Floor: WD/2R . 04/27/2009 07:25 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Bennett moved the following: 1 Senate Amendment 2 3 Delete lines 16 - 41 4 and insert: 5 (1) A county may not impose a fee or seek reimbursement for 6 any costs or expenses that may be incurred for services provided 7 by a first responder, including costs or expenses related to 8 personnel, supplies, motor vehicles, or equipment in response to 9 a motor vehicle accident, except for costs of materials to 10 contain or clean up hazardous waste in quantities reportable to 11 the State Warning Point at the Division of Emergency Management 12 within the Department of Community Affairs. 13 (2) As used in this section, the term “first responder” 14 means a law enforcement officer as defined in s. 943.10, a 15 firefighter as defined in s. 633.30, or an emergency medical 16 technician or paramedic as defined in s. 401.23 who is employed 17 by the state or a local government. A volunteer law enforcement 18 officer, firefighter, or emergency medical technician or 19 paramedic engaged by the state or a local government is also 20 considered a first responder of the state or local government 21 for purposes of this section. 22 Section 2. Section 166.0446, Florida Statutes, is created 23 to read: 24 166.0446 Prohibition of fees for first-responder services.— 25 (1) A municipality may not impose a fee or seek 26 reimbursement for any costs or expenses that may be incurred for 27 services provided by a first responder, including costs or 28 expenses related to personnel, supplies, motor vehicles, or 29 equipment in response to a motor vehicle accident, except for 30 costs of materials to contain or clean up hazardous waste in 31 quantities reportable to the State Warning Point at the Division 32 of Emergency Management within the Department of Community 33 Affairs.
