       The Committee on Community Affairs (Bennett) recommended the
       following:

    5  insert:
    6         Section 13. Section 373.62, Florida Statutes, is amended to
    7  read:
    8         373.62 Water conservation; automatic sprinkler systems.—
    9         (1) Any person who purchases and installs an automatic lawn
   10  sprinkler system after May 1, 1991, must shall install, and must
   11  maintain, and operate, a rain sensor device or switch that
   12  overrides will override the irrigation cycle of the sprinkler
   13  system when adequate rainfall has occurred.
   14         (2)A development or subdivision that has at least 25
   15  residential parcels that have an installed and operating smart
   16  irrigation controller, and commercial irrigation users that
   17  install and operate a smart irrigation controller, are exempt
   18  from day-of-the-week watering restrictions of the applicable
   19  local government and water management district if the smart
   20  irrigation controller is approved by the local government after
   21  consultation with the water management district in which the
   22  smart irrigation controller is located. Restrictions related to
   23  time-of-day watering still apply. The smart irrigation
   24  controller user must post a sign at the residence or commercial
   25  facility in plain view from the nearest roadway
   26  stating:“Irrigating with Smart Irrigation Controller.” A “smart
   27  irrigation controller” means a device that assesses the
   28  available plant soil moisture in order to optimize an irrigation
   29  system and minimize the use of water and must be weather-based
   30  or soil-sensor based. In order to qualify for the exemption, the
   31  smart irrigation controller must be properly installed; allow
   32  for irrigation schedule adjustments, including run times and
   33  required cycles based on the soil moisture requirements; and be
   34  remotely monitored and capable of remotely modifying the
   35  settings for irrigation cycles and run times.

   38         And the title is amended as follows:
   39         Delete line 33
   40  and insert:
   41         by the act; amending s. 373.62, F.S.; exempting
   42         certain users of smart irrigation controllers from
   43         certain watering restrictions; defining the term
   44         “smart irrigation controller”; providing device
   45         requirements; providing an effective date.
