    1                        A bill to be entitled                      
    2         An act relating to the influenza vaccine; amending ss.
    3         402.305, 402.313, and 402.3131, F.S.; requiring child
    4         care facilities, family day care homes, and large
    5         family child care homes to provide parents with
    6         certain information regarding the causes, symptoms,
    7         and transmission of the influenza virus; providing an
    8         effective date.
    9  
   10         WHEREAS, the State of Florida recognizes the importance of
   11  the influenza vaccine for children enrolled or enrolling in
   12  child care programs, and
   13         WHEREAS, the Bureau of Immunization of the Department of
   14  Health acknowledges that vaccines, including the influenza
   15  vaccine, focus on disease prevention and are the most cost
   16  effective medical intervention, and
   17         WHEREAS, the Centers for Disease Control and Prevention,
   18  through the Advisory Committee on Immunization Practices,
   19  recommends that annual vaccination of all children aged 6 months
   20  through 59 months continue to be a primary focus of vaccination
   21  efforts because these children are at higher risk for influenza
   22  complications compared with older children, and
   23         WHEREAS, vaccination against influenza each fall and winter
   24  remains the primary mechanism to prevent disease, NOW,
   25  THEREFORE,

   27  Be It Enacted by the Legislature of the State of Florida:
   28  
   29         Section 1. Present paragraphs (b) and (c) of subsection (9)
   30  of section 402.305, Florida Statutes, are redesignated as
   31  paragraphs (c) and (d), respectively, and a new paragraph (b) is
   32  added to that subsection, to read:
   33         402.305 Licensing standards; child care facilities.—
   34         (9) ADMISSIONS AND RECORDKEEPING.—
   35         (b)During the months of August and September of each year,
   36  each child care facility shall provide parents of children
   37  enrolled in the facility detailed information regarding the
   38  causes, symptoms, and transmission of the influenza virus in an
   39  effort to educate those parents regarding the importance of
   40  immunizing their children against influenza as recommended by
   41  the Advisory Committee on Immunization Practices of the Centers
   42  for Disease Control and Prevention.
   43         Section 2. Subsection (14) is added to section 402.313,
   44  Florida Statutes, to read:
   45         402.313 Family day care homes.—
   46         (14)During the months of August and September of each
   47  year, each family day care home shall provide parents of
   48  children enrolled in the home detailed information regarding the
   49  causes, symptoms, and transmission of the influenza virus in an
   50  effort to educate those parents regarding the importance of
   51  immunizing their children against influenza as recommended by
   52  the Advisory Committee on Immunization Practices of the Centers
   53  for Disease Control and Prevention.
   54         Section 3. Subsection (9) is added to section 402.3131,
   55  Florida Statutes, to read:
   56         402.3131 Large family child care homes.—
   57         (9)During the months of August and September of each year,
   58  each large family child care home shall provide parents of
   59  children enrolled in the home detailed information regarding the
   60  causes, symptoms, and transmission of the influenza virus in an
   61  effort to educate those parents regarding the importance of
   62  immunizing their children against influenza as recommended by
   63  the Advisory Committee on Immunization Practices of the Centers
   64  for Disease Control and Prevention.
   65         Section 4. This act shall take effect upon becoming a law.
