       The Committee on Commerce (Gelber) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 535 - 549
    4  and insert:
    5         15 12.5 miles of the location of the proposed additional
    6  motor vehicle dealer or within 12.5 miles of the location of the
    7  proposed relocated motor vehicle dealer; or
    8         2. Any existing motor vehicle dealer or dealers of the same
    9  line-make can establish that during any 12-month period of the
   10  36-month period preceding the filing of the licensee’s
   11  application for the proposed dealership, such dealer or its
   12  predecessor made 20 25 percent of its retail sales of new motor
   13  vehicles to persons whose registered household addresses were
   14  located within a radius of 15 12.5 miles of the location of the
   15  proposed additional motor vehicle dealer or within 12.5 miles of
   16  the location of the proposed relocated motor vehicle dealer, or
   17  performed repairs on the same line-make motor vehicles which
   18  constituted 20 percent of its total service department sales to
   19  persons whose registered addresses were located within a radius
   20  of 15 miles of the location of the proposed additional motor
   21  vehicle dealer or within 12.5 miles of the location of the
   22  proposed relocated dealer; provided such existing dealer is
   23  located in
