Paragraphs (zzz) and (aaaa) are added to 6 subsection (4) of section 320.08056, Florida Statutes, to read: 7 320.08056 Specialty license plates.— 8 (4) The following license plate annual use fees shall be 9 collected for the appropriate specialty license plates: 10 (zzz) Hispanics Settled Florida in 1565 license plate, $25. 11 (aaaa) Children First license plate, $25. 12 Section 7. Subsections (78) and (79) are added to section 13 320.08058, Florida Statutes, to read: 14 320.08058 Specialty license plates.— 15 (78) HISPANICS SETTLED FLORIDA IN 1565 LICENSE PLATES.— 16 (a) The department shall develop a Hispanics Settled 17 Florida in 1565 license plate as provided in this section. 18 (b) Hispanics Settled Florida in 1565 license plates must 19 bear the colors and design approved by the department. The word 20 “Florida” must appear at the top of the plate, and the words 21 “HISPANICS SETTLED FLORIDA” must appear at the bottom of the 22 plate. 23 (c) The department shall retain all revenues from the sale 24 of such plates until all startup costs for developing and 25 issuing the plates have been recovered. Thereafter, 50 percent 26 of the annual use fees shall be distributed to National Hispanic 27 Corporate Achievers, Inc., an organization in Orlando that 28 sponsors minority job fairs. The remaining 50 percent shall be 29 distributed to Florida Hispanic Foundation. The fees shall be 30 used to support job and mentorship programs and to provide 31 scholarship grants for needy students from minority communities 32 in this state. 33 (d) By January 1, 2010, the department shall establish a 34 method to issue a Hispanics Settled Florida in 1565 license 35 plate voucher to allow for the presale of the Hispanics Settled 36 Florida in 1565 license plate. Issuance of the vouchers is 37 contingent upon payment of an application fee of $10,000 no 38 later than December 1, 2009. The processing fee as prescribed in 39 s. 320.08056, the service charge and branch charge as prescribed 40 in s. 320.04, and the annual use fee as prescribed in s. 41 320.08056 shall be charged for the voucher. All other applicable 42 fees shall be charged at the time of issuance of the license 43 plate. The approved Hispanics Settled Florida in 1565 license 44 plate organization must, within 24 months after the 45 establishment of the presale voucher, record with the department 46 a minimum of 1,000 voucher sales before manufacture of the 47 Hispanics Settled Florida in 1565 license plate can commence. 48 If, at the conclusion of the 24-month presale period, the 49 minimum sales requirements have not been met, the Hispanics 50 Settled Florida in 1565 license plate is deauthorized and the 51 department shall discontinue development of the plate and 52 discontinue issuance of the presale vouchers as prescribed in s. 53 320.08056. Upon deauthorization of the license plate, a 54 purchaser of the Hispanics Settled Florida in 1565 license plate 55 voucher may use the annual use fee collected as a credit towards 56 any other specialty license plate or apply for a refund on a 57 form prescribed by the department. This paragraph expires 58 January 1, 2012. 59 (79) CHILDREN FIRST LICENSE PLATES.— 60 (a) The department shall develop a Children First license 61 plate as provided in this section. The plate must bear the 62 colors and design approved by the department. The word “Florida” 63 must appear at the top of the plate and the words “Children 64 First” must appear at the bottom of the plate. 65 (b) The annual use fees shall be distributed to Children 66 First Florida, Inc., which shall retain all proceeds until the 67 startup costs to develop and establish the plates have been 68 recovered. Thereafter, the proceeds shall be used as follows: 69 1. A maximum of 15 percent of the proceeds may be used to 70 administer the license plate program and for direct 71 administrative costs associated with the operations of Children 72 First Florida, Inc. 73 2. A maximum of 10 percent of the proceeds may be used to 74 promote and market the license plates. 75 3. The remaining fees shall be used by Children First 76 Florida, Inc., to fund public schools in this state, including 77 teacher salaries. 78 79 ================= T I T L E A M E N D M E N T ================ 80 And the title is amended as follows: 81 Delete lines 28 - 29 82 and insert: 83 amending ss. 320.08056 and 320.08058, F.S.; creating a 84 Hispanics Settled Florida in 1565 license plate and a 85 Children First license plate;
