1 A bill to be entitled
2 An act relating to state university presidents;
3 amending ss. 1001.706 and 1001.74, F.S.; revising
4 powers and duties of the Board of Governors and
5 university boards of trustees relating to personnel;
6 providing that a state university president is not
7 subject to the personnel program established by the
8 Board of Governors; requiring that a board of trustees
9 appoint the university president and administer a
10 personnel program for the president; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (a) of subsection (5) of section
16 1001.706, Florida Statutes, is amended to read:
17 1001.706 Powers and duties of the Board of Governors.—
18 (5) POWERS AND DUTIES RELATING TO PERSONNEL.—
19 (a) The Board of Governors, or the board's designee, shall
20 establish the personnel program for all employees of a state
21 university except, including the president.
22 Section 2. Subsection (5) of section 1001.74, Florida
23 Statutes, is amended to read:
24 1001.74 Powers and duties of university boards of
25 trustees.—
26 (5) POWERS AND DUTIES RELATING TO PERSONNEL.—
27 (a) To the extent delegated by the Board of Governors
28 pursuant to s. 1001.706, each board of trustees shall establish
29 the personnel program for all employees of the university
30 except, including the president.
31 (b) Each board of trustees shall appoint a university
32 president and administer a personnel program for the president.
33 (c)(b) The Department of Management Services shall retain
34 authority over state university employees for programs
35 established in ss. 110.123, 110.1232, 110.1234, 110.1238, and
36 110.161 and in chapters 121, 122, and 238. Unless specifically
37 authorized by law, neither the Board of Governors nor a state
38 university may offer group insurance programs for employees as a
39 substitute for or as an alternative to the health insurance
40 programs offered pursuant to chapter 110.
41 (d)(c) Except as otherwise provided by law, university
42 employees are public employees for purposes of chapter 112 and
43 the payment for travel and per diem shall not exceed the level
44 specified in s. 112.061.
45 Section 3. This act shall take effect July 1, 2009.
