       The Committee on Judiciary (Richter) recommended the following:
       
    1         Senate Amendment to Amendment (304236) (with title
    2  amendment)

    4         Between lines 3186 and 3187
    5  insert:
    6         Section 67. Subsection (1) of section 651.105, Florida
    7  Statutes, is amended to read:
    8         651.105 Examination and inspections.—
    9  (1) The office may at any time, and shall at least once every 5
   10  3 years, examine the business of any applicant for a certificate
   11  of authority and any provider engaged in the execution of care
   12  contracts or engaged in the performance of obligations under
   13  such contracts, in the same manner as is provided for
   14  examination of insurance companies pursuant to s. 624.316. Such
   15  examinations shall be made by a representative or examiner
   16  designated by the office, whose compensation will be fixed by
   17  the office pursuant to s. 624.320. Routine examinations may be
   18  made by having the necessary documents submitted to the office;
   19  and, for this purpose, financial documents and records
   20  conforming to commonly accepted accounting principles and
   21  practices, as required under s. 651.026, will be deemed
   22  adequate. The final written report of each such examination
   23  shall be filed with the office and, when so filed, will
   24  constitute a public record. Any provider being examined shall,
   25  upon request, give reasonable and timely access to all of its
   26  records. The representative or examiner designated by the office
   27  may at any time examine the records and affairs and inspect the
   28  physical property of any provider, whether in connection with a
   29  formal examination or not.
