       Senator Fasano moved the following:

    5  insert:
    6         (18)A function related to air quality inside an enclosed
    7  ice rink to protect the health and safety of visitors and
    8  employees of an enclosed ice skating rink from dangers
    9  associated with oxides of nitrogen (NOx), hydrocarbons (HC),
   10  carbon monoxide (CO), carbon dioxide and other harmful gasses,
   11  vapors, or particles as identified by the department that change
   12  the air quality due to the operation of the ice rink. The
   13  department may adopt rules including definitions; air quality
   14  standards, monitoring, testing, and record keeping; maintenance
   15  and operation requirements for equipment that affects air
   16  quality; ventilation of the facility; operators’ required
   17  response activities to the exceedance of an air quality
   18  standard; fees; enforcement, citations and penalties. The
   19  department may enter and inspect an enclosed ice skating rink at
   20  reasonable hours to determine compliance with applicable
   21  statutes or rules.
   22         Section 4. Subsection (1) of section 381.0061, Florida
   23  Statutes, is amended to read:
   24         381.0061 Administrative fines.—
   25         (1) In addition to any administrative action authorized by
   26  chapter 120 or by other law, the department may impose a fine,
   27  which shall not exceed $500 for each violation, for a violation
   28  of s. 381.006(16), s. 381.006(18), s. 381.0065, s. 381.0066, s.
   29  381.0072, or part III of chapter 489, for a violation of any
   30  rule adopted under this chapter, or for a violation of any of
   31  the provisions of chapter 386. Notice of intent to impose such
   32  fine shall be given by the department to the alleged violator.
   33  Each day that a violation continues may constitute a separate
   34  violation.

   56         equipment that affects air quality; authorizing the
   57         department to enter and inspect an enclosed ice
   58         skating rink at reasonable hours to determine
   59         compliance with applicable air quality statutes or
   60         rules; amending s. 381.0061, F.S.; providing that the
   61         department may impose a fine, which may not exceed
   62         $500 for each violation, for a violation of the ice
   63         rink air quality standards; amending s. 381.0072,
