4     Between lines 831 and 832, insert:
5     Section 8.  Section 720.314, Florida Statutes, is created
6to read:
7     720.314  Parcel owner informational complaint.--
8     (1)  Any parcel owner may file an informational complaint
9to report alleged failures by the homeowners' association or
10officers or directors of the association to comply with the
11provisions of this chapter. The informational complaint shall be
12in writing and signed by the complainant, and the accuracy of
13the facts alleged shall be sworn to before a notary public.
14Properly filed informational complaints shall be used for
15analysis and recommendations to the Legislature for changes to
16this chapter.
17     (2)  The informational complaint shall be in the format
18provided in subsection (3) and shall be filed with the Office of
19Program Policy Analysis and Government Accountability. If the
20form does not comply with the requirements provided in
21subsection (3), it shall be returned to the complainant as not
22in compliance with the requirements of this section and shall
23not be considered by the Office of Program Policy Analysis and
24Government Accountability for any purpose.
25     (3)  The informational complaint shall be in substantially

44     Section 9.  The Office of Program Policy Analysis and
45Government Accountability shall conduct a study to evaluate
46whether the state should regulate homeowners' associations in a
47manner similar to the regulation of condominiums and
48cooperatives. The study's scope shall include, but need not be
49limited to, estimating the number of homeowners' associations
50and the number of homes that are members of a homeowners'
51association. The office shall submit its report to the President
52of the Senate and the Speaker of the House of Representatives by  
53January 1, 2010.
