       The Committee on Criminal and Civil Justice Appropriations
       (Crist) recommended the following:
       
    1         Senate Amendment to Amendment (950750) 
    2  
    3         Delete lines 97 - 103
    4  and insert:
    5  775.082 or s. 775.083. Prosecution for a violation of subsection
    6  (5) does not preclude prosecution for theft under subsection (8)
    7  or s. 812.014.
    8         (8) Theft of utility services for the purpose of
    9  facilitating the manufacture of a controlled substance is a
   10  misdemeanor of the first degree, punishable as provided in s.
   11  775.082 or s. 775.083.
