Florida Senate - 2009 SB 2606 By Senator Pruitt 28-00373A-09 20092606__ 1 A bill to be entitled 2 An act relating to stormwater management system 3 design; establishing a study commission to develop 4 recommendations relating to stormwater management 5 system design; specifying study criteria; providing 6 for commission membership, meetings, and expiration; 7 requiring the commission to submit findings and 8 legislative recommendations to the Legislature by a 9 specified date; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. (1) A study commission is established to develop 14 legislative recommendations relating to stormwater management 15 system design in the state. The commission shall: 16 (a) Review the Joint Professional Engineers and Landscape 17 Architecture Committee Report conducted pursuant to s. 17, 18 chapter 88-347, Laws of Florida, and determine the current 19 validity of the report and the need to revise any of the 20 conclusions or recommendations. 21 (b) Determine how a licensed and registered professional 22 might demonstrate competency for stormwater management system 23 design. 24 (c) Determine how the Board of Professional Engineers and 25 the Board of Landscape Architecture might administer 26 certification tests or continuing education requirements for 27 stormwater management system design. 28 (d) Provide recommendations for grandfathering the rights 29 of licensed professionals who currently practice stormwater 30 management design in a manner that will allow them to continue 31 to practice without meeting any new requirements the commission 32 recommends be placed on licensed professionals in the future. 33 (2)(a) The Board of Landscape Architecture, the Board of 34 Professional Engineers, the Florida Engineering Society, the 35 Florida Chapter of the American Society of Landscape Architects, 36 and the Secretary of Environmental Protection shall each appoint 37 one member to the commission. 38 (b) Members of the commission may not be reimbursed for 39 travel, per diem, or any other costs associated with serving on 40 the commission. 41 (c) The commission shall meet a minimum of four times 42 either in person or via teleconference; however, a minimum of 43 two meetings shall be public hearings with testimony. 44 (d) The commission shall expire on November 1, 2009. 45 (3) The commission shall provide its findings and 46 legislative recommendations to the President of the Senate and 47 the Speaker of the House of Representatives by November 1, 2009. 48 Section 2. This act shall take effect July 1, 2009.
