1 A bill to be entitled
2 An act relating to state purchasing of vehicles;
3 providing definitions; requiring state agencies, state
4 universities, and certain local governments to
5 purchase hybrid, flex-fuel, or biodiesel vehicles if
6 such vehicles are available; authorizing the
7 Department of Management Services to adopt rules;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. State purchasing of vehicles.—
13 (1) As used in this section, the term:
14 (a) “Hybrid vehicle” has the same meaning as in s.
15 316.0741, Florida Statutes.
16 (b) “Flex-fuel vehicle” means a vehicle that is designed to
17 run on gasoline or a blend of up to 85 percent ethanol.
18 (c) “Biodiesel vehicle” means a vehicle that is designed to
19 run on biodiesel. For the purposes of this section, the term
20 “biodiesel” means mono-alkyl esters of long-chain fatty acids
21 derived from plant or animal matter for use as a source of
22 energy and meeting the specifications for biodiesel and
23 biodiesel blends with petroleum products as adopted by the
24 Department of Agriculture and Consumer Services. Biodiesel may
25 refer to biodiesel blends designated BXX, where XX represents
26 the volume percentage of biodiesel fuel in the blend.
27 (2) Any new motor vehicle purchased after January 1, 2010,
28 by a state agency, state university, or local government through
29 any state-purchasing plan must be a hybrid, flex-fuel, or
30 biodiesel vehicle if such vehicle is available and otherwise
31 meets the requirements for the vehicle's intended use.
32 (3) The Department of Management Services, by October 1,
33 2009, shall adopt rules that establish criteria and procedures
34 for the purchase of hybrid, flex-fuel, and biodiesel vehicles.
35 Section 2. This act shall take effect July 1, 2009.
