26 | (13) Effective July 1, 2011, in addition to the |
27 | requirements of subsections (10) and (11) and notwithstanding |
28 | any specific authority provided in s. 320.08058, an organization |
29 | or entity receiving annual use fee revenue from the sale of a |
30 | specialty license plate may use no more than a total of 10 |
31 | percent of the revenues for administrative, marketing, and |
32 | promotion costs, including annual audit and compliance affidavit |
33 | costs. |
34 | (14) Notwithstanding any other provision of this chapter, |
35 | no annual use fee revenue derived from the sale of a specialty |
36 | license plate, or the interest thereon, shall be expended on |
37 | projects or programs outside this state. |
38 | Section 2. Subsection (29), paragraph (b) of subsection |
39 | (32), and subsection (35) of section 320.08058, Florida |
40 | Statutes, are amended, and subsections (69) through (79) are |
41 | added to that section, to read: |
42 | 320.08058 Specialty license plates.-- |
43 | (29) CHOOSE LIFE LICENSE PLATES.-- |
44 | (a) The department shall develop a Choose Life license |
45 | plate as provided in this section. The word "Florida" must |
46 | appear at the bottom of the plate, and the words "Choose Life" |
47 | must appear at the top of the plate. |
48 | (b) The annual use fees shall be distributed quarterly to |
49 | Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a |
50 | list of annually to each county in the ratio that the annual use |
51 | fees collected by each county bears to the total fees collected |
52 | for the plates within the state. |
53 | (c) Up to 10 percent of the fees may be used for |
54 | administrative costs directly associated with the operations of |
55 | Choose Life, Inc., and activities by Choose Life, Inc., to |
56 | promote adoption and to market the license plate in this state. |
57 | Choose Life, Inc., shall administer distribution of the |
58 | remaining Each county shall distribute the funds to |
59 | nongovernmental, not-for-profit agencies within the county, |
60 | which agencies' services primarily consist of are limited to |
61 | counseling and meeting the physical needs of pregnant women who |
62 | are considering committed to placing their children for |
63 | adoption. |
64 | 1. Funds may not be distributed to any agency that is |
65 | involved or associated with abortion activities, including |
66 | counseling for or referrals to abortion clinics, providing |
67 | medical abortion-related procedures, or proabortion advertising, |
68 | and funds may not be distributed to any agency that charges |
69 | women for services received. |
70 | 2. Choose Life, Inc., may, from time to time, establish |
71 | criteria pertaining to appropriate percentages of expenditures |
72 | on items including, but not limited to, physical needs of women, |
73 | physical needs of infants awaiting adoption, counseling, |
74 | advertising, and training. |
75 | 3. Choose Life license plate funds generated in counties |
76 | that do not have a qualified service provider shall be |
77 | distributed by Choose Life, Inc., to qualified service providers |
78 | in other counties. |
79 | 4. Funds shall not be removed from a county with active |
80 | qualified service providers for distribution to service |
81 | providers in other counties unless year-end unused fund balances |
82 | exceed 20 percent of the county's annual Choose Life license |
83 | plate revenues for 3 consecutive years. If year-end fund |
84 | balances exceed 20 percent of a county's annual revenues for 3 |
85 | consecutive years, such balance may be distributed by Choose |
86 | Life, Inc., to qualified service providers in other counties. |
87 | 1. Agencies that receive the funds must use at least 70 |
88 | percent of the funds to provide for the material needs of |
89 | pregnant women who are committed to placing their children for |
90 | adoption, including clothing, housing, medical care, food, |
91 | utilities, and transportation. Such funds may also be expended |
92 | on infants awaiting placement with adoptive parents. |
93 | 2. The remaining funds may be used for adoption, |
94 | counseling, training, or advertising, but may not be used for |
95 | administrative expenses, legal expenses, or capital |
96 | expenditures. |
97 | 5.3. Each service provider agency that receives such funds |
98 | must submit an annual attestation to Choose Life, Inc., which |
99 | shall, upon request, make copies available to a state agency |
100 | charged with auditing the county. Any unused funds that exceed |
101 | 10 percent of the funds received by an agency during its fiscal |
102 | year must be returned to the county, which shall distribute them |
103 | to other qualified agencies. |
104 | 6. Choose Life license plate use fees generated in this |
105 | state may only be spent on activities within this state. |
106 | (d)1. Within 90 days after the effective date of this |
107 | paragraph, county commissions that have never distributed Choose |
108 | Life funds shall forward such funds to Choose Life, Inc., for |
109 | distribution. |
110 | 2. Within 180 days after the effective date of this |
111 | paragraph, county commissions that have been distributing Choose |
112 | Life funds shall forward fund balances to Choose Life, Inc., for |
113 | distribution. |
114 | (32) UNITED WE STAND LICENSE PLATES.-- |
115 | (b) The department shall retain all revenues from the sale |
116 | of such plates until all startup costs for developing and |
117 | issuing the plates have been recovered. Thereafter, |
118 | notwithstanding s. 332.14, 100 percent of the annual use fee |
119 | shall be distributed to the Department of Transportation SAFE |
120 | Council for the development and implementation of programs to |
121 | fund a grant program to enhance security at airports throughout |
122 | the state, pursuant to s. 332.14. Up to 10 percent of the annual |
123 | use fee revenue may be used for administration, promotion, and |
124 | marketing of the plate, including annual audit and compliance |
125 | affidavit costs. |
126 | (35) FLORIDA GOLF LICENSE PLATES.-- |
127 | (a) The Department of Highway Safety and Motor Vehicles |
128 | shall develop a Florida Golf license plate as provided in this |
129 | section. The word "Florida" must appear at the bottom of the |
130 | plate. The Dade Amateur Golf Association, following consultation |
131 | with the PGA TOUR, the Florida Sports Foundation, the LPGA, and |
132 | the PGA of America may submit a revised sample plate for |
133 | consideration by the department. |
134 | (b) The department shall distribute the Florida Golf |
135 | license plate annual use fee to the Dade Amateur Golf |
136 | Association, a s. 501(c)(3) organization Florida Sports |
137 | Foundation, a direct-support organization of the Office of |
138 | Tourism, Trade, and Economic Development. The license plate |
139 | annual use fees are to be annually allocated as follows: |
140 | 1. Up to 10 5 percent of the proceeds from the annual use |
141 | fees may be used by the Dade Amateur Golf Association Florida |
142 | Sports Foundation for the administration of the Florida Junior |
143 | Youth Golf Program. |
144 | 2. The Dade Amateur Golf Association shall receive the |
145 | first $80,000 in proceeds from the annual use fees for the |
146 | operation of youth golf programs in Miami-Dade County. |
147 | Thereafter, 15 percent of the proceeds from the annual use fees |
148 | shall be provided to the Dade Amateur Golf Association for the |
149 | operation of youth golf programs in Miami-Dade County. |
150 | 3. The remaining proceeds from the annual use fees shall |
151 | be available for grants to nonprofit organizations to operate |
152 | youth golf programs and for marketing the Florida Golf license |
153 | plates. All grant recipients, including the Dade Amateur Golf |
154 | Association, shall be required to provide to the Dade Amateur |
155 | Golf Association Florida Sports Foundation an annual program and |
156 | financial report regarding the use of grant funds. Such reports |
157 | shall be made available to the public. |
158 | (c) The Dade Amateur Golf Association shall Florida Sports |
159 | Foundation may establish a Florida Junior Golf Council Youth |
160 | Golf Program. The Florida Junior Golf Council Youth Golf Program |
161 | shall assist organizations for the benefit of youth, introduce |
162 | young people to golf, instruct young people in golf, teach the |
163 | values of golf, and stress life skills, fair play, courtesy, and |
164 | self-discipline. |
165 | (d) The Dade Amateur Golf Association Florida Sports |
166 | Foundation shall establish a seven-member Florida Junior Golf |
167 | Council committee to offer advice regarding the distribution of |
168 | the annual use fees for grants to nonprofit organizations. The |
169 | council advisory committee shall consist of one member from a |
170 | group serving youth, one member from a group serving disabled |
171 | youth, and five members at large. |
172 | (69) AUTISM LICENSE PLATES.-- |
173 | (a) The department shall develop an Autism license plate |
174 | as provided in this section. Autism license plates must bear the |
175 | colors and design approved by the department. The word "Florida" |
176 | must appear at the top of the plate, and the words "Support |
177 | Autism Programs" must appear at the bottom of the plate. |
178 | (b) The proceeds from the license plate annual use fee |
179 | shall be distributed to Achievement and Rehabilitation Centers, |
180 | Inc., to fund service programs for autism and related |
181 | disabilities throughout the state and to operate and establish |
182 | programs to support individuals with autism and related |
183 | disabilities through direct services, evaluation, training, and |
184 | awareness. Achievement and Rehabilitation Centers, Inc., shall |
185 | establish an Autism Services Grant Council that shall provide |
186 | grants from available Autism license plate proceeds to nonprofit |
187 | organizations for direct services and programs for individuals |
188 | with autism and related disabilities and their families. |
189 | Consideration for participation in such services and programs |
190 | shall be given to applicants who are children or adults with |
191 | autism and related disabilities and their families and shall |
192 | include those who are on the Agency for Persons with |
193 | Disabilities waiting lists for services. Achievement and |
194 | Rehabilitation Centers, Inc., shall also establish an Autism |
195 | License Plate Fund. Moneys in the fund shall be used by the |
196 | grant council as provided in this paragraph. All funds received |
197 | under this subsection must be used in this state. |
198 | (c) Achievement and Rehabilitation Centers, Inc., may |
199 | retain all proceeds from the annual use fee up to $85,000 until |
200 | all documented startup costs for developing and establishing the |
201 | plate have been recovered. Thereafter, the proceeds from the |
202 | annual use fee shall be used as follows: |
203 | 1. Up to 10 percent of the proceeds from the annual use |
204 | fee may be used for the administration of the Autism License |
205 | Plate Fund, the Autism Services Grant Council, and related |
206 | matters. |
207 | 2. Funds may be used as necessary for annual audit or |
208 | compliance affidavit costs. |
209 | 3. Thirty-five percent of the proceeds from the annual use |
210 | fee shall be used to establish and operate programs to support |
211 | individuals with autism and related disabilities and their |
212 | families through direct services, evaluation, training, and |
213 | awareness in the state. |
214 | 4. The Center for Autism and Related Disabilities at the |
215 | University of Miami shall receive 15 percent of the proceeds |
216 | from the annual use fee for distribution, as determined |
217 | appropriate by the director of that center, to the seven |
218 | regional autism centers created under s. 1004.55. The regional |
219 | centers shall use the proceeds to support the services they |
220 | provide. |
221 | 5. The remaining proceeds from the annual use fee shall be |
222 | available to the Autism Services Grant Council for grants to |
223 | nonprofit organizations to operate direct services programs for |
224 | individuals with autism and related disabilities and their |
225 | families and for marketing the Autism license plate. All grant |
226 | recipients, including Achievement and Rehabilitation Centers, |
227 | Inc., and the Center for Autism and Related Disabilities, shall |
228 | be required to provide to the Autism Services Grant Council an |
229 | annual program and financial report regarding the use of grant |
230 | funds. Such reports shall be made available to the public. |
231 | (d) Notwithstanding any provision of law to the contrary, |
232 | the first $10,000 in proceeds generated from voluntary |
233 | contributions to the Autism License Plate Fund authorized in ss. |
234 | 320.02 and 322.08 shall be retained by the department to offset |
235 | the department's implementation costs. |
236 | (70) LET'S GO SURFING LICENSE PLATES.-- |
237 | (a) The department shall develop a Let's Go Surfing |
238 | license plate as provided in this section. Let's Go Surfing |
239 | license plates must bear the colors and design approved by the |
240 | department. The word "Florida" must appear at the top of the |
241 | plate, and the words "Let's Go Surfing" must appear at the |
242 | bottom of the plate. |
243 | (b) The license plate annual use fees shall be distributed |
244 | to East Coast Surfing Hall of Fame and Museum, Inc., to fund |
245 | activities, programs, and projects to promote Florida's surfing- |
246 | related tourism, preserve Florida's surfing history and |
247 | heritage, preserve Florida's surf and shores, and honor |
248 | lifeguards who patrol Florida's surf and shores to protect |
249 | beachgoers, surfers, and others. East Coast Surfing Hall of Fame |
250 | and Museum, Inc., may retain all revenue from the annual use |
251 | fees until all startup costs for developing and establishing the |
252 | plate have been recovered. Thereafter, up to 10 percent of the |
253 | annual use fee revenue may be used for administration, |
254 | promotion, and marketing of the plate, including annual audit |
255 | and compliance affidavit costs. |
256 | (71) FLORIDA HORSE PARK LICENSE PLATES.-- |
257 | (a) The department shall develop a Florida Horse Park |
258 | license plate as provided in this section. Florida Horse Park |
259 | license plates must bear the colors and design approved by the |
260 | department. The word "Florida" must appear at the top of the |
261 | plate, and the words "Discover Florida's Horses" must appear at |
262 | the bottom of the plate. |
263 | (b) The annual use fees shall be distributed to the |
264 | Florida Agriculture Center and Horse Park Authority created by |
265 | s. 570.952, which shall retain all proceeds until all startup |
266 | costs for developing and establishing the plate have been |
267 | recovered. Thereafter, the proceeds shall be used as follows: |
268 | 1. A maximum of 10 percent of the proceeds from the annual |
269 | use fees may be used for the administration, promotion, and |
270 | marketing of the Florida Horse Park license plate. |
271 | 2. The remaining proceeds shall be used by the authority |
272 | to promote the Florida Agriculture Center and Horse Park located |
273 | in Marion County; to support continued development of the park, |
274 | including the construction of additional educational facilities, |
275 | barns, and other structures; to provide improvements to the |
276 | existing infrastructure at the park; and to provide for |
277 | operational expenses of the Florida Agriculture Center and Horse |
278 | Park. |
279 | (72) ST. JOHNS RIVER LICENSE PLATES.-- |
280 | (a) The department shall develop a St. Johns River license |
281 | plate as provided in this section. St. Johns River license |
282 | plates must bear the colors and design approved by the |
283 | department. The word "Florida" must appear at the top of the |
284 | plate, and the words "St. Johns River" must appear at the bottom |
285 | of the plate. |
286 | (b) The requirements of s. 320.08053 must be met prior to |
287 | the issuance of the plate. Thereafter, the license plate annual |
288 | use fees shall be distributed to the St. Johns River Alliance, |
289 | Inc., a s. 501(c)(3) nonprofit organization, which shall |
290 | administer the fees as follows: |
291 | 1. The St. Johns River Alliance, Inc., shall retain the |
292 | first $60,000 of the annual use fees as direct reimbursement for |
293 | administrative costs, startup costs, and costs incurred in the |
294 | development and approval process. Thereafter, up to 10 percent |
295 | of the annual use fee revenue may be used for administrative |
296 | costs directly associated with education programs, conservation, |
297 | research, and grant administration of the organization and for |
298 | promotion and marketing of the specialty license plate. |
299 | 2. At least 30 percent of the fees shall be available for |
300 | competitive grants for targeted community-based or county-based |
301 | research or projects for which state funding is limited or not |
302 | currently available. The remaining 50 percent shall be directed |
303 | toward community outreach and access programs. The competitive |
304 | grants shall be administered and approved by the board of |
305 | directors of the St. Johns River Alliance, Inc. A grant advisory |
306 | committee shall be composed of six members chosen by the St. |
307 | Johns River Alliance board members. |
308 | 3. Any remaining funds shall be distributed with the |
309 | approval of and accountability to the board of directors of the |
310 | St. Johns River Alliance, Inc., and shall be used to support |
311 | activities contributing to education, outreach, and springs |
312 | conservation. |
313 | (73) ENDLESS SUMMER LICENSE PLATES.-- |
314 | (a) The department shall develop an Endless Summer license |
315 | plate as provided in this section. Endless Summer license plates |
316 | must bear the colors and design approved by the department. The |
317 | word "Florida" must appear at the top of the plate, and the |
318 | words "Endless Summer" must appear at the bottom of the plate. |
319 | (b) The license plate annual use fees shall be distributed |
320 | to Surfing's Evolution & Preservation Corporation to fund its |
321 | activities, programs, and projects aimed at preserving the sport |
322 | of surfing. Surfing's Evolution & Preservation Corporation may |
323 | retain all revenue from the annual use fees until all startup |
324 | costs for developing and establishing the plate have been |
325 | recovered. Thereafter, up to 10 percent of the annual use fee |
326 | revenue may be used for promotion and marketing of the specialty |
327 | license plate and administrative costs directly associated with |
328 | the corporation's programs and the specialty license plate. |
329 | Surfing's Evolution & Preservation Corporation shall use the |
330 | remaining funds as follows: |
331 | 1. To fund the proposed Surfing's Evolution & Preservation |
332 | Experience project. |
333 | 2. To provide funds for the provision of lifeguards or the |
334 | building of artificial reefs. |
335 | 3. To provide funds to organizations that house the |
336 | history and artifacts of surfing or promote the sport through |
337 | exhibits, lectures, and events. |
338 | 4. To support programs and events of other organizations |
339 | that support beaches and oceans and promote education on beach |
340 | safety, coastal pollution, and beach ecology. |
341 | (74) CATCH ME, RELEASE ME LICENSE PLATES.-- |
342 | (a) The department shall develop a Catch Me, Release Me |
343 | license plate as provided in this section. Catch Me, Release Me |
344 | license plates must bear the colors and design approved by the |
345 | department. The word "Florida" must appear at the top of the |
346 | plate, and the words "Catch Me, Release Me" must appear at the |
347 | bottom of the plate. |
348 | (b) The license plate annual use fees shall be distributed |
349 | to the Guy Harvey Ocean Foundation, Inc., to fund marine-related |
350 | scientific research, including research of free-ranging pelagic |
351 | marine species that inhabit, use, or migrate through Florida |
352 | waters; conservation initiatives; and education and public |
353 | outreach programs targeting school-aged children in the state. |
354 | The Guy Harvey Ocean Foundation, Inc., may retain all revenue up |
355 | to $60,000 from the annual use fees until all startup costs for |
356 | developing and establishing the plate have been recovered. |
357 | Thereafter, up to 10 percent of the annual use fee revenue may |
358 | be used for administrative costs directly associated with the |
359 | operations of the Guy Harvey Ocean Foundation, Inc., and up to |
360 | 10 percent may be used for promotion and marketing of the |
361 | specialty license plate. |
362 | (75) FRATERNAL ORDER OF POLICE LICENSE PLATES.-- |
363 | (a) The department shall develop a Fraternal Order of |
364 | Police license plate as provided in this section. Fraternal |
365 | Order of Police license plates must bear the colors and design |
366 | approved by the department. The word "Florida" must appear at |
367 | the top of the plate, and the words "Fraternal Order of Police" |
368 | must appear at the bottom of the plate. |
369 | (b) In order to purchase the Fraternal Order of Police |
370 | license plate, a person must submit a certified letter from the |
371 | Florida State Lodge of the Fraternal Order of Police showing |
372 | that he or she qualifies for the use of the Fraternal Order of |
373 | Police law enforcement emblem by being a member in good |
374 | standing. |
375 | (c) The license plate annual use fees shall be distributed |
376 | to the Florida State Lodge Fraternal Order of Police Memorial |
377 | Foundation to fund its activities, programs, and projects aimed |
378 | at preserving, maintaining, and expanding the Florida Fraternal |
379 | Order of Police Law Enforcement Memorial. The Florida State |
380 | Lodge of the Fraternal Order of Police may retain all revenue |
381 | from the annual use fees until all startup costs for developing |
382 | and establishing the plate have been recovered. Thereafter, up |
383 | to 10 percent of the annual use fee revenue may be used for |
384 | promotion and marketing of the specialty license plate and |
385 | administrative costs directly associated with memorial programs |
386 | and the specialty license plate. The Florida State Lodge |
387 | Fraternal Order of Police Memorial Foundation shall use the |
388 | remaining funds as follows: |
389 | 1. To fund the Florida State Fraternal Order of Police Law |
390 | Enforcement Memorial projects. |
391 | 2. To provide funds for the expansion, maintenance, and |
392 | support of the Florida State Lodge Fraternal Order of Police |
393 | Memorial Foundation. |
394 | 3. To provide funds to organizations that help support the |
395 | families of law enforcement officers who have died in the line |
396 | of duty. |
397 | 4. To support programs and events that support the Florida |
398 | Fraternal Order of Police Law Enforcement Memorial. |
399 | (76) GO GREEN FLORIDA LICENSE PLATES.-- |
400 | (a) The department shall develop a Go Green Florida |
401 | license plate as provided in this section. Go Green Florida |
402 | license plates must bear the colors and design approved by the |
403 | department. The word "Florida" must appear at the top of the |
404 | plate, the words "Go Green" must appear on the bottom of the |
405 | plate, and the "Go Green Florida" emblem or logo must appear on |
406 | the plate. |
407 | (b) The requirements of s. 320.08053 must be met prior to |
408 | the issuance of the plate. The annual use fees shall be |
409 | distributed to the Coalition for Renewable Energy Solutions, |
410 | Inc. After reimbursement for documented costs expended to |
411 | establish the plate, the proceeds of the annual use fees shall |
412 | be used in the following manner: |
413 | 1. Up to 10 percent may be used by the Coalition for |
414 | Renewable Energy Solutions, Inc., for administrative, promotion, |
415 | and marketing costs. |
416 | 2. The remainder shall be used to fund the Renewable |
417 | Energy and Energy-Efficient Technologies Grants Program pursuant |
418 | to s. 377.804, the Solar Energy System Incentives Program |
419 | pursuant to s. 377.806, under the Florida Energy and Climate |
420 | Commission, or other educational programs dedicated to providing |
421 | effective alternative energy practices. |
422 | (c) The coalition shall comply with the financial audit |
423 | requirements of s. 320.08062. |
424 | (77) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.-- |
425 | (a) The department shall develop a Florida Biodiversity |
426 | Foundation license plate as provided in this section. Florida |
427 | Biodiversity Foundation license plates must bear the colors and |
428 | design approved by the department. The word "Florida" must |
429 | appear at the top of the plate, and the words "Save Wild |
430 | Florida" must appear at the bottom of the plate. |
431 | (b) The annual use fees shall be distributed to the |
432 | Florida Biodiversity Foundation, Inc., which shall retain 50 |
433 | percent of the proceeds until the startup costs to develop and |
434 | establish the plates have been recovered. Thereafter, the |
435 | proceeds shall be used as follows: |
436 | 1. A maximum of 10 percent of the proceeds may be used to |
437 | fund the administrative, promotion, and marketing costs of the |
438 | license plate program and the foundation. |
439 | 2. The remaining fees shall be used by the foundation to |
440 | fund research, education, and scientific study of the diversity |
441 | of animals and plants and to aid in the preservation, study, |
442 | conservation, and recovery of imperiled organisms. |
443 | (78) TOOMEY FOUNDATION FOR THE NATURAL SCIENCES LICENSE |
444 | PLATES.-- |
445 | (a) The department shall develop a Toomey Foundation for |
446 | the Natural Sciences license plate as provided in this section. |
447 | Toomey Foundation for the Natural Sciences license plates must |
448 | bear the colors and design approved by the department. The word |
449 | "Florida" must appear at the top of the plate, and the words |
450 | "Preserving the Past" must appear at the bottom of the plate. |
451 | (b) The annual use fees shall be distributed to the Toomey |
452 | Foundation for the Natural Sciences, Inc., which shall retain 50 |
453 | percent of the proceeds until the startup costs to develop and |
454 | establish the plates have been recovered. Thereafter, the |
455 | proceeds shall be used as follows: |
456 | 1. A maximum of 10 percent of the proceeds may be used to |
457 | fund the administrative, promotion, and marketing costs of the |
458 | license plate program and the foundation. |
459 | 2. The remaining fees shall be used by the foundation to |
460 | acquire, manage, and preserve properties that are of scientific |
461 | importance to paleontologists, archeologists, or geologists for |
462 | the purposes of research and education and to promote and |
463 | protect the unique natural sciences of this state. |
464 | (79) TRINITY LICENSE PLATES.-- |
465 | (a) The department shall develop a Trinity license plate |
466 | as provided in this section. Trinity license plates must bear |
467 | the colors and design approved by the department. The word |
468 | "Florida" must appear at the top of the plate, and the words |
469 | "Sunshine State" must appear at the bottom of the plate. |
470 | (b) The annual use fees shall be distributed to the Toomey |
471 | Foundation for the Natural Sciences, Inc., which shall retain 50 |
472 | percent of the proceeds until the startup costs to develop and |
473 | establish the plates have been recovered. Thereafter, the |
474 | proceeds shall be used as follows: |
475 | 1. A maximum of 10 percent of the proceeds may be used to |
476 | fund the administrative, promotion, and marketing costs of the |
477 | license plate program and the foundation. |
478 | 2. The remaining fees shall be used by the foundation to |
479 | support educational, research, and scientific activities in this |
480 | state, including the distribution of funds to qualified entities |
481 | in furtherance of the stated purposes of the foundation. |
482 | Section 3. Paragraphs (h) and (i) are added to subsection |
483 | (15) of section 320.02, Florida Statutes, to read: |

487 | (h) The application form for motor vehicle registration |
488 | and renewal of registration must include language permitting a |
489 | voluntary contribution of $5 to the Autism License Plate Fund |
490 | administered by Achievement and Rehabilitation Centers, Inc. |
491 | Except as provided in s. 320.08058(69)(d), such contributions |
492 | must be distributed by the department each month to the Autism |
493 | License Plate Fund administered by Achievement and |
494 | Rehabilitation Centers, Inc., to be used as provided in s. |
495 | 320.08058(69). |
496 | (i) The application form for motor vehicle registration |
497 | and renewal of registration must include language permitting a |
498 | voluntary contribution of $1 to Ronald McDonald Houses of |
499 | Florida. Such contributions must be distributed by the |
500 | department each month to Ronald McDonald House Charities Tampa |
501 | Bay, Inc., a not-for-profit organization. |

503 | For the purpose of applying the service charge provided in s. |
504 | 215.20, contributions received under this subsection are not |
505 | income of a revenue nature. |
506 | Section 4. Section 320.0706, Florida Statutes, is amended |
507 | to read: |
508 | 320.0706 Display of license plates on trucks.--The owner |
509 | of any commercial truck of gross vehicle weight of 26,001 pounds |
510 | or more shall display the registration license plate on both the |
511 | front and rear of the truck in conformance with all the |
512 | requirements of s. 316.605 that do not conflict with this |
513 | section. The owner of a dump truck may place the rear license |
514 | plate on the gate no higher than 60 inches to allow for better |
515 | visibility. However, the owner of a truck tractor shall be |
516 | required to display the registration license plate only on the |
517 | front of such vehicle. The owner of any wrecker issued a regular |
518 | wrecker license plate shall display the license plate only on |
519 | the front of the vehicle. The owner of any wrecker issued gross |
520 | vehicle weight wrecker license plates shall display the license |
521 | plates on both the front and rear of the vehicle in conformance |
522 | with the requirements of s. 316.605 that do not conflict with |
523 | this section. A violation of this section is a noncriminal |
524 | traffic infraction, punishable as a moving violation as provided |
525 | in chapter 318. |
526 | Section 5. Subsection (6) of section 322.08, Florida |
527 | Statutes, is amended to read: |
528 | 322.08 Application for license.-- |
529 | (6) The application form for a driver's license or |
530 | duplicate thereof shall include language permitting the |
531 | following: |
532 | (a) A voluntary contribution of $1 per applicant, which |
533 | contribution shall be deposited into the Health Care Trust Fund |
534 | for organ and tissue donor education and for maintaining the |
535 | organ and tissue donor registry. |
536 | (b) A voluntary contribution of $1 per applicant, which |
537 | contribution shall be distributed to the Florida Council of the |
538 | Blind. |
539 | (c) A voluntary contribution of $2 per applicant, which |
540 | shall be distributed to the Hearing Research Institute, |
541 | Incorporated. |
542 | (d) A voluntary contribution of $1 per applicant, which |
543 | shall be distributed to the Juvenile Diabetes Foundation |
544 | International. |
545 | (e) A voluntary contribution of $1 per applicant, which |
546 | shall be distributed to the Children's Hearing Help Fund. |
547 | (f) A voluntary contribution of $1 per applicant, which |
548 | shall be distributed to Family First, a nonprofit organization. |
549 | (g) A voluntary contribution of $5 per applicant, which, |
550 | except as provided in s. 320.08058(69)(d), shall be distributed |
551 | to the Autism License Plate Fund administered by Achievement and |
552 | Rehabilitation Centers, Inc., to be used as provided in s. |
553 | 320.08058(69). |

555 | A statement providing an explanation of the purpose of the trust |
556 | funds shall also be included. For the purpose of applying the |
557 | service charge provided in s. 215.20, contributions received |
558 | under paragraphs (b), (c), (d), (e), and (f), and (g) and under |
559 | s. 322.18(9)(a) are not income of a revenue nature. |
560 | Section 6. This act shall take effect September 1, 2009. |
