17 | such plates; amending s. 320.02, F.S.; requiring the |
18 | application form for motor vehicle registration and |
19 | renewal of registration to include language permitting a |
20 | voluntary contribution to the Autism License Plate Fund |
21 | and Ronald McDonald Houses of Florida; providing for |
22 | distribution of such contributions; amending s. 320.06, |
23 | F.S.; revising the period after which a registration |
24 | license plate must be replaced; revising the fees for such |
25 | replacement; removing a requirement that license plates |
26 | and validation stickers be treated with a retroreflective |
27 | material; removing a requirement that the size of |
28 | validation stickers be specified by the department; |
29 | revising the purpose of a fee collected on each motor |
30 | vehicle registration or motor vehicle renewal registration |
31 | issued; amending s. 320.0706, F.S.; providing for the |
32 | display of license plates on wreckers; providing |
33 | penalties; amending s. 322.08, F.S.; requiring the |
34 | application form for a driver's license or duplicate |
35 | thereof to include language permitting a voluntary |
36 | contribution to the Autism License Plate Fund; providing |
37 | an effective date. |

39 | Be It Enacted by the Legislature of the State of Florida: |
40 |
|
41 | Section 1. Paragraph (cc) of subsection (4) of section |
42 | 320.08056, Florida Statutes, is amended, paragraphs (qqq) |
43 | through (yyy) are added to that subsection, and subsections (13) |
44 | and (14) are added to that section, to read: |
45 | 320.08056 Specialty license plates.-- |
46 | (4) The following license plate annual use fees shall be |
47 | collected for the appropriate specialty license plates: |
48 | (cc) Choose Life license plate, $25 $20. |
49 | (qqq) Autism license plate, $25. |
50 | (rrr) Let's Go Surfing license plate, $25. |
51 | (sss) Florida Horse Park license plate, $25. |
52 | (ttt) St. Johns River license plate, $25. |
53 | (uuu) Endless Summer license plate, $25. |
54 | (vvv) Catch Me, Release Me license plate, $25. |
55 | (www) Fraternal Order of Police license plate, $25. |
56 | (xxx) Go Green Florida license plate, $25. |
57 | (yyy) Florida Biodiversity Foundation license plate, $25. |
58 | (13) Effective July 1, 2011, in addition to the |
59 | requirements of subsections (10) and (11) and notwithstanding |
60 | any specific authority provided in s. 320.08058, an organization |
61 | or entity receiving annual use fee revenue from the sale of a |
62 | specialty license plate may use no more than a total of 10 |
63 | percent of the revenues for administrative, marketing, and |
64 | promotion costs, including annual audit and compliance affidavit |
65 | costs. |
66 | (14) Notwithstanding any other provision of this chapter, |
67 | no annual use fee revenue derived from the sale of a specialty |
68 | license plate, or the interest thereon, shall be expended on |
69 | projects or programs outside this state. |
70 | Section 2. Subsection (29), paragraph (b) of subsection |
71 | (32), and subsection (35) of section 320.08058, Florida |
72 | Statutes, are amended, and subsections (69) through (77) are |
73 | added to that section, to read: |
74 | 320.08058 Specialty license plates.-- |
75 | (29) CHOOSE LIFE LICENSE PLATES.-- |
76 | (a) The department shall develop a Choose Life license |
77 | plate as provided in this section. The word "Florida" must |
78 | appear at the bottom of the plate, and the words "Choose Life" |
79 | must appear at the top of the plate. |
80 | (b) The annual use fees shall be distributed quarterly to |
81 | Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a |
82 | list of annually to each county in the ratio that the annual use |
83 | fees collected by each county bears to the total fees collected |
84 | for the plates within the state. |
85 | (c) Up to 10 percent of the fees may be used for |
86 | administrative costs directly associated with the operations of |
87 | Choose Life, Inc., and activities by Choose Life, Inc., to |
88 | promote adoption and to market the license plate in this state. |
89 | Choose Life, Inc., shall administer distribution of the |
90 | remaining Each county shall distribute the funds to |
91 | nongovernmental, not-for-profit agencies within the county, |
92 | which agencies' services primarily consist of are limited to |
93 | counseling and meeting the physical needs of pregnant women who |
94 | are considering committed to placing their children for |
95 | adoption. |
96 | 1. Funds may not be distributed to any agency that is |
97 | involved or associated with abortion activities, including |
98 | counseling for or referrals to abortion clinics, providing |
99 | medical abortion-related procedures, or proabortion advertising, |
100 | and funds may not be distributed to any agency that charges |
101 | women for services received. |
102 | 2. Choose Life, Inc., may, from time to time, establish |
103 | criteria pertaining to appropriate percentages of expenditures |
104 | on items including, but not limited to, physical needs of women, |
105 | physical needs of infants awaiting adoption, counseling, |
106 | advertising, and training. |
107 | 3. Choose Life license plate funds generated in counties |
108 | that do not have a qualified service provider shall be |
109 | distributed by Choose Life, Inc., to qualified service providers |
110 | in other counties. |
111 | 4. Funds shall not be removed from a county with active |
112 | qualified service providers for distribution to service |
113 | providers in other counties unless year-end unused fund balances |
114 | exceed 20 percent of the county's annual Choose Life license |
115 | plate revenues for 3 consecutive years. If year-end fund |
116 | balances exceed 20 percent of a county's annual revenues for 3 |
117 | consecutive years, such balance may be distributed by Choose |
118 | Life, Inc., to qualified service providers in other counties. |
119 | 1. Agencies that receive the funds must use at least 70 |
120 | percent of the funds to provide for the material needs of |
121 | pregnant women who are committed to placing their children for |
122 | adoption, including clothing, housing, medical care, food, |
123 | utilities, and transportation. Such funds may also be expended |
124 | on infants awaiting placement with adoptive parents. |
125 | 2. The remaining funds may be used for adoption, |
126 | counseling, training, or advertising, but may not be used for |
127 | administrative expenses, legal expenses, or capital |
128 | expenditures. |
129 | 5.3. Each service provider agency that receives such funds |
130 | must submit an annual attestation to Choose Life, Inc., which |
131 | shall, upon request, make copies available to a state agency |
132 | charged with auditing the county. Any unused funds that exceed |
133 | 10 percent of the funds received by an agency during its fiscal |
134 | year must be returned to the county, which shall distribute them |
135 | to other qualified agencies. |
136 | 6. Choose Life license plate use fees generated in this |
137 | state may only be spent on activities within this state. |
138 | (d)1. Within 90 days after the effective date of this |
139 | paragraph, county commissions that have never distributed Choose |
140 | Life funds shall forward such funds to Choose Life, Inc., for |
141 | distribution. |
142 | 2. Within 180 days after the effective date of this |
143 | paragraph, county commissions that have been distributing Choose |
144 | Life funds shall forward fund balances to Choose Life, Inc., for |
145 | distribution. |
146 | (32) UNITED WE STAND LICENSE PLATES.-- |
147 | (b) The department shall retain all revenues from the sale |
148 | of such plates until all startup costs for developing and |
149 | issuing the plates have been recovered. Thereafter, |
150 | notwithstanding s. 332.14, 100 percent of the annual use fee |
151 | shall be distributed to the Department of Transportation SAFE |
152 | Council for the development and implementation of programs to |
153 | fund a grant program to enhance security at airports throughout |
154 | the state, pursuant to s. 332.14. Up to 10 percent of the annual |
155 | use fee revenue may be used for administration, promotion, and |
156 | marketing of the plate, including annual audit and compliance |
157 | affidavit costs. |
158 | (35) FLORIDA GOLF LICENSE PLATES.-- |
159 | (a) The Department of Highway Safety and Motor Vehicles |
160 | shall develop a Florida Golf license plate as provided in this |
161 | section. The word "Florida" must appear at the bottom of the |
162 | plate. The Dade Amateur Golf Association, following consultation |
163 | with the PGA TOUR, the Florida Sports Foundation, the LPGA, and |
164 | the PGA of America may submit a revised sample plate for |
165 | consideration by the department. |
166 | (b) The department shall distribute the Florida Golf |
167 | license plate annual use fee to the Dade Amateur Golf |
168 | Association, a s. 501(c)(3) organization Florida Sports |
169 | Foundation, a direct-support organization of the Office of |
170 | Tourism, Trade, and Economic Development. The license plate |
171 | annual use fees are to be annually allocated as follows: |
172 | 1. Up to 10 5 percent of the proceeds from the annual use |
173 | fees may be used by the Dade Amateur Golf Association Florida |
174 | Sports Foundation for the administration of the Florida Junior |
175 | Youth Golf Program. |
176 | 2. The Dade Amateur Golf Association shall receive the |
177 | first $80,000 in proceeds from the annual use fees for the |
178 | operation of youth golf programs in Miami-Dade County. |
179 | Thereafter, 15 percent of the proceeds from the annual use fees |
180 | shall be provided to the Dade Amateur Golf Association for the |
181 | operation of youth golf programs in Miami-Dade County. |
182 | 3. The remaining proceeds from the annual use fees shall |
183 | be available for grants to nonprofit organizations to operate |
184 | youth golf programs and for marketing the Florida Golf license |
185 | plates. All grant recipients, including the Dade Amateur Golf |
186 | Association, shall be required to provide to the Dade Amateur |
187 | Golf Association Florida Sports Foundation an annual program and |
188 | financial report regarding the use of grant funds. Such reports |
189 | shall be made available to the public. |
190 | (c) The Dade Amateur Golf Association shall Florida Sports |
191 | Foundation may establish a Florida Junior Golf Council Youth |
192 | Golf Program. The Florida Junior Golf Council Youth Golf Program |
193 | shall assist organizations for the benefit of youth, introduce |
194 | young people to golf, instruct young people in golf, teach the |
195 | values of golf, and stress life skills, fair play, courtesy, and |
196 | self-discipline. |
197 | (d) The Dade Amateur Golf Association Florida Sports |
198 | Foundation shall establish a seven-member Florida Junior Golf |
199 | Council committee to offer advice regarding the distribution of |
200 | the annual use fees for grants to nonprofit organizations. The |
201 | council advisory committee shall consist of one member from a |
202 | group serving youth, one member from a group serving disabled |
203 | youth, and five members at large. |
204 | (69) AUTISM LICENSE PLATES.-- |
205 | (a) The department shall develop an Autism license plate |
206 | as provided in this section. Autism license plates must bear the |
207 | colors and design approved by the department. The word "Florida" |
208 | must appear at the top of the plate, and the words "Support |
209 | Autism Programs" must appear at the bottom of the plate. |
210 | (b) The proceeds from the license plate annual use fee |
211 | shall be distributed to Achievement and Rehabilitation Centers, |
212 | Inc., to fund service programs for autism and related |
213 | disabilities throughout the state and to operate and establish |
214 | programs to support individuals with autism and related |
215 | disabilities through direct services, evaluation, training, and |
216 | awareness. Achievement and Rehabilitation Centers, Inc., shall |
217 | establish an Autism Services Grant Council that shall provide |
218 | grants from available Autism license plate proceeds to nonprofit |
219 | organizations for direct services and programs for individuals |
220 | with autism and related disabilities and their families. |
221 | Consideration for participation in such services and programs |
222 | shall be given to applicants who are children or adults with |
223 | autism and related disabilities and their families and shall |
224 | include those who are on the Agency for Persons with |
225 | Disabilities waiting lists for services. Achievement and |
226 | Rehabilitation Centers, Inc., shall also establish an Autism |
227 | License Plate Fund. Moneys in the fund shall be used by the |
228 | grant council as provided in this paragraph. All funds received |
229 | under this subsection must be used in this state. |
230 | (c) Achievement and Rehabilitation Centers, Inc., may |
231 | retain all proceeds from the annual use fee up to $85,000 until |
232 | all documented startup costs for developing and establishing the |
233 | plate have been recovered. Thereafter, the proceeds from the |
234 | annual use fee shall be used as follows: |
235 | 1. Up to 10 percent of the proceeds from the annual use |
236 | fee may be used for the administration of the Autism License |
237 | Plate Fund, the Autism Services Grant Council, and related |
238 | matters. |
239 | 2. Funds may be used as necessary for annual audit or |
240 | compliance affidavit costs. |
241 | 3. Thirty-five percent of the proceeds from the annual use |
242 | fee shall be used to establish and operate programs to support |
243 | individuals with autism and related disabilities and their |
244 | families through direct services, evaluation, training, and |
245 | awareness in the state. |
246 | 4. The Center for Autism and Related Disabilities at the |
247 | University of Miami shall receive 15 percent of the proceeds |
248 | from the annual use fee for distribution, as determined |
249 | appropriate by the director of that center, to the seven |
250 | regional autism centers created under s. 1004.55. The regional |
251 | centers shall use the proceeds to support the services they |
252 | provide. |
253 | 5. The remaining proceeds from the annual use fee shall be |
254 | available to the Autism Services Grant Council for grants to |
255 | nonprofit organizations to operate direct services programs for |
256 | individuals with autism and related disabilities and their |
257 | families and for marketing the Autism license plate. All grant |
258 | recipients, including Achievement and Rehabilitation Centers, |
259 | Inc., and the Center for Autism and Related Disabilities, shall |
260 | be required to provide to the Autism Services Grant Council an |
261 | annual program and financial report regarding the use of grant |
262 | funds. Such reports shall be made available to the public. |
263 | (d) Notwithstanding any provision of law to the contrary, |
264 | the first $10,000 in proceeds generated from voluntary |
265 | contributions to the Autism License Plate Fund authorized in ss. |
266 | 320.02 and 322.08 shall be retained by the department to offset |
267 | the department's implementation costs. |
268 | (70) LET'S GO SURFING LICENSE PLATES.-- |
269 | (a) The department shall develop a Let's Go Surfing |
270 | license plate as provided in this section. Let's Go Surfing |
271 | license plates must bear the colors and design approved by the |
272 | department. The word "Florida" must appear at the top of the |
273 | plate, and the words "Let's Go Surfing" must appear at the |
274 | bottom of the plate. |
275 | (b) The license plate annual use fees shall be distributed |
276 | to East Coast Surfing Hall of Fame and Museum, Inc., to fund |
277 | activities, programs, and projects to promote Florida's surfing- |
278 | related tourism, preserve Florida's surfing history and |
279 | heritage, preserve Florida's surf and shores, and honor |
280 | lifeguards who patrol Florida's surf and shores to protect |
281 | beachgoers, surfers, and others. East Coast Surfing Hall of Fame |
282 | and Museum, Inc., may retain all revenue from the annual use |
283 | fees until all startup costs for developing and establishing the |
284 | plate have been recovered. Thereafter, up to 10 percent of the |
285 | annual use fee revenue may be used for administration, |
286 | promotion, and marketing of the plate, including annual audit |
287 | and compliance affidavit costs. |
288 | (71) FLORIDA HORSE PARK LICENSE PLATES.-- |
289 | (a) The department shall develop a Florida Horse Park |
290 | license plate as provided in this section. Florida Horse Park |
291 | license plates must bear the colors and design approved by the |
292 | department. The word "Florida" must appear at the top of the |
293 | plate, and the words "Discover Florida's Horses" must appear at |
294 | the bottom of the plate. |
295 | (b) The annual use fees shall be distributed to the |
296 | Florida Agriculture Center and Horse Park Authority created by |
297 | s. 570.952, which shall retain all proceeds until all startup |
298 | costs for developing and establishing the plate have been |
299 | recovered. Thereafter, the proceeds shall be used as follows: |
300 | 1. A maximum of 10 percent of the proceeds from the annual |
301 | use fees may be used for the administration, promotion, and |
302 | marketing of the Florida Horse Park license plate. |
303 | 2. The remaining proceeds shall be used by the authority |
304 | to promote the Florida Agriculture Center and Horse Park located |
305 | in Marion County; to support continued development of the park, |
306 | including the construction of additional educational facilities, |
307 | barns, and other structures; to provide improvements to the |
308 | existing infrastructure at the park; and to provide for |
309 | operational expenses of the Florida Agriculture Center and Horse |
310 | Park. |
311 | (72) ST. JOHNS RIVER LICENSE PLATES.-- |
312 | (a) The department shall develop a St. Johns River license |
313 | plate as provided in this section. St. Johns River license |
314 | plates must bear the colors and design approved by the |
315 | department. The word "Florida" must appear at the top of the |
316 | plate, and the words "St. Johns River" must appear at the bottom |
317 | of the plate. |
318 | (b) The requirements of s. 320.08053 must be met prior to |
319 | the issuance of the plate. Thereafter, the license plate annual |
320 | use fees shall be distributed to the St. Johns River Alliance, |
321 | Inc., a s. 501(c)(3) nonprofit organization, which shall |
322 | administer the fees as follows: |
323 | 1. The St. Johns River Alliance, Inc., shall retain the |
324 | first $60,000 of the annual use fees as direct reimbursement for |
325 | administrative costs, startup costs, and costs incurred in the |
326 | development and approval process. Thereafter, up to 10 percent |
327 | of the annual use fee revenue may be used for administrative |
328 | costs directly associated with education programs, conservation, |
329 | research, and grant administration of the organization and for |
330 | promotion and marketing of the specialty license plate. |
331 | 2. At least 30 percent of the fees shall be available for |
332 | competitive grants for targeted community-based or county-based |
333 | research or projects for which state funding is limited or not |
334 | currently available. The remaining 50 percent shall be directed |
335 | toward community outreach and access programs. The competitive |
336 | grants shall be administered and approved by the board of |
337 | directors of the St. Johns River Alliance, Inc. A grant advisory |
338 | committee shall be composed of six members chosen by the St. |
339 | Johns River Alliance board members. |
340 | 3. Any remaining funds shall be distributed with the |
341 | approval of and accountability to the board of directors of the |
342 | St. Johns River Alliance, Inc., and shall be used to support |
343 | activities contributing to education, outreach, and springs |
344 | conservation. |
345 | (73) ENDLESS SUMMER LICENSE PLATES.-- |
346 | (a) The department shall develop an Endless Summer license |
347 | plate as provided in this section. Endless Summer license plates |
348 | must bear the colors and design approved by the department. The |
349 | word "Florida" must appear at the top of the plate, and the |
350 | words "Endless Summer" must appear at the bottom of the plate. |
351 | (b) The license plate annual use fees shall be distributed |
352 | to Surfing's Evolution & Preservation Corporation to fund its |
353 | activities, programs, and projects aimed at preserving the sport |
354 | of surfing. Surfing's Evolution & Preservation Corporation may |
355 | retain all revenue from the annual use fees until all startup |
356 | costs for developing and establishing the plate have been |
357 | recovered. Thereafter, up to 10 percent of the annual use fee |
358 | revenue may be used for promotion and marketing of the specialty |
359 | license plate and administrative costs directly associated with |
360 | the corporation's programs and the specialty license plate. |
361 | Surfing's Evolution & Preservation Corporation shall use the |
362 | remaining funds as follows: |
363 | 1. To fund the proposed Surfing's Evolution & Preservation |
364 | Experience project. |
365 | 2. To provide funds for the provision of lifeguards or the |
366 | building of artificial reefs. |
367 | 3. To provide funds to organizations that house the |
368 | history and artifacts of surfing or promote the sport through |
369 | exhibits, lectures, and events. |
370 | 4. To support programs and events of other organizations |
371 | that support beaches and oceans and promote education on beach |
372 | safety, coastal pollution, and beach ecology. |
373 | (74) CATCH ME, RELEASE ME LICENSE PLATES.-- |
374 | (a) The department shall develop a Catch Me, Release Me |
375 | license plate as provided in this section. Catch Me, Release Me |
376 | license plates must bear the colors and design approved by the |
377 | department. The word "Florida" must appear at the top of the |
378 | plate, and the words "Catch Me, Release Me" must appear at the |
379 | bottom of the plate. |
380 | (b) The license plate annual use fees shall be distributed |
381 | to the Guy Harvey Ocean Foundation, Inc., to fund marine-related |
382 | scientific research, including research of free-ranging pelagic |
383 | marine species that inhabit, use, or migrate through Florida |
384 | waters; conservation initiatives; and education and public |
385 | outreach programs targeting school-aged children in the state. |
386 | The Guy Harvey Ocean Foundation, Inc., may retain all revenue up |
387 | to $60,000 from the annual use fees until all startup costs for |
388 | developing and establishing the plate have been recovered. |
389 | Thereafter, up to 10 percent of the annual use fee revenue may |
390 | be used for administrative costs directly associated with the |
391 | operations of the Guy Harvey Ocean Foundation, Inc., and up to |
392 | 10 percent may be used for promotion and marketing of the |
393 | specialty license plate. |
394 | (75) FRATERNAL ORDER OF POLICE LICENSE PLATES.-- |
395 | (a) The department shall develop a Fraternal Order of |
396 | Police license plate as provided in this section. Fraternal |
397 | Order of Police license plates must bear the colors and design |
398 | approved by the department. The word "Florida" must appear at |
399 | the top of the plate, and the words "Fraternal Order of Police" |
400 | must appear at the bottom of the plate. |
401 | (b) In order to purchase the Fraternal Order of Police |
402 | license plate, a person must submit a certified letter from the |
403 | Florida State Lodge of the Fraternal Order of Police showing |
404 | that he or she qualifies for the use of the Fraternal Order of |
405 | Police law enforcement emblem by being a member in good |
406 | standing. |
407 | (c) The license plate annual use fees shall be distributed |
408 | to the Florida State Lodge Fraternal Order of Police Memorial |
409 | Foundation to fund its activities, programs, and projects aimed |
410 | at preserving, maintaining, and expanding the Florida Fraternal |
411 | Order of Police Law Enforcement Memorial. The Florida State |
412 | Lodge of the Fraternal Order of Police may retain all revenue |
413 | from the annual use fees until all startup costs for developing |
414 | and establishing the plate have been recovered. Thereafter, up |
415 | to 10 percent of the annual use fee revenue may be used for |
416 | promotion and marketing of the specialty license plate and |
417 | administrative costs directly associated with memorial programs |
418 | and the specialty license plate. The Florida State Lodge |
419 | Fraternal Order of Police Memorial Foundation shall use the |
420 | remaining funds as follows: |
421 | 1. To fund the Florida State Fraternal Order of Police Law |
422 | Enforcement Memorial projects. |
423 | 2. To provide funds for the expansion, maintenance, and |
424 | support of the Florida State Lodge Fraternal Order of Police |
425 | Memorial Foundation. |
426 | 3. To provide funds to organizations that help support the |
427 | families of law enforcement officers who have died in the line |
428 | of duty. |
429 | 4. To support programs and events that support the Florida |
430 | Fraternal Order of Police Law Enforcement Memorial. |
431 | (76) GO GREEN FLORIDA LICENSE PLATES.-- |
432 | (a) The department shall develop a Go Green Florida |
433 | license plate as provided in this section. Go Green Florida |
434 | license plates must bear the colors and design approved by the |
435 | department. The word "Florida" must appear at the top of the |
436 | plate, the words "Go Green" must appear on the bottom of the |
437 | plate, and the "Go Green Florida" emblem or logo must appear on |
438 | the plate. |
439 | (b) The requirements of s. 320.08053 must be met prior to |
440 | the issuance of the plate. The annual use fees shall be |
441 | distributed to the Coalition for Renewable Energy Solutions, |
442 | Inc. After reimbursement for documented costs expended to |
443 | establish the plate, the proceeds of the annual use fees shall |
444 | be used in the following manner: |
445 | 1. Up to 10 percent may be used by the Coalition for |
446 | Renewable Energy Solutions, Inc., for administrative, promotion, |
447 | and marketing costs. |
448 | 2. The remainder shall be used to fund the Solar Energy |
449 | System Incentives Program pursuant to s. 377.806, as directed by |
450 | the Florida Energy and Climate Commission. These funds may be |
451 | remitted directly from the department to the Solar Energy System |
452 | Incentives Program on a quarterly basis based on a calculation |
453 | of fees collected. |
454 | (c) The Coalition for Renewable Energy Solutions, Inc., |
455 | shall submit financial records and statements to the Office of |
456 | the Auditor General for all expenditures related to the Go Green |
457 | Florida program no later than 60 days after the end of each |
458 | fiscal year. |
459 | (d) The "Go Green Florida" emblem or logo may be |
460 | authorized for use by the department in recognition of energy- |
461 | efficient vehicle usage and practices. The display of the decal |
462 | for energy-efficient practices may not be considered a |
463 | substitute for a legal license tag. |
464 | (77) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.-- |
465 | (a) The department shall develop a Florida Biodiversity |
466 | Foundation license plate as provided in this section. Florida |
467 | Biodiversity Foundation license plates must bear the colors and |
468 | design approved by the department. The word "Florida" must |
469 | appear at the top of the plate, and the words "Save Wild |
470 | Florida" must appear at the bottom of the plate. |
471 | (b) The annual use fees shall be distributed to the |
472 | Florida Biodiversity Foundation, Inc., which shall retain 50 |
473 | percent of the proceeds until the startup costs to develop and |
474 | establish the plates have been recovered. Thereafter, the |
475 | proceeds shall be used as follows: |
476 | 1. A maximum of 10 percent of the proceeds may be used to |
477 | fund the administrative, promotion, and marketing costs of the |
478 | license plate program and the foundation. |
479 | 2. The remaining fees shall be used by the foundation to |
480 | fund research, education, and scientific study of the diversity |
481 | of animals and plants and to aid in the preservation, study, |
482 | conservation, and recovery of imperiled organisms. |
483 | Section 3. Paragraphs (h) and (i) are added to subsection |
484 | (15) of section 320.02, Florida Statutes, to read: |

489 | and renewal of registration must include language permitting a |

493 | must be distributed by the department each month to the Autism |
494 | License Plate Fund administered by Achievement and |
495 | Rehabilitation Centers, Inc., to be used as provided in s. |
496 | 320.08058(69). |
497 | (i) The application form for motor vehicle registration |
498 | and renewal of registration must include language permitting a |
499 | voluntary contribution of $1 to Ronald McDonald Houses of |
500 | Florida. Such contributions must be distributed by the |
501 | department each month to Ronald McDonald House Charities Tampa |
502 | Bay, Inc., a not-for-profit organization. |

504 | For the purpose of applying the service charge provided in s. |
505 | 215.20, contributions received under this subsection are not |
506 | income of a revenue nature. |
507 | Section 4. Paragraph (b) of subsection (1) and subsection |
508 | (3) of section 320.06, Florida Statutes, are amended to read: |
509 | 320.06 Registration certificates, license plates, and |
510 | validation stickers generally.-- |
511 | (1) |
512 | (b) Registration license plates bearing a graphic symbol |
513 | and the alphanumeric system of identification shall be issued |
514 | for a 10-year 6-year period. At the end of that 10-year 6-year |
515 | period, upon renewal, the plate shall be replaced. The |
516 | department shall stagger the implementation of the 10-year 6- |
517 | year license plate replacement cycle. The fee for such |
518 | replacement is $20 $12, $2 of which shall be paid each year |
519 | before the plate is replaced, to be credited towards the next |
520 | $20 $12 replacement fee. The fees shall be deposited into the |
521 | Highway Safety Operating Trust Fund. A credit or refund shall |
522 | not be given for any prior years' payments of such prorated |
523 | replacement fee if the plate is replaced or surrendered before |
524 | the end of the 10-year 6-year period, except that a credit may |
525 | be given when a registrant is required by the department to |
526 | replace a license plate under s. 320.08056(8)(a). With each |
527 | license plate, there shall be issued a validation sticker |
528 | showing the owner's birth month, license plate number, and the |
529 | year of expiration or the appropriate renewal period if the |
530 | owner is not a natural person. The validation sticker shall be |
531 | placed on the upper right corner of the license plate. Such |
532 | license plate and validation sticker shall be issued based on |
533 | the applicant's appropriate renewal period. The registration |
534 | period is a period of 12 months, the extended registration |
535 | period is a period of 24 months, and all expirations shall occur |
536 | based on the applicant's appropriate registration period. A |
537 | vehicle with an apportioned registration shall be issued an |
538 | annual license plate and a cab card that denote the declared |
539 | gross vehicle weight for each apportioned jurisdiction in which |
540 | the vehicle is authorized to operate. |
541 | (3)(a) Registration license plates shall be of metal |
542 | specially treated with a retroreflective material, as specified |
543 | by the department. The registration license plate is designed to |
544 | increase nighttime visibility and legibility and shall be at |
545 | least 6 inches wide and not less than 12 inches in length, |
546 | unless a plate with reduced dimensions is deemed necessary by |
547 | the department to accommodate motorcycles, mopeds, or similar |
548 | smaller vehicles. Validation stickers shall be treated with a |
549 | retroreflective material, shall be of such size as specified by |
550 | the department, and shall adhere to the license plate. The |
551 | registration license plate shall be imprinted with a combination |
552 | of bold letters and numerals or numerals, not to exceed seven |
553 | digits, to identify the registration license plate number. The |
554 | license plate shall also be imprinted with the word "Florida" at |
555 | the top and the name of the county in which it is sold, the |
556 | state motto, or the words "Sunshine State" at the bottom. |
557 | Apportioned license plates shall have the word "Apportioned" at |
558 | the bottom and license plates issued for vehicles taxed under s. |
559 | 320.08(3)(d), (4)(m) or (n), (5)(b) or (c), or (14) shall have |
560 | the word "Restricted" at the bottom. License plates issued for |
561 | vehicles taxed under s. 320.08(12) must be imprinted with the |
562 | word "Florida" at the top and the word "Dealer" at the bottom. |
563 | Manufacturer license plates issued for vehicles taxed under s. |
564 | 320.08(12) must be imprinted with the word "Florida" at the top |
565 | and the word "Manufacturer" at the bottom. License plates issued |
566 | for vehicles taxed under s. 320.08(5)(d) or (e) must be |
567 | imprinted with the word "Wrecker" at the bottom. Any county may, |
568 | upon majority vote of the county commission, elect to have the |
569 | county name removed from the license plates sold in that county. |
570 | The state motto or the words "Sunshine State" shall be printed |
571 | in lieu thereof. A license plate issued for a vehicle taxed |
572 | under s. 320.08(6) may not be assigned a registration license |
573 | number, or be issued with any other distinctive character or |
574 | designation, which that distinguishes the motor vehicle as a |
575 | for-hire motor vehicle. |
576 | (b) An additional fee of 50 cents shall be collected and |
577 | deposited into the Highway Safety Operating Trust Fund on each |
578 | motor vehicle registration or motor vehicle renewal registration |
579 | issued in this state in order that material costs are paid for |
580 | all license plates and validation stickers be fully treated with |
581 | retroreflective material. |
582 | Section 5. Section 320.0706, Florida Statutes, is amended |
583 | to read: |
584 | 320.0706 Display of license plates on trucks.--The owner |
585 | of any commercial truck of gross vehicle weight of 26,001 pounds |
586 | or more shall display the registration license plate on both the |
587 | front and rear of the truck in conformance with all the |
588 | requirements of s. 316.605 that do not conflict with this |
589 | section. The owner of a dump truck may place the rear license |
590 | plate on the gate no higher than 60 inches to allow for better |
591 | visibility. However, the owner of a truck tractor shall be |
592 | required to display the registration license plate only on the |
593 | front of such vehicle. The owner of any wrecker issued a regular |
594 | wrecker license plate shall display the license plate only on |
595 | the front of the vehicle. The owner of any wrecker issued gross |
596 | vehicle weight wrecker license plates shall display the license |
597 | plates on both the front and rear of the vehicle in conformance |
598 | with the requirements of s. 316.605 that do not conflict with |
599 | this section. A violation of this section is a noncriminal |
600 | traffic infraction, punishable as a moving violation as provided |
601 | in chapter 318. |
602 | Section 6. Subsection (6) of section 322.08, Florida |
603 | Statutes, is amended to read: |
604 | 322.08 Application for license.-- |
605 | (6) The application form for a driver's license or |
606 | duplicate thereof shall include language permitting the |
607 | following: |
608 | (a) A voluntary contribution of $1 per applicant, which |
609 | contribution shall be deposited into the Health Care Trust Fund |
610 | for organ and tissue donor education and for maintaining the |
611 | organ and tissue donor registry. |
612 | (b) A voluntary contribution of $1 per applicant, which |
613 | contribution shall be distributed to the Florida Council of the |
614 | Blind. |
615 | (c) A voluntary contribution of $2 per applicant, which |
616 | shall be distributed to the Hearing Research Institute, |
617 | Incorporated. |
618 | (d) A voluntary contribution of $1 per applicant, which |
619 | shall be distributed to the Juvenile Diabetes Foundation |
620 | International. |
621 | (e) A voluntary contribution of $1 per applicant, which |
622 | shall be distributed to the Children's Hearing Help Fund. |
623 | (f) A voluntary contribution of $1 per applicant, which |
624 | shall be distributed to Family First, a nonprofit organization. |
625 | (g) A voluntary contribution of $5 per applicant, which, |
626 | except as provided in s. 320.08058(69)(d), shall be distributed |
627 | to the Autism License Plate Fund administered by Achievement and |
628 | Rehabilitation Centers, Inc., to be used as provided in s. |
629 | 320.08058(69). |

631 | A statement providing an explanation of the purpose of the trust |
632 | funds shall also be included. For the purpose of applying the |
633 | service charge provided in s. 215.20, contributions received |
634 | under paragraphs (b), (c), (d), (e), and (f), and (g) and under |
635 | s. 322.18(9)(a) are not income of a revenue nature. |
636 | Section 7. This act shall take effect July 1, 2009. |
