Florida Senate - 2009 SB 2534 By Senator Bennett 21-01696-09 20092534__ 1 A bill to be entitled 2 An act relating to public K-12 educational funding; 3 amending s. 1003.02, F.S.; prohibiting the use of 4 school district funds for the funding of or 5 contracting with community-based organizations to 6 provide noninstructional programs or services that are 7 not required by law; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Paragraph (d) of subsection (1) of section 12 1003.02, Florida Statutes, is amended to read: 13 1003.02 District school board operation and control of 14 public K-12 education within the school district.—As provided in 15 part II of chapter 1001, district school boards are 16 constitutionally and statutorily charged with the operation and 17 control of public K-12 education within their school district. 18 The district school boards must establish, organize, and operate 19 their public K-12 schools and educational programs, employees, 20 and facilities. Their responsibilities include staff 21 development, public K-12 school student education including 22 education for exceptional students and students in juvenile 23 justice programs, special programs, adult education programs, 24 and career education programs. Additionally, district school 25 boards must: 26 (1) Provide for the proper accounting for all students of 27 school age, for the attendance and control of students at 28 school, and for proper attention to health, safety, and other 29 matters relating to the welfare of students in the following 30 fields: 31 (d) Courses of study and instructional materials.— 32 1. Provide adequate instructional materials for all 33 students as follows and in accordance with the requirements of 34 chapter 1006, in the core courses of mathematics, language arts, 35 social studies, science, reading, and literature, except for 36 instruction for which the school advisory council approves the 37 use of a program that does not include a textbook as a major 38 tool of instruction. 39 2. Adopt courses of study for use in the schools of the 40 district. 41 3. Provide for proper requisitioning, distribution, 42 accounting, storage, care, and use of all instructional 43 materials as may be needed, and ensure that instructional 44 materials used in the district are consistent with the district 45 goals and objectives and the curriculum frameworks approved by 46 the State Board of Education, as well as with the state and 47 school district performance standards required by law and state 48 board rule. 49 50 School district funds may not be used for the purpose of funding 51 or contracting with community-based organizations to provide 52 noninstructional programs or services that are not otherwise 53 required by law. 54 Section 2. This act shall take effect July 1, 2009.
