    1                        A bill to be entitled                      
    2         An act relating to health care clinics; amending s.
    3         400.9905, F.S.; redefining the term “clinic” for
    4         purposes of the Health Care Clinic Act to exclude
    5         those entities that derive more than a certain
    6         percentage of their revenue from oncology services or
    7         radiation therapy services; providing an effective
    8         date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Paragraph (i) of subsection (4) of section
   13  400.9905, Florida Statutes, is amended to read:
   14         400.9905 Definitions.—
   15         (4) “Clinic” means an entity at which health care services
   16  are provided to individuals and which tenders charges for
   17  reimbursement for such services, including a mobile clinic and a
   18  portable equipment provider. For purposes of this part, the term
   19  does not include and the licensure requirements of this part do
   20  not apply to:
   21         (i) Entities that provide only oncology or radiation
   22  therapy services by physicians licensed under chapter 458 or
   23  chapter 459, or entities that provide oncology or radiation
   24  therapy services by physicians licensed under chapter 458 or
   25  chapter 459 which are owned by a corporation whose shares are
   26  publicly traded on a recognized stock exchange, or an entity
   27  that provides oncology services or radiation therapy services,
   28  whether at a single location or multiple locations, by or under
   29  the supervision of physicians licensed under chapter 458 or
   30  chapter 459, if the entity derives more than 50 percent of its
   31  total revenues from those services.
   32         Section 2. This act shall take effect July 1, 2009.
