    1                        A bill to be entitled                      
    2         An act relating to the Marriage Education Trust Fund;
    3         creating s. 741.0101, F.S.; creating the Marriage
    4         Education Trust Fund within the Executive Office of
    5         the Governor; providing for administration of the
    6         trust fund and use of moneys therein; providing for
    7         future review and termination or re-creation of the
    8         trust fund; providing a contingent effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 741.0101, Florida Statutes, is created
   13  to read:
   14         741.0101 Marriage Education Trust Fund.—
   15         (1) The Marriage Education Trust Fund is created within the
   16  Executive Office of the Governor for the purpose of collecting
   17  and disbursing funds generated from the additional marriage
   18  license fee in s. 741.01(4)(b). The funds shall be directed to
   19  the Department of Children and Family Services for the specific
   20  purpose of funding marriage education programs that prepare,
   21  strengthen, and restore healthy marriage relationships and shall
   22  be appropriated in a grants-in-aid category to the department
   23  for that purpose.
   24         (2) Pursuant to the provisions of s. 19(f)(2), Art. III of
   25  the State Constitution, the trust fund shall, unless terminated
   26  sooner, be terminated on July 1, 2013. Prior to its scheduled
   27  termination, the trust fund shall be reviewed as provided in s.
   28  215.3206(1) and (2).
   29         Section 2. This act shall take effect July 1, 2009, if
   30  Senate Bill 2310 or similar legislation is adopted in the same
   31  legislative session or an extension thereof and becomes law.
