing
   69  suggestions, technical assistance, and guidance.

   72         And the title is amended as follows:
   73         Delete line 416
   74  and insert:
   75         made by the act; amending s. 1001.42, F.S.; deleting
   76         provisions that require each district school board to
   77         reduce paperwork and data collection and report its
   78         findings and potential solutions on reducing burdens
   79         associated with such collection; amending s. 1008.31,
   80         F.S.; requiring that the Commissioner of Education
   81         monitor and review the collection of paperwork, data,
   82         and reports by school districts; requiring that the
   83         commissioner complete an annual review of such
   84         collection by a specified date each year; requiring
   85         that the commissioner prepare a report, by a specified
   86         date each year, assisting the school districts with
   87         eliminating or consolidating paperwork, data, and
   88         reports by providing suggestions, technical
   89         assistance, and guidance; providing an effective date.
