       Senator Baker moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 71 - 85
    4  and insert:
    5         (2) The agency may not issue an initial license, other than
    6  a change of ownership license, to a home health agency under
    7  part III of chapter 400 or this part until July 1, 2010, in any
    8  county that has at least one actively licensed home health
    9  agency and a population of persons 65 years of age or older, as
   10  indicated in the most recent population estimates published by
   11  the Executive Office of the Governor, of fewer than 1,200
   12  persons per home health agency. In such counties, for an
   13  application received by the agency before July 1, 2009, which
   14  has been deemed by the agency to be complete except for proof of
   15  accreditation, the agency may issue an initial or a change of
   16  ownership license only if the applicant applied for
   17  accreditation from an accrediting organization that is
   18  recognized by the agency before May 1, 2009.
