Section 125.01045, Florida Statutes, is created 6 to read: 7 125.01045 Prohibition of collection of fees for first 8 responder services.— 9 (1) As residents are currently taxed or assessed for 10 essential government services, a county may not seek 11 reimbursement from a resident of that county for any costs or 12 expenses that may be incurred for services provided by a first 13 responder, including costs or expenses related to personnel, 14 supplies, motor vehicles, or equipment in response to a motor 15 vehicle accident, except for costs of materials to contain or 16 clean up hazardous materials in quantities reportable to the 17 Florida State Warning Point at the Division of Emergency 18 Management, and costs for transportation and treatment provided 19 by ambulance services licensed pursuant to s. 401.23(5). 20 (2) As used in this section, the term “first responder” 21 means a law enforcement officer as defined in s. 943.10, a 22 firefighter as defined in s. 633.30, or an emergency medical 23 technician or paramedic as defined in s. 401.23 who is employed 24 by the state or a local government. A volunteer law enforcement 25 officer, firefighter, or emergency medical technician or 26 paramedic engaged by the state or a local government is also 27 considered a first responder of the state or local government 28 for purposes of this section. 29 Section 2. Section 166.0446, Florida Statutes, is created 30 to read: 31 166.0446 Prohibition of collection of fees for first 32 responder services.— 33 (1) As residents are currently taxed or assessed for 34 essential government services, a municipality may not seek 35 reimbursement for any costs or expenses that may be incurred for 36 services provided by a first responder, including costs or 37 expenses related to personnel, supplies, motor vehicles, or 38 equipment in response to a motor vehicle accident, except for 39 transportation and treatment provided by ambulance services 40 licensed pursuant to s. 401.23(5) or for costs of materials to 41 contain or clean up hazardous materials in quantities reportable 42 to the Florida State Warning Point at the Division of Emergency 43 Management. 44 (2) As used in this section, the term “first responder” 45 means a law enforcement officer as defined in s. 943.10, a 46 firefighter as defined in s. 633.30, or an emergency medical 47 technician or paramedic as defined in s. 401.23 who is employed 48 by the state or a local government.
