The Committee on Banking and Insurance (Bennett) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 125.01045, Florida Statutes, is created
6 to read:
7 125.01045 Prohibition of fees for first-responder
8 services.—
9 (1) A county may not impose a fee or seek reimbursement for
10 any costs or expenses that may be incurred for services provided
11 by a first responder, including costs or expenses related to
12 personnel, supplies, motor vehicles, or equipment in response to
13 a motor vehicle accident, except for transportation and
14 treatment provided by ambulance services licensed pursuant to s.
15 401.23(5).
16 (2) As used in this section, the term “first responder”
17 means a law enforcement officer as defined in s. 943.10, a
18 firefighter as defined in s. 633.30, or an emergency medical
19 technician or paramedic as defined in s. 401.23 who is employed
20 by the state or a local government. A volunteer law enforcement
21 officer, firefighter, or emergency medical technician or
22 paramedic engaged by the state or a local government is also
23 considered a first responder of the state or local government
24 for purposes of this section.
25 Section 2. Section 166.0446, Florida Statutes, is created
26 to read:
27 166.0446 Prohibition of fees for first-responder services.—
28 (1) A municipality may not impose a fee or seek
29 reimbursement for any costs or expenses that may be incurred for
30 services provided by a first responder, including costs or
31 expenses related to personnel, supplies, motor vehicles, or
32 equipment in response to a motor vehicle accident, except for
33 transportation and treatment provided by ambulance services
34 licensed pursuant to s. 401.23(5).
35 (2) As used in this section, the term “first responder”
36 means a law enforcement officer as defined in s. 943.10, a
37 firefighter as defined in s. 633.30, or an emergency medical
38 technician or paramedic as defined in s. 401.23 who is employed
39 by the state or a local government. A volunteer law enforcement

44 Section 3. This act shall take effect July 1, 2009.
