       Senator Smith moved the following:
       
    1         Senate Amendment (with title amendment)

    4         Delete line 555
    5  and insert:
    6         Section 5. Notwithstanding a law or rule that requires a
    7  project that is the subject of a license to commence within a
    8  specific time period, an agency may grant a waiver or variance
    9  to extend the commencement period if the licensee demonstrates
   10  that the delay is the result of the economic conditions existing
   11  as of January 1, 2009, and if the license was issued before July
   12  1, 2009, free and clear of all administrative and judicial
   13  proceedings. A petition for waiver or variance must be submitted
   14  to the agency before June 31, 2010.
   15         Section 6. This act shall take effect July 1, 2009.
