Floor: 1/AD/3R . 04/30/2009 02:16 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Bennett moved the following: 1 Senate Amendment 2 3 Delete lines 19 - 42 4 and insert: 5 a motor vehicle accident, except for costs to contain or 6 clean up hazardous materials in quantities reportable to the 7 Florida State Warning Point at the Division of Emergency 8 Management, and costs for transportation and treatment provided 9 by ambulance services licensed pursuant to ss. 401.23(4) and 10 401.23(5). 11 (2) As used in this section, the term “first responder” 12 means a law enforcement officer as defined in s. 943.10, a 13 firefighter as defined in s. 633.30, or an emergency medical 14 technician or paramedic as defined in s. 401.23 who is employed 15 by the state or a local government. A volunteer law enforcement 16 officer, firefighter, or emergency medical technician or 17 paramedic engaged by the state or a local government is also 18 considered a first responder of the state or local government 19 for purposes of this section. 20 Section 2. Section 166.0446, Florida Statutes, is created 21 to read: 22 166.0446 Prohibition of fees for first-responder services.— 23 (1) A municipality may not impose a fee or seek 24 reimbursement for any costs or expenses that may be incurred for 25 services provided by a first responder, including costs or 26 expenses related to personnel, supplies, motor vehicles, or 27 equipment in response to a motor vehicle accident, except for 28 costs to contain or clean up hazardous materials in
