5 Section 6. Paragraphs (zzz), (aaaa), (bbbb), and (cccc) are
6 added to subsection (4) of section 320.08056, Florida Statutes,
7 to read:
8 320.08056 Specialty license plates.—
9 (4) The following license plate annual use fees shall be
10 collected for the appropriate specialty license plates:
11 (zzz) Hispanics Settled Florida in 1565 license plate, $25.
12 (aaaa) Florida Biodiversity Foundation license plate, $25.
13 (bbbb) Preserving the Past license plate, $25.
14 (cccc) Trinity license plate, $25.
15 Section 7. Subsections (78), (79), (80), and (81) are added
16 to section 320.08058, Florida Statutes, to read:
17 320.08058 Specialty license plates.—
18 (78) HISPANICS SETTLED FLORIDA IN 1565 LICENSE PLATES.—
19 (a) The department shall develop a Hispanics Settled
20 Florida in 1565 license plate as provided in this section.
21 (b) Hispanics Settled Florida in 1565 license plates must
22 bear the colors and design approved by the department. The word
23 “Florida” must appear at the top of the plate, and the words
24 “HISPANICS SETTLED FLORIDA” must appear at the bottom of the
25 plate.
26 (c) The department shall retain all revenues from the sale
27 of such plates until all startup costs for developing and
28 issuing the plates have been recovered. Thereafter, 50 percent
29 of the annual use fees shall be distributed to National Hispanic
30 Corporate Achievers, Inc., an organization in Orlando that
31 sponsors minority job fairs. The remaining 50 percent shall be
32 distributed to Florida Hispanic Foundation. The fees shall be
33 used to support job and mentorship programs and to provide
34 scholarship grants for needy students from minority communities
35 in this state.
36 (d) By January 1, 2010, the department shall establish a
37 method to issue a Hispanics Settled Florida in 1565 license
38 plate voucher to allow for the presale of the Hispanics Settled
39 Florida in 1565 license plate. Issuance of the vouchers is
40 contingent upon payment of an application fee of $10,000 no
41 later than December 1, 2009. The processing fee as prescribed in
42 s. 320.08056, the service charge and branch charge as prescribed
43 in s. 320.04, and the annual use fee as prescribed in s.
44 320.08056 shall be charged for the voucher. All other applicable
45 fees shall be charged at the time of issuance of the license
46 plate. The approved Hispanics Settled Florida in 1565 license
47 plate organization must, within 24 months after the
48 establishment of the presale voucher, record with the department
49 a minimum of 1,000 voucher sales before manufacture of the
50 Hispanics Settled Florida in 1565 license plate can commence.
51 If, at the conclusion of the 24-month presale period, the
52 minimum sales requirements have not been met, the Hispanics
53 Settled Florida in 1565 license plate is deauthorized and the
54 department shall discontinue development of the plate and
55 discontinue issuance of the presale vouchers as prescribed in s.
56 320.08056. Upon deauthorization of the license plate, a
57 purchaser of the Hispanics Settled Florida in 1565 license plate
58 voucher may use the annual use fee collected as a credit towards
59 any other specialty license plate or apply for a refund on a
60 form prescribed by the department. This paragraph expires
61 January 1, 2012.
62 (79) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.—
63 (a) The department shall develop a Florida Biodiversity
64 Foundation license plate as provided in this section. Florida
65 Biodiversity Foundation license plates must bear the colors and
66 design approved by the department. The word “Florida” must
67 appear at the top of the plate, and the words “Save Wild
68 Florida” must appear at the bottom of the plate.
69 (b) The annual use fees shall be distributed to the Florida
70 Biodiversity Foundation, Inc., which shall retain 50 percent of
71 the proceeds until the startup costs to develop and establish
72 the plates have been recovered. Thereafter, the proceeds shall
73 be used as follows:
74 1. A maximum of 25 percent of the proceeds may be used to
75 fund the administrative, promotion, and marketing costs of the
76 license plate program and the foundation.
77 2. The remaining fees shall be used by the foundation to
78 fund research, education, and scientific study of the diversity
79 of animals and plants and to aid in the preservation, study,
80 conservation, and recovery of imperiled organisms.
81 (80) PRESERVING THE PAST LICENSE PLATES.—
82 (a) The department shall develop a Preserving the Past
83 license plate as provided in this section. The plate must bear
84 the colors and design approved by the department. The word
85 “Florida” must appear at the top of the plate, and the words
86 “Preserving the Past” must appear at the bottom of the plate.
87 (b) The annual use fees shall be distributed to the Toomey
88 Foundation for the Natural Sciences, Inc., which shall retain 50
89 percent of the proceeds until the startup costs to develop and
90 establish the plates have been recovered. Thereafter, the
91 proceeds shall be used as follows:
92 1. A maximum of 25 percent of the proceeds may be used to
93 fund the administrative, promotion, and marketing costs of the
94 license plate program and the foundation.
95 2. The remaining fees shall be used by the foundation to
96 acquire, manage, and preserve properties that are of scientific
97 importance to paleontologists, archeologists, or geologists for
98 the purposes of research and education, and to promote and
99 protect the unique natural sciences of this state.
100 (81) TRINITY LICENSE PLATES.—
101 (a) The department shall develop a Trinity license plate as
102 provided in this section. The plate must bear the colors and
103 design approved by the department. The word “Florida” must
104 appear at the top of the plate and the words “Sunshine State”
105 must appear at the bottom of the plate.
106 (b) The annual use fees shall be distributed to the Toomey
107 Foundation for the Natural Sciences, Inc., which shall retain 50
108 percent of the proceeds until the startup costs to develop and
109 establish the plates have been recovered. Thereafter, the
110 proceeds shall be used as follows:
111 1. A maximum of 25 percent of the proceeds may be used to
112 fund the administrative, promotion, and marketing costs of the
113 license plate program and the foundation.
114 2. The remaining fees shall be used by the foundation to
115 support educational, research, and scientific activities in this
116 state, including the distribution of funds to qualified entities
117 in furtherance of the stated purposes of the foundation.
