    1                        A bill to be entitled                      
    2         An act relating to traffic infractions; amending s.
    3         318.18, F.S.; providing a surcharge on noncriminal
    4         moving traffic violations; providing for the proceeds
    5         from such surcharge to be used to fund the cost of
    6         civil traffic infraction hearing officers; providing
    7         an effective date.
    8         
    9  Be It Enacted by the Legislature of the State of Florida:
   10         
   11         Section 1. Subsection (19) is added to section 318.18,
   12  Florida Statutes, to read:
   13         318.18 Amount of penalties.—The penalties required for a
   14  noncriminal disposition pursuant to s. 318.14 or a criminal
   15  offense listed in s. 318.17 are as follows:
   16         (19) In addition to any penalties imposed, a surcharge of
   17  $1 must be paid for all noncriminal moving traffic violations
   18  under chapter 316. Revenue from the surcharge shall be remitted
   19  to the Department of Revenue and deposited into the Operating
   20  Trust Fund within the state courts system, created in s.
   21  25.3844, and used exclusively to fund the cost of civil traffic
   22  infraction hearing officers appointed pursuant to ss. 318.30
   23  318.38.
   24         Section 2. This act shall take effect July 1, 2009.
