Florida Senate - 2009 CS for CS for SB 2326 By the Committees on Transportation; and Communications, Energy, and Public Utilities; and Senator Ring 596-05616-09 20092326c2 1 A bill to be entitled 2 An act relating to license plates; amending ss. 3 320.08056 and 320.08058, F.S.; creating a Go Green 4 Florida license plate, a Florida Biodiversity 5 Foundation license plate, a Toomey Foundation for the 6 Natural Sciences license plate, and a Trinity license 7 plate; establishing an annual fee for the plates; 8 providing for the distribution of use fees received 9 from the annual sale of such plates; providing an 10 effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraphs (qqq), (rrr), (sss), and (ttt) are 15 added to subsection (4) of section 320.08056, Florida Statutes, 16 to read: 17 320.08056 Specialty license plates.— 18 (4) The following license plate annual use fees shall be 19 collected for the appropriate specialty license plates: 20 (qqq) Go Green Florida license plate, $25. 21 (rrr) Florida Biodiversity Foundation license plate, $25. 22 (sss) Toomey Foundation for the Natural Sciences license 23 plate, $25. 24 (ttt) Trinity license plate, $25. 25 Section 2. Subsections (69), (70), (71), and (72) are added 26 to section 320.08058, Florida Statutes, to read: 27 320.08058 Specialty license plates.— 28 (69) GO GREEN FLORIDA LICENSE PLATES.— 29 (a) The department shall develop a Go Green Florida license 30 plate as provided in this section. The plate must bear the 31 colors and design approved by the department. The word “Florida” 32 must appear at the top of the plate, and the words “Go Green 33 Florida” must appear at the bottom of the plate. The Go Green 34 Florida emblem or logo must appear on the plate. 35 (b) The requirements of s. 320.08053 must be met before the 36 issuance of the plate. 37 (c) The proceeds from the sale of the plate shall be 38 distributed to the Coalition for Renewable Energy Solutions, 39 Inc. After reimbursement for documented costs expended to 40 establish the plates and for annual auditing costs, the 41 coalition shall use the proceeds of the annual use fees in the 42 following manner: 43 1. A maximum of 5 percent shall be used for administrative 44 costs directly associated with the management and distribution 45 of the proceeds. 46 2. A maximum of 25 percent shall be used for the continuing 47 statewide promotion and marketing of the plate. 48 3. Seventy percent shall be used to fund the Renewable 49 Energy and Energy-Efficient Technology Grants Program pursuant 50 to s. 377.804, the Solar Energy System Incentives Program 51 pursuant to s. 377.806, under the Florida Energy and Climate 52 Commission, or other educational programs dedicated to providing 53 effective alternative energy practices. 54 (d) The coalition shall comply with the financial audit 55 requirements of s. 320.08062. 56 (e) The Go Green Florida emblem or logo may be used as a 57 decal by the department in recognition of energy-efficient 58 vehicle usage and practices. However, the display of the decal 59 is not a substitute for a license plate. 60 (70) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.— 61 (a) The department shall develop a Florida Biodiversity 62 Foundation license plate as provided in this section. The plate 63 must bear the colors and design approved by the department. The 64 word “Florida” must appear at the top of the plate, and the 65 words “Save Wild Florida” must appear at the bottom of the 66 plate. 67 (b) The annual use fees shall be distributed to the Florida 68 Biodiversity Foundation Inc., which shall retain 50 percent of 69 the proceeds until the startup costs to develop and establish 70 the plates have been recovered. Thereafter, the proceeds shall 71 be used as follows: 72 1. A maximum of 25 percent of the proceeds may be used to 73 fund the administrative, promotion, and marketing costs of the 74 license plate program and the foundation. 75 2. The remaining fees shall be used by the foundation to 76 fund research, education, and scientific study of the diversity 77 of animals and plants and to aid in the preservation, study, 78 conservation, and recovery of imperiled organisms. 79 (71) TOOMEY FOUNDATION FOR THE NATURAL SCIENCES LICENSE 80 PLATES.— 81 (a) The department shall develop a Toomey Foundation for 82 the Natural Sciences license plate as provided in this section. 83 The plate must bear the colors and design approved by the 84 department. The word “Florida” must appear at the top of the 85 plate, and the words “Preserving the Past” must appear at the 86 bottom of the plate. 87 (b) The annual use fees shall be distributed to the Toomey 88 Foundation for the Natural Sciences, Inc., which shall retain 50 89 percent of the proceeds until the startup costs to develop and 90 establish the plates have been recovered. Thereafter, the 91 proceeds shall be used as follows: 92 1. A maximum of 25 percent of the proceeds may be used to 93 fund the administrative, promotion, and marketing costs of the 94 license plate program and the foundation. 95 2. The remaining fees shall be used by the foundation to 96 acquire, manage, and preserve properties that are of scientific 97 importance to paleontologists, archeologists, or geologists for 98 the purposes of research and education, and to promote and 99 protect the unique natural sciences of this state. 100 (72) TRINITY LICENSE PLATES.— 101 (a) The department shall develop a Trinity license plate as 102 provided in this section. The plate must bear the colors and 103 design approved by the department. The word “Florida” must 104 appear at the top of the plate and the words “Sunshine State” 105 must appear at the bottom of the plate. 106 (b) The annual use fees shall be distributed to the Toomey 107 Foundation for the Natural Sciences, Inc., which shall retain 50 108 percent of the proceeds until the startup costs to develop and 109 establish the plates have been recovered. Thereafter, the 110 proceeds shall be used as follows: 111 1. A maximum of 25 percent of the proceeds may be used to 112 fund the administrative, promotion, and marketing costs of the 113 license plate program and the foundation. 114 2. The remaining fees shall be used by the foundation to 115 support educational, research, and scientific activities in this 116 state, including the distribution of funds to qualified entities 117 in furtherance of the stated purposes of the foundation. 118 Section 3. This act shall take effect October 1, 2009.
