    1                        A bill to be entitled                      
    2         An act relating to supplemental educational services;
    3         amending s. 1008.331, F.S.; requiring that each school
    4         district report certain information to the Department
    5         of Education regarding state-approved supplemental
    6         educational services providers that are providing
    7         services to public school students in the district by
    8         a specified date each year; requiring that the
    9         department evaluate each provider based on such
   10         information and assign a service designation;
   11         providing an exception for such designation; requiring
   12         that the department adopt rules specifying the
   13         threshold requirements for such designation; requiring
   14         that the department report the service designations to
   15         the providers, the school districts, parents, and the
   16         public by a specified date each year; authorizing
   17         school districts to use certain funds to meet the
   18         requirements in the act; requiring that the State
   19         Board of Education adopt rules; providing an effective
   20         date.

   22  Be It Enacted by the Legislature of the State of Florida:
   23  
   24         Section 1. Subsection (5) of section 1008.331, Florida
   25  Statutes, is amended to read:
   26         1008.331 Supplemental educational services in Title I
   27  schools; school district, provider, and department
   28  responsibilities.—
   29         (5) RESPONSIBILITIES OF THE DEPARTMENT OF EDUCATION.—
   30         (a) By May 1 of each year, each school district must report
   31  to the department, in the form prescribed by the department, the
   32  following information regarding each supplemental educational
   33  services provider that provides services to public school
   34  students in the district:
   35         1.Student learning gains as demonstrated by mastery of
   36  applicable benchmarks or access points set forth in the Sunshine
   37  State Standards;
   38         2.Student attendance and completion data provided to the
   39  district by each provider;
   40         3.Parent satisfaction survey results;
   41         4.School district satisfaction survey results; and
   42         5.Principal satisfaction survey results. The Department of
   43  Education shall assign to each state-approved supplemental
   44  educational services provider one of the following grades,
   45  defined according to rules of the State Board of Education:
   46         1.“A,” providing superior service.
   47         2.“B,” providing above satisfactory service.
   48         3.“C,” providing satisfactory service.
   49         4.“D,” providing below satisfactory service.
   50         5.“F,” providing unsatisfactory service.
   51         (b) The department shall evaluate each state-approved
   52  provider using the information received pursuant to paragraph
   53  (a) and assign a service designation of excellent, satisfactory,
   54  or unsatisfactory for the prior school year. However, if the
   55  student population served by the provider does not meet the
   56  minimum sample size necessary, based on accepted professional
   57  practice for statistical reliability and the prevention of the
   58  unlawful release of personally identifiable student information,
   59  the provider will not receive a service designation. The
   60  department shall specify, by rule, the threshold requirements
   61  for assigning the service designations. By July 1 of each year,
   62  the department must report the service designation to the
   63  supplemental educational services providers, the school
   64  districts, parents, and the public. A state-approved
   65  supplemental educational services provider’s grade shall be
   66  based on a combination of student learning gains and student
   67  proficiency levels, as measured by the statewide assessment
   68  pursuant to s. 1008.22, and norm-referenced tests approved by
   69  the Department of Education for students in kindergarten through
   70  grade 3.
   71         (c) School districts may use Title I, Part A funds to meet
   72  the requirements, as provided in the Elementary and Secondary
   73  Education Act, as amended. Beginning with the 2007-2008 school
   74  year, the Department of Education shall assign a grade to each
   75  state-approved supplemental educational services provider and by
   76  March 1 report the grades to the supplemental educational
   77  services providers, the school districts, parents, and the
   78  public.
   79         (d)The State Board of Education shall adopt rules pursuant
   80  to ss. 120.536(1) and 120.54 to implement the provisions of this
   81  subsection.
   82         Section 2. This act shall take effect July 1, 2009.
