19 | (www) Fraternal Order of Police license plate, $25. |

22 | (13) Effective July 1, 2011, in addition to the |
23 | requirements of subsections (10) and (11) and notwithstanding |
24 | any specific authority provided in s. 320.08058, an organization |
25 | or entity receiving annual use fee revenue from the sale of a |
26 | specialty license plate may use no more than a total of 10 |
27 | percent of the revenues for administrative, marketing, and |
28 | promotion costs, including annual audit and compliance affidavit |
29 | costs. |
30 | (14) Notwithstanding any other provision of this chapter, |
31 | no annual use fee revenue derived from the sale of a specialty |
32 | license plate, or the interest thereon, shall be expended on |
33 | projects or programs outside this state. |
34 | Section 2. Subsection (29), paragraph (b) of subsection |
35 | (32), and subsection (35) of section 320.08058, Florida |
36 | Statutes, are amended, and subsections (69) through (77) are |
37 | added to that section, to read: |
38 | 320.08058 Specialty license plates.-- |
39 | (29) CHOOSE LIFE LICENSE PLATES.-- |
40 | (a) The department shall develop a Choose Life license |
41 | plate as provided in this section. The word "Florida" must |
42 | appear at the bottom of the plate, and the words "Choose Life" |
43 | must appear at the top of the plate. |
44 | (b) The annual use fees shall be distributed quarterly to |
45 | Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a |
46 | list of annually to each county in the ratio that the annual use |
47 | fees collected by each county bears to the total fees collected |
48 | for the plates within the state. |
49 | (c) Up to 10 percent of the fees may be used for |
50 | administrative costs directly associated with the operations of |
51 | Choose Life, Inc., and activities by Choose Life, Inc., to |
52 | promote adoption and to market the license plate in this state. |
53 | Choose Life, Inc., shall administer distribution of the |
54 | remaining Each county shall distribute the funds to |
55 | nongovernmental, not-for-profit agencies within the county, |
56 | which agencies' services primarily consist of are limited to |
57 | counseling and meeting the physical needs of pregnant women who |
58 | are considering committed to placing their children for |
59 | adoption. |
60 | 1. Funds may not be distributed to any agency that is |
61 | involved or associated with abortion activities, including |
62 | counseling for or referrals to abortion clinics, providing |
63 | medical abortion-related procedures, or proabortion advertising, |
64 | and funds may not be distributed to any agency that charges |
65 | women for services received. |
66 | 2. Choose Life, Inc., may, from time to time, establish |
67 | criteria pertaining to appropriate percentages of expenditures |
68 | on items including, but not limited to, physical needs of women, |
69 | physical needs of infants awaiting adoption, counseling, |
70 | advertising, and training. |
71 | 3. Choose Life license plate funds generated in counties |
72 | that do not have a qualified service provider shall be |
73 | distributed by Choose Life, Inc., to qualified service providers |
74 | in other counties. |
75 | 4. Funds shall not be removed from a county with active |
76 | qualified service providers for distribution to service |
77 | providers in other counties unless year-end unused fund balances |
78 | exceed 20 percent of the county's annual Choose Life license |
79 | plate revenues for 3 consecutive years. If year-end fund |
80 | balances exceed 20 percent of a county's annual revenues for 3 |
81 | consecutive years, such balance may be distributed by Choose |
82 | Life, Inc., to qualified service providers in other counties. |
83 | 1. Agencies that receive the funds must use at least 70 |
84 | percent of the funds to provide for the material needs of |
85 | pregnant women who are committed to placing their children for |
86 | adoption, including clothing, housing, medical care, food, |
87 | utilities, and transportation. Such funds may also be expended |
88 | on infants awaiting placement with adoptive parents. |
89 | 2. The remaining funds may be used for adoption, |
90 | counseling, training, or advertising, but may not be used for |
91 | administrative expenses, legal expenses, or capital |
92 | expenditures. |
93 | 5.3. Each service provider agency that receives such funds |
94 | must submit an annual attestation to Choose Life, Inc., which |
95 | shall, upon request, make copies available to a state agency |
96 | charged with auditing the county. Any unused funds that exceed |
97 | 10 percent of the funds received by an agency during its fiscal |
98 | year must be returned to the county, which shall distribute them |
99 | to other qualified agencies. |
100 | 6. Choose Life license plate use fees generated in this |
101 | state may only be spent on activities within this state. |
102 | (d)1. Within 90 days after the effective date of this |
103 | paragraph, county commissions that have never distributed Choose |
104 | Life funds shall forward such funds to Choose Life, Inc., for |
105 | distribution. |
106 | 2. Within 180 days after the effective date of this |
107 | paragraph, county commissions that have been distributing Choose |
108 | Life funds shall forward fund balances to Choose Life, Inc., for |
109 | distribution. |
110 | (32) UNITED WE STAND LICENSE PLATES.-- |
111 | (b) The department shall retain all revenues from the sale |
112 | of such plates until all startup costs for developing and |
113 | issuing the plates have been recovered. Thereafter, |
114 | notwithstanding s. 332.14, 100 percent of the annual use fee |
115 | shall be distributed to the Department of Transportation SAFE |
116 | Council for the development and implementation of programs to |
117 | fund a grant program to enhance security at airports throughout |
118 | the state, pursuant to s. 332.14. Up to 10 percent of the annual |
119 | use fee revenue may be used for administration, promotion, and |
120 | marketing of the plate, including annual audit and compliance |
121 | affidavit costs. |
122 | (35) FLORIDA GOLF LICENSE PLATES.-- |
123 | (a) The Department of Highway Safety and Motor Vehicles |
124 | shall develop a Florida Golf license plate as provided in this |
125 | section. The word "Florida" must appear at the bottom of the |
126 | plate. The Dade Amateur Golf Association, following consultation |
127 | with the PGA TOUR, the Florida Sports Foundation, the LPGA, and |
128 | the PGA of America may submit a revised sample plate for |
129 | consideration by the department. |
130 | (b) The department shall distribute the Florida Golf |
131 | license plate annual use fee to the Dade Amateur Golf |
132 | Association, a s. 501(c)(3) organization Florida Sports |
133 | Foundation, a direct-support organization of the Office of |
134 | Tourism, Trade, and Economic Development. The license plate |
135 | annual use fees are to be annually allocated as follows: |
136 | 1. Up to 10 5 percent of the proceeds from the annual use |
137 | fees may be used by the Dade Amateur Golf Association Florida |
138 | Sports Foundation for the administration of the Florida Junior |
139 | Youth Golf Program. |
140 | 2. The Dade Amateur Golf Association shall receive the |
141 | first $80,000 in proceeds from the annual use fees for the |
142 | operation of youth golf programs in Miami-Dade County. |
143 | Thereafter, 15 percent of the proceeds from the annual use fees |
144 | shall be provided to the Dade Amateur Golf Association for the |
145 | operation of youth golf programs in Miami-Dade County. |
146 | 3. The remaining proceeds from the annual use fees shall |
147 | be available for grants to nonprofit organizations to operate |
148 | youth golf programs and for marketing the Florida Golf license |
149 | plates. All grant recipients, including the Dade Amateur Golf |
150 | Association, shall be required to provide to the Dade Amateur |
151 | Golf Association Florida Sports Foundation an annual program and |
152 | financial report regarding the use of grant funds. Such reports |
153 | shall be made available to the public. |
154 | (c) The Dade Amateur Golf Association shall Florida Sports |
155 | Foundation may establish a Florida Junior Golf Council Youth |
156 | Golf Program. The Florida Junior Golf Council Youth Golf Program |
157 | shall assist organizations for the benefit of youth, introduce |
158 | young people to golf, instruct young people in golf, teach the |
159 | values of golf, and stress life skills, fair play, courtesy, and |
160 | self-discipline. |
161 | (d) The Dade Amateur Golf Association Florida Sports |
162 | Foundation shall establish a seven-member Florida Junior Golf |
163 | Council committee to offer advice regarding the distribution of |
164 | the annual use fees for grants to nonprofit organizations. The |
165 | council advisory committee shall consist of one member from a |
166 | group serving youth, one member from a group serving disabled |
167 | youth, and five members at large. |
168 | (69) AUTISM LICENSE PLATES.-- |
169 | (a) The department shall develop an Autism license plate |
170 | as provided in this section. Autism license plates must bear the |
171 | colors and design approved by the department. The word "Florida" |
172 | must appear at the top of the plate, and the words "Support |
173 | Autism Programs" must appear at the bottom of the plate. |
174 | (b) The proceeds from the license plate annual use fee |
175 | shall be distributed to Achievement and Rehabilitation Centers, |
176 | Inc., to fund service programs for autism and related |
177 | disabilities throughout the state and to operate and establish |
178 | programs to support individuals with autism and related |
179 | disabilities through direct services, evaluation, training, and |
180 | awareness. Achievement and Rehabilitation Centers, Inc., shall |
181 | establish an Autism Services Grant Council that shall provide |
182 | grants from available Autism license plate proceeds to nonprofit |
183 | organizations for direct services and programs for individuals |
184 | with autism and related disabilities and their families. |
185 | Consideration for participation in such services and programs |
186 | shall be given to applicants who are children or adults with |
187 | autism and related disabilities and their families and shall |
188 | include those who are on the Agency for Persons with |
189 | Disabilities waiting lists for services. Achievement and |
190 | Rehabilitation Centers, Inc., shall also establish an Autism |
191 | License Plate Fund. Moneys in the fund shall be used by the |
192 | grant council as provided in this paragraph. All funds received |
193 | under this subsection must be used in this state. |
194 | (c) Achievement and Rehabilitation Centers, Inc., may |
195 | retain all proceeds from the annual use fee up to $85,000 until |
196 | all documented startup costs for developing and establishing the |
197 | plate have been recovered. Thereafter, the proceeds from the |
198 | annual use fee shall be used as follows: |
199 | 1. Up to 10 percent of the proceeds from the annual use |
200 | fee may be used for the administration of the Autism License |
201 | Plate Fund, the Autism Services Grant Council, and related |
202 | matters. |
203 | 2. Funds may be used as necessary for annual audit or |
204 | compliance affidavit costs. |
205 | 3. Thirty-five percent of the proceeds from the annual use |
206 | fee shall be used to establish and operate programs to support |
207 | individuals with autism and related disabilities and their |
208 | families through direct services, evaluation, training, and |
209 | awareness in the state. |
210 | 4. The Center for Autism and Related Disabilities at the |
211 | University of Miami shall receive 15 percent of the proceeds |
212 | from the annual use fee for distribution, as determined |
213 | appropriate by the director of that center, to the seven |
214 | regional autism centers created under s. 1004.55. The regional |
215 | centers shall use the proceeds to support the services they |
216 | provide. |
217 | 5. The remaining proceeds from the annual use fee shall be |
218 | available to the Autism Services Grant Council for grants to |
219 | nonprofit organizations to operate direct services programs for |
220 | individuals with autism and related disabilities and their |
221 | families and for marketing the Autism license plate. All grant |
222 | recipients, including Achievement and Rehabilitation Centers, |
223 | Inc., and the Center for Autism and Related Disabilities, shall |
224 | be required to provide to the Autism Services Grant Council an |
225 | annual program and financial report regarding the use of grant |
226 | funds. Such reports shall be made available to the public. |
227 | (d) Notwithstanding any provision of law to the contrary, |
228 | the first $10,000 in proceeds generated from voluntary |
229 | contributions to the Autism License Plate Fund authorized in ss. |
230 | 320.02 and 322.08 shall be retained by the department to offset |
231 | the department's implementation costs. |
232 | (70) LET'S GO SURFING LICENSE PLATES.-- |
233 | (a) The department shall develop a Let's Go Surfing |
234 | license plate as provided in this section. Let's Go Surfing |
235 | license plates must bear the colors and design approved by the |
236 | department. The word "Florida" must appear at the top of the |
237 | plate, and the words "Let's Go Surfing" must appear at the |
238 | bottom of the plate. |
239 | (b) The license plate annual use fees shall be distributed |
240 | to East Coast Surfing Hall of Fame and Museum, Inc., to fund |
241 | activities, programs, and projects to promote Florida's surfing- |
242 | related tourism, preserve Florida's surfing history and |
243 | heritage, preserve Florida's surf and shores, and honor |
244 | lifeguards who patrol Florida's surf and shores to protect |
245 | beachgoers, surfers, and others. East Coast Surfing Hall of Fame |
246 | and Museum, Inc., may retain all revenue from the annual use |
247 | fees until all startup costs for developing and establishing the |
248 | plate have been recovered. Thereafter, up to 10 percent of the |
249 | annual use fee revenue may be used for administration, |
250 | promotion, and marketing of the plate, including annual audit |
251 | and compliance affidavit costs. |
252 | (71) FLORIDA HORSE PARK LICENSE PLATES.-- |
253 | (a) The department shall develop a Florida Horse Park |
254 | license plate as provided in this section. Florida Horse Park |
255 | license plates must bear the colors and design approved by the |
256 | department. The word "Florida" must appear at the top of the |
257 | plate, and the words "Discover Florida's Horses" must appear at |
258 | the bottom of the plate. |
259 | (b) The annual use fees shall be distributed to the |
260 | Florida Agriculture Center and Horse Park Authority created by |
261 | s. 570.952, which shall retain all proceeds until all startup |
262 | costs for developing and establishing the plate have been |
263 | recovered. Thereafter, the proceeds shall be used as follows: |
264 | 1. A maximum of 10 percent of the proceeds from the annual |
265 | use fees may be used for the administration, promotion, and |
266 | marketing of the Florida Horse Park license plate. |
267 | 2. The remaining proceeds shall be used by the authority |
268 | to promote the Florida Agriculture Center and Horse Park located |
269 | in Marion County; to support continued development of the park, |
270 | including the construction of additional educational facilities, |
271 | barns, and other structures; to provide improvements to the |
272 | existing infrastructure at the park; and to provide for |
273 | operational expenses of the Florida Agriculture Center and Horse |
274 | Park. |
275 | (72) ST. JOHNS RIVER LICENSE PLATES.-- |
276 | (a) The department shall develop a St. Johns River license |
277 | plate as provided in this section. St. Johns River license |
278 | plates must bear the colors and design approved by the |
279 | department. The word "Florida" must appear at the top of the |
280 | plate, and the words "St. Johns River" must appear at the bottom |
281 | of the plate. |
282 | (b) The requirements of s. 320.08053 must be met prior to |
283 | the issuance of the plate. Thereafter, the license plate annual |
284 | use fees shall be distributed to the St. Johns River Alliance, |
285 | Inc., a s. 501(c)(3) nonprofit organization, which shall |
286 | administer the fees as follows: |
287 | 1. The St. Johns River Alliance, Inc., shall retain the |
288 | first $60,000 of the annual use fees as direct reimbursement for |
289 | administrative costs, startup costs, and costs incurred in the |
290 | development and approval process. Thereafter, up to 10 percent |
291 | of the annual use fee revenue may be used for administrative |
292 | costs directly associated with education programs, conservation, |
293 | research, and grant administration of the organization and for |
294 | promotion and marketing of the specialty license plate. |
295 | 2. At least 30 percent of the fees shall be available for |
296 | competitive grants for targeted community-based or county-based |
297 | research or projects for which state funding is limited or not |
298 | currently available. The remaining 50 percent shall be directed |
299 | toward community outreach and access programs. The competitive |
300 | grants shall be administered and approved by the board of |
301 | directors of the St. Johns River Alliance, Inc. A grant advisory |
302 | committee shall be composed of six members chosen by the St. |
303 | Johns River Alliance board members. |
304 | 3. Any remaining funds shall be distributed with the |
305 | approval of and accountability to the board of directors of the |
306 | St. Johns River Alliance, Inc., and shall be used to support |
307 | activities contributing to education, outreach, and springs |
308 | conservation. |
309 | (73) ENDLESS SUMMER LICENSE PLATES.-- |
310 | (a) The department shall develop an Endless Summer license |
311 | plate as provided in this section. Endless Summer license plates |
312 | must bear the colors and design approved by the department. The |
313 | word "Florida" must appear at the top of the plate, and the |
314 | words "Endless Summer" must appear at the bottom of the plate. |
315 | (b) The license plate annual use fees shall be distributed |
316 | to Surfing's Evolution & Preservation Corporation to fund its |
317 | activities, programs, and projects aimed at preserving the sport |
318 | of surfing. Surfing's Evolution & Preservation Corporation may |
319 | retain all revenue from the annual use fees until all startup |
320 | costs for developing and establishing the plate have been |
321 | recovered. Thereafter, up to 10 percent of the annual use fee |
322 | revenue may be used for promotion and marketing of the specialty |
323 | license plate and administrative costs directly associated with |
324 | the corporation's programs and the specialty license plate. |
325 | Surfing's Evolution & Preservation Corporation shall use the |
326 | remaining funds as follows: |
327 | 1. To fund the proposed Surfing's Evolution & Preservation |
328 | Experience project. |
329 | 2. To provide funds for the provision of lifeguards or the |
330 | building of artificial reefs. |
331 | 3. To provide funds to organizations that house the |
332 | history and artifacts of surfing or promote the sport through |
333 | exhibits, lectures, and events. |
334 | 4. To support programs and events of other organizations |
335 | that support beaches and oceans and promote education on beach |
336 | safety, coastal pollution, and beach ecology. |
337 | (74) CATCH ME, RELEASE ME LICENSE PLATES.-- |
338 | (a) The department shall develop a Catch Me, Release Me |
339 | license plate as provided in this section. Catch Me, Release Me |
340 | license plates must bear the colors and design approved by the |
341 | department. The word "Florida" must appear at the top of the |
342 | plate, and the words "Catch Me, Release Me" must appear at the |
343 | bottom of the plate. |
344 | (b) The license plate annual use fees shall be distributed |
345 | to the Guy Harvey Ocean Foundation, Inc., to fund marine-related |
346 | scientific research, including research of free-ranging pelagic |
347 | marine species that inhabit, use, or migrate through Florida |
348 | waters; conservation initiatives; and education and public |
349 | outreach programs targeting school-aged children in the state. |
350 | The Guy Harvey Ocean Foundation, Inc., may retain all revenue up |
351 | to $60,000 from the annual use fees until all startup costs for |
352 | developing and establishing the plate have been recovered. |
353 | Thereafter, up to 10 percent of the annual use fee revenue may |
354 | be used for administrative costs directly associated with the |
355 | operations of the Guy Harvey Ocean Foundation, Inc., and up to |
356 | 10 percent may be used for promotion and marketing of the |
357 | specialty license plate. |
358 | (75) FRATERNAL ORDER OF POLICE LICENSE PLATES.-- |
359 | (a) The department shall develop a Fraternal Order of |
360 | Police license plate as provided in this section. Fraternal |
361 | Order of Police license plates must bear the colors and design |
362 | approved by the department. The word "Florida" must appear at |
363 | the top of the plate, and the words "Fraternal Order of Police" |
364 | must appear at the bottom of the plate. |
365 | (b) In order to purchase the Fraternal Order of Police |
366 | license plate, a person must submit a certified letter from the |
367 | Florida State Lodge of the Fraternal Order of Police showing |
368 | that he or she qualifies for the use of the Fraternal Order of |
369 | Police law enforcement emblem by being a member in good |
370 | standing. |
371 | (c) The license plate annual use fees shall be distributed |
372 | to the Florida State Lodge Fraternal Order of Police Memorial |
373 | Foundation to fund its activities, programs, and projects aimed |
374 | at preserving, maintaining, and expanding the Florida Fraternal |
375 | Order of Police Law Enforcement Memorial. The Florida State |
376 | Lodge of the Fraternal Order of Police may retain all revenue |
377 | from the annual use fees until all startup costs for developing |
378 | and establishing the plate have been recovered. Thereafter, up |
379 | to 10 percent of the annual use fee revenue may be used for |
380 | promotion and marketing of the specialty license plate and |
381 | administrative costs directly associated with memorial programs |
382 | and the specialty license plate. The Florida State Lodge |
383 | Fraternal Order of Police Memorial Foundation shall use the |
384 | remaining funds as follows: |
385 | 1. To fund the Florida State Fraternal Order of Police Law |
386 | Enforcement Memorial projects. |
387 | 2. To provide funds for the expansion, maintenance, and |
388 | support of the Florida State Lodge Fraternal Order of Police |
389 | Memorial Foundation. |
390 | 3. To provide funds to organizations that help support the |
391 | families of law enforcement officers who have died in the line |
392 | of duty. |
393 | 4. To support programs and events that support the Florida |
394 | Fraternal Order of Police Law Enforcement Memorial. |
395 | (76) GO GREEN FLORIDA LICENSE PLATES.-- |
396 | (a) The department shall develop a Go Green Florida |
397 | license plate as provided in this section. Go Green Florida |
398 | license plates must bear the colors and design approved by the |
399 | department. The word "Florida" must appear at the top of the |
400 | plate, the words "Go Green" must appear on the bottom of the |
401 | plate, and the "Go Green Florida" emblem or logo must appear on |
402 | the plate. |
403 | (b) The requirements of s. 320.08053 must be met prior to |
404 | the issuance of the plate. The annual use fees shall be |
405 | distributed to the Coalition for Renewable Energy Solutions, |
406 | Inc. After reimbursement for documented costs expended to |
407 | establish the plate, the proceeds of the annual use fees shall |
408 | be used in the following manner: |
409 | 1. Up to 10 percent may be used by the Coalition for |
410 | Renewable Energy Solutions, Inc., for administrative, promotion, |
411 | and marketing costs. |
412 | 2. The remainder shall be used to fund the Solar Energy |
413 | System Incentives Program pursuant to s. 377.806, as directed by |
414 | the Florida Energy and Climate Commission. These funds may be |
415 | remitted directly from the department to the Solar Energy System |
416 | Incentives Program on a quarterly basis based on a calculation |
417 | of fees collected. |
418 | (c) The Coalition for Renewable Energy Solutions, Inc., |
419 | shall submit financial records and statements to the Office of |
420 | the Auditor General for all expenditures related to the Go Green |
421 | Florida program no later than 60 days after the end of each |
422 | fiscal year. |
423 | (d) The "Go Green Florida" emblem or logo may be |
424 | authorized for use by the department in recognition of energy- |
425 | efficient vehicle usage and practices. The display of the decal |
426 | for energy-efficient practices may not be considered a |
427 | substitute for a legal license tag. |
428 | (77) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.-- |
429 | (a) The department shall develop a Florida Biodiversity |
430 | Foundation license plate as provided in this section. Florida |
431 | Biodiversity Foundation license plates must bear the colors and |
432 | design approved by the department. The word "Florida" must |
433 | appear at the top of the plate, and the words "Save Wild |
434 | Florida" must appear at the bottom of the plate. |
435 | (b) The annual use fees shall be distributed to the |
436 | Florida Biodiversity Foundation, Inc., which shall retain 50 |
437 | percent of the proceeds until the startup costs to develop and |
438 | establish the plates have been recovered. Thereafter, the |
439 | proceeds shall be used as follows: |
440 | 1. A maximum of 10 percent of the proceeds may be used to |
441 | fund the administrative, promotion, and marketing costs of the |
442 | license plate program and the foundation. |
443 | 2. The remaining fees shall be used by the foundation to |
444 | fund research, education, and scientific study of the diversity |
445 | of animals and plants and to aid in the preservation, study, |
446 | conservation, and recovery of imperiled organisms. |
447 | Section 3. Paragraphs (h) and (i) are added to subsection |
448 | (15) of section 320.02, Florida Statutes, to read: |

452 | (h) The application form for motor vehicle registration |
453 | and renewal of registration must include language permitting a |

466 | Bay, Inc., a not-for-profit organization. |

468 | For the purpose of applying the service charge provided in s. |
469 | 215.20, contributions received under this subsection are not |
470 | income of a revenue nature. |
471 | Section 4. Section 320.0706, Florida Statutes, is amended |
472 | to read: |
473 | 320.0706 Display of license plates on trucks.--The owner |
474 | of any commercial truck of gross vehicle weight of 26,001 pounds |
475 | or more shall display the registration license plate on both the |
476 | front and rear of the truck in conformance with all the |
477 | requirements of s. 316.605 that do not conflict with this |
478 | section. The owner of a dump truck may place the rear license |
479 | plate on the gate no higher than 60 inches to allow for better |
480 | visibility. However, the owner of a truck tractor shall be |
481 | required to display the registration license plate only on the |
482 | front of such vehicle. The owner of any wrecker issued a regular |
483 | wrecker license plate shall display the license plate only on |
484 | the front of the vehicle. The owner of any wrecker issued gross |
485 | vehicle weight wrecker license plates shall display the license |
486 | plates on both the front and rear of the vehicle in conformance |
487 | with the requirements of s. 316.605 that do not conflict with |
488 | this section. A violation of this section is a noncriminal |
489 | traffic infraction, punishable as a moving violation as provided |
490 | in chapter 318. |
491 | Section 5. Subsection (6) of section 322.08, Florida |
492 | Statutes, is amended to read: |
493 | 322.08 Application for license.-- |
494 | (6) The application form for a driver's license or |
495 | duplicate thereof shall include language permitting the |
496 | following: |
497 | (a) A voluntary contribution of $1 per applicant, which |
498 | contribution shall be deposited into the Health Care Trust Fund |
499 | for organ and tissue donor education and for maintaining the |
500 | organ and tissue donor registry. |
501 | (b) A voluntary contribution of $1 per applicant, which |
502 | contribution shall be distributed to the Florida Council of the |
503 | Blind. |
504 | (c) A voluntary contribution of $2 per applicant, which |
505 | shall be distributed to the Hearing Research Institute, |
506 | Incorporated. |
507 | (d) A voluntary contribution of $1 per applicant, which |
508 | shall be distributed to the Juvenile Diabetes Foundation |
509 | International. |
510 | (e) A voluntary contribution of $1 per applicant, which |
511 | shall be distributed to the Children's Hearing Help Fund. |
512 | (f) A voluntary contribution of $1 per applicant, which |
513 | shall be distributed to Family First, a nonprofit organization. |
514 | (g) A voluntary contribution of $5 per applicant, which, |
515 | except as provided in s. 320.08058(69)(d), shall be distributed |
516 | to the Autism License Plate Fund administered by Achievement and |
517 | Rehabilitation Centers, Inc., to be used as provided in s. |
518 | 320.08058(69). |

520 | A statement providing an explanation of the purpose of the trust |
521 | funds shall also be included. For the purpose of applying the |
522 | service charge provided in s. 215.20, contributions received |
523 | under paragraphs (b), (c), (d), (e), and (f), and (g) and under |
524 | s. 322.18(9)(a) are not income of a revenue nature. |
525 | Section 6. This act shall take effect September 1, 2009. |
