5 Section 1. Paragraph (cc) of subsection (4) of section
6 320.08056, Florida Statutes, is amended, and paragraphs (qqq)
7 through (zzz)are added to that section to read:
8 320.08056 Specialty license plates.—
9 (4) The following license plate annual use fees shall be
10 collected for the appropriate specialty license plates:
11 (cc) Choose Life license plate, $25 $20.
12 (qqq) Florida Horse Park license plate $25.
13 (rrr) Let's Go Surfing license plate $25.
14 (sss) Fraternal Order of Police license plate $25.
15 (ttt) Autism license plate license plate $25.
16 (uuu) Go Green Florida license plate $25.
17 (vvv) Catch Me, Release Me license plate $25.
18 (www) Endless Summer license plate $25.
19 (xxx) St. Johns River license plate $25.
20 (yyy) Florida Biodiversity Foundation license plate $25.
21 (zzz) Preserving the Past license plate $25.
22 Section 2. Paragraph (c) is added to subsection (29) of
23 section 320.08058, Florida Statutes, paragraph (b) of subsection
24 (32) of that section, is amended, and subsections (69), (70),
25 (71), (72), (73), (74), (75), (76), (77), and (78) are added to
26 that section, to read:
27 320.08058 Specialty license plates.—
28 (29) CHOOSE LIFE LICENSE PLATES.—
29 (c) Choose Life license plate funds generated in counties
30 that do not have a qualified service provider or have not
31 submitted an attestation within the last 12 months shall be
32 redistributed by the department, in an equitable manner, to
33 counties having a qualified service provider.
34 (32) UNITED WE STAND LICENSE PLATES.—
35 (b) The department shall retain all revenues from the sale
36 of such plates until all startup costs for developing and
37 issuing the plates have been recovered. Thereafter,
38 notwithstanding the provisions of s. 332.14, 100 percent of the
39 annual use fee shall be distributed to the Department of
40 Transportation SAFE Council for the development and
41 implementation of programs to fund a grant program to enhance
42 security at airports throughout the state, pursuant to s.
43 332.14. Up to 10 percent of the annual use fee revenue may be
44 used for administration, promotion, and marketing of the plate,
45 including the annual audit and compliance affidavit costs.
46 (69) FLORIDA HORSE PARK LICENSE PLATES.—
47 (a) The department shall develop a Florida Horse Park
48 license plate as provided in this section. The plate must bear
49 the colors and design approved by the department. The word
50 “Florida” must appear at the top of the plate and the words
51 “Discover Florida’s Horses” must appear at the bottom of the
52 plate.
53 (b) The annual use fees shall be distributed to the Florida
54 Agriculture Center and Horse Park Authority created by s.
55 570.952, which shall retain all proceeds until the startup costs
56 to develop and establish the plates have been recovered.
57 Thereafter, the proceeds shall be used as follows:
58 1. A maximum of 10 percent of the proceeds may be used to
59 administer the license plate program.
60 2. A maximum of 15 percent of the proceeds may be used to
61 promote and market the license plates.
62 3. The remaining fees shall be used by the authority to
63 promote the Florida Agriculture Center and Horse Park located in
64 Marion County; to support continued development of the park,
65 including the construction of additional educational facilities,
66 barns, and other structures; to provide improvements to the
67 existing infrastructure at the park; and to provide for
68 operational expenses of the park.
69 (70) LET’S GO SURFING LICENSE PLATES.—
70 (a) This subsection may be cited as the “Erik Jersted
71 Memorial Act.”
72 (b) The department shall develop a Let’s Go Surfing license
73 plate as provided in this section. Let’s Go Surfing license
74 plates must bear the colors and design approved by the
75 department. The word “Florida” must appear at the top of the
76 plate, and the words “Let’s Go Surfing” must appear at the
77 bottom of the plate.
78 (c) The license plate annual use fees shall be distributed
79 to East Coast Surfing Hall of Fame and Museum, Inc., to fund
80 activities, programs, and projects to promote Florida’s surfing
81 related tourism, preserve Florida’s surfing history and
82 heritage, preserve Florida’s surf and shores, and honor
83 lifeguards who patrol Florida’s surf and shores to protect
84 beach-goers, surfers, and others. East Coast Surfing Hall of
85 Fame and Museum, Inc., may retain all revenue from the annual
86 use fees until all startup costs for developing and establishing
87 the plate have been recovered. Thereafter, up to 25 percent of
88 the annual use fee revenue may be used for administration,
89 promotion, and marketing of the plate, including costs of the
90 annual audit and compliance affidavit.
91 (71) FRATERNAL ORDER OF POLICE LICENSE PLATES.—
92 (a)1. The department shall develop a Fraternal Order of
93 Police license plate as provided in this section. The plate must
94 bear the colors and design approved by the department. The word
95 “Florida” must appear at the top of the plate and the words
96 “Fraternal Order of Police” must appear at the bottom of the
97 plate.
98 2. The department may issue the plate only to an applicant
99 who submits a notarized letter from the Florida State Lodge of
100 the Fraternal Order of Police stating that the applicant is a
101 member of the lodge in good standing or a member of a lodge
102 member’s family, together with other fees and documents required
103 for a specialty plate.
104 (b) The annual use fees shall be distributed to the Florida
105 State Lodge of the Fraternal Order of Police, which shall retain
106 all proceeds until the startup costs to develop and establish
107 the plate have been recovered. Thereafter, the proceeds shall be
108 distributed to the Florida State Lodge Memorial Foundation of
109 the Fraternal Order of Police and used as follows:
110 1. A maximum of 25 percent of the proceeds may be used to
111 promote and market the plate, to administer the license plate
112 program, and to pay administrative costs directly associated
113 with the state Fraternal Order of Police Law Enforcement
114 Memorial.
115 2. The remaining fees shall be used by the foundation to
116 fund projects, programs, or events related to the memorial or to
117 fund improvements, maintenance, or other support for the
118 memorial.
119 (72) AUTISM LICENSE PLATES.—
120 (a) The department shall develop an Autism license plate as
121 provided in this section. Autism license plates must bear the
122 colors and design approved by the department. The word “Florida”
123 must appear at the top of the plate, and the words “Support
124 Autism Programs” must appear at the bottom of the plate.
125 (b) The proceeds from the license plate annual use fee
126 shall be distributed to Achievement and Rehabilitation Centers,
127 Inc., to fund service programs for autism and related
128 disabilities throughout the state and to operate and establish
129 programs to support individuals with autism and related
130 disabilities through direct services, evaluation, training, and
131 awareness. Achievement and Rehabilitation Centers, Inc., shall
132 establish an Autism Services Grant Council whose membership
133 shall be drawn from among stakeholders throughout the state who
134 represent the interests of individuals with autism and related
135 disabilities. The grant council shall provide grants from
136 available Autism license plate proceeds to nonprofit
137 organizations throughout the state to establish or operate
138 direct services and programs for individuals with autism and
139 related disabilities and their families or to market the Autism
140 license plate. Consideration for participation in such services
141 and programs shall be given to applicants who are children or
142 adults with autism and related disabilities and their families
143 and shall include those who are on the Agency for Persons with
144 Disabilities waiting lists for services. Achievement and
145 Rehabilitation Centers, Inc., shall also establish an Autism
146 License Plate Fund. Moneys in the fund shall be used by the
147 grant council as provided in this paragraph. All funds received
148 under this subsection must be used in this state.
149 (c) Achievement and Rehabilitation Centers, Inc., may
150 retain all proceeds from the annual use fee up to $85,000 until
151 all documented startup costs for developing and establishing the
152 plate have been recovered. Thereafter, the proceeds from the
153 annual use fee shall be used as follows:
154 1. Achievement and Rehabilitation Centers, Inc., may use up
155 to 10 percent of the proceeds from the annual use fee for all
156 administrative costs associated with the operation of the Autism
157 Services Grant Council, the Autism License Plate Fund, and the
158 programs established and operated as provided in subparagraph
159 2., including the costs of an annual audit or compliance
160 affidavit.
161 2. Achievement and Rehabilitation Centers, Inc., may use up
162 to 25 percent of the proceeds from the annual use fee to
163 establish and operate programs statewide to support individuals
164 with autism and related disabilities and their families through
165 direct services, evaluation, and training.
166 3. Achievement and Rehabilitation Centers, Inc., shall
167 disburse 15 percent of the proceeds from the annual use fee to
168 the Center for Autism and Related Disabilities at the University
169 of Miami for distribution to the seven regional autism centers
170 created under s. 1004.55. To the extent possible, the director
171 of the Center for Autism and Related Disabilities at the
172 University of Miami shall distribute funds proportionately among
173 the regional centers. The regional centers shall use the funds
174 to support the services they provide.
175 4. Achievement and Rehabilitation Centers, Inc., shall
176 disburse 50 percent of the proceeds from the annual use fee to
177 the Autism Services Grant Council, which shall provide grants to
178 nonprofit organizations throughout the state to establish or
179 operate direct services and programs for individuals with autism
180 and related disabilities and their families or to market the
181 Autism license plate.

183 All grant recipients, the Achievement and Rehabilitation
184 Centers, Inc., and the Center for Autism and Related
185 Disabilities at the University of Miami shall provide to the
186 Autism Services Grant Council an annual program and financial
187 report regarding the use of the proceeds from the annual use
188 fee. The report shall be made available to the public.
189 (73) GO GREEN FLORIDA LICENSE PLATES.—
190 (a) The department shall develop a Go Green Florida license
191 plate as provided in this section. The plate must bear the
192 colors and design approved by the department. The word “Florida”
193 must appear at the top of the plate, and the words “Go Green
194 Florida” must appear at the bottom of the plate. The Go Green
195 Florida emblem or logo must appear on the plate.
196 (b) The requirements of s. 320.08053 must be met before the
197 issuance of the plate.
198 (c) The proceeds from the sale of the plate shall be
199 distributed to the Coalition for Renewable Energy Solutions,
200 Inc. After reimbursement for documented costs expended to
201 establish the plates and for annual auditing costs, the
202 coalition shall use the proceeds of the annual use fees in the
203 following manner:
204 1. A maximum of 5 percent shall be used for administrative
205 costs directly associated with the management and distribution
206 of the proceeds.
207 2. A maximum of 25 percent shall be used for the continuing
208 statewide promotion and marketing of the plate.
209 3. Seventy percent shall be used to fund the Renewable
210 Energy and Energy Efficient Technology Grants program pursuant
211 to s. 377.804, the Solar Energy System Incentives program
212 pursuant to s. 377.806, under the Florida Energy and Climate
213 Commission, or other educational programs dedicated to providing
214 effective alternative energy practices.
215 (d) The coalition shall comply with the financial audit
216 requirements of s. 320.08062.
217 (e) The Go Green Florida emblem or logo may be used as a
218 decal by the department in recognition of energy-efficient
219 vehicle usage and practices. However, the display of the decal
220 is not a substitute for a license plate.
221 (74) CATCH ME, RELEASE ME LICENSE PLATES.—
222 (a) The department shall develop a Catch Me, Release Me
223 license plate as provided in this section. The plates must bear
224 the colors and design approved by the department. The word
225 “Florida” must appear at the top of the plate, and the words
226 “Catch Me, Release Me” must appear at the bottom of the plate.
227 (b) The annual use fees shall be distributed to the Guy
228 Harvey Ocean Foundation, Inc., which shall administer the fees
229 as follows:
230 1. The foundation shall retain the first $60,000 of the
231 annual use fees as direct reimbursement for administrative
232 costs, startup costs, and costs incurred in the development and
233 approval of the plates. Thereafter, up to 15 percent of the
234 annual use fees may be used for administrative costs directly
235 associated with the operation of the foundation and up to 10
236 percent may be used for promotion and marketing of the plate.
237 2. Any remaining funds shall be used by the foundation to
238 fund scientific research related to marine issues, including
239 research of free-ranging pelagic marine species that inhabit,
240 use, or migrate through the waters of this state, and to fund
241 conservation initiatives and education and public outreach
242 programs for school-aged children.
243 (75) ENDLESS SUMMER LICENSE PLATES.—
244 (a) The department shall develop an Endless Summer license
245 plate as provided in this section. Endless Summer license plates
246 must bear the colors and design approved by the department. The
247 word “Florida” must appear at the top of the plate, and the
248 words “Endless Summer” must appear at the bottom of the plate.
249 (b) The license plate annual use fees shall be distributed
250 to Surfing’s Evolution & Preservation Corporation to fund its
251 activities, programs, and projects aimed at preserving the sport
252 of surfing. Surfing’s Evolution & Preservation Corporation may
253 retain all revenue from the annual use fees until all startup
254 costs for developing and establishing the plate have been
255 recovered. Thereafter, up to 25 percent of the annual use fee
256 revenue may be used for promotion and marketing of the specialty
257 license plate and administrative costs directly associated with
258 the corporation’s programs and the specialty license plate.
259 Surfing’s Evolution & Preservation Corporation shall use the
260 remaining funds as follows:
261 1. To fund the proposed Surfing’s Evolution & Preservation
262 Experience project.
263 2. To provide funds for the provision of lifeguards or the
264 building of artificial reefs.
265 3. To provide funds to organizations that house the history
266 and artifacts of surfing or promote the sport through exhibits,
267 lectures, and events.
268 4. To support programs and events of other organizations
269 that support beaches and oceans and promote education on beach
270 safety, coastal pollution, and beach ecology.
271 (76) ST. JOHNS RIVER LICENSE PLATES.—
272 (a) The department shall develop a St. Johns River license
273 plate as provided in this section. The St. Johns River license
274 plates must bear the colors and design approved by the
275 department. The word “Florida” must appear at the top of the
276 plate, and the words “St. Johns River” must appear at the bottom
277 of the plate.
278 (b) The requirements of s. 320.08053 must be met prior to
279 the issuance of the plate. Thereafter, the license plate annual
280 use fees shall be distributed to the St. Johns River Alliance,
281 Inc., a 501(c)(3) nonprofit organization, which shall administer
282 the fees as follows:
283 1. The St. Johns River Alliance, Inc., shall retain the
284 first $60,000 of the annual use fees as direct reimbursement for
285 administrative costs, startup costs, and costs incurred in the
286 development and approval process. Thereafter, up to 10 percent
287 of the annual use fee revenue may be used for administrative
288 costs directly associated with education programs, conservation,
289 research, and grant administration of the organization and up to
290 10 percent may be used for promotion and marketing of the
291 specialty license plate.
292 2. At least 30 percent of the fees shall be available for
293 competitive grants for targeted community-based or county-based
294 research or projects for which state funding is limited or not
295 currently available. The remaining 50 percent shall be directed
296 toward community outreach and access programs. The competitive
297 grants shall be administered and approved by the board of
298 directors of the St. Johns River Alliance, Inc. A grant advisory
299 committee shall be composed of six members chosen by the St.
300 Johns River Alliance board members.
301 3. Any remaining funds shall be distributed with the
302 approval of and accountability to the board of directors of the
303 St. Johns River Alliance, Inc., and shall be used to support
304 activities contributing to education, outreach, and springs
305 conservation.
306 (77) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.—
307 (a) The department shall develop a Florida Biodiversity
308 Foundation license plate as provided in this section. Florida
309 Biodiversity Foundation license plates must bear the colors and
310 design approved by the department. The word “Florida” must
311 appear at the top of the plate, and the words “Save Wild
312 Florida” must appear at the bottom of the plate.
313 (b) The annual use fees shall be distributed to the Florida
314 Biodiversity Foundation, Inc., which shall retain 50 percent of
315 the proceeds until the startup costs to develop and establish
316 the plates have been recovered. Thereafter, the proceeds shall
317 be used as follows:
318 1. A maximum of 25 percent of the proceeds may be used to
319 fund the administrative, promotion, and marketing costs of the
320 license plate program and the foundation.
321 2. The remaining fees shall be used by the foundation to
322 fund research, education, and scientific study of the diversity
323 of animals and plants and to aid in the preservation, study,
324 conservation, and recovery of imperiled organisms.
325 (78) PRESERVING THE PAST LICENSE PLATES.—
326 (a) The department shall develop a Preserving the Past
327 license plate as provided in this section. The plate must bear
328 the colors and design approved by the department. The word
329 “Florida” must appear at the top of the plate, and the words
330 “Preserving the Past” must appear at the bottom of the plate.
331 (b) The annual use fees shall be distributed to the Toomey
332 Foundation for the Natural Sciences, Inc., which shall retain 50
333 percent of the proceeds until the startup costs to develop and
334 establish the plates have been recovered. Thereafter, the
335 proceeds shall be used as follows:
336 1. A maximum of 25 percent of the proceeds may be used to
337 fund the administrative, promotion, and marketing costs of the
338 license plate program and the foundation.
339 2. The remaining fees shall be used by the foundation to
340 acquire, manage, and preserve properties that are of scientific
341 importance to paleontologists, archeologists, or geologists for
342 the purposes of research and education, and to promote and
343 protect the unique natural sciences of this state.
344 Section 3. Paragraph (h) is added to subsection (15) of
345 section 320.02, Florida Statutes, to read:
346 320.02 Registration required; application for registration;
347 forms.—
348 (15)
349 (h) The application form for motor vehicle registration and
350 renewal of registration must include language permitting a
351 voluntary contribution of $1 to Ronald McDonald Houses of
352 Florida. Such contributions must be distributed by the
353 department each month to Ronald McDonald House Charities Tampa
354 Bay, Inc., a not-for-profit organization.

356 For the purpose of applying the service charge provided in s.
357 215.20, contributions received under this subsection are not
358 income of a revenue nature.
359 Section 4. This act shall take effect September 1, 2009.

376 River license plate; A Florida Biodiversity Foundation license
377 plate; and a Preserving the Past license plate; providing for
378 the distribution of use fees received from the sale of such
379 plates; amending s. 320.02, F.S., requiring the application form
380 for motor vehicle registration and renewal of registration to
381 include language permitting a voluntary contribution to the
382 Ronald McDonald Houses of Florida; revising provisions for
383 distribution of such contributions; providing an effective date.
