       Senator Deutch moved the following:
       
    1         Senate Amendment to Amendment (927562) (with title
    2  amendment)
    3  
    4         Delete lines 582 - 586
    5  and insert:
    6         Section 6. Paragraph (h) is added to subsection (1) of
    7  section 718.116, Florida Statutes, paragraph (b) of subsection
    8  (5) is amended, and subsection (11) is added to that section
    9  read:
   10         718.116 Assessments; liability; lien and priority;
   11  interest; collection.—
   12         (1)
   13         (h) In addition to the limited liability of paragraph (b),
   14  a first mortgagee or its successor or assignee shall pay to the
   15  association any special assessment levied against the unit
   16  during the pendency of a foreclosure action involving the unit
   17  for damage to the common elements, roof, and structural
   18  components of the building and to mechanical, electrical, and
   19  plumbing elements serving the building caused by windstorm,
   20  fire, or other casualty or act of God for the purpose of
   21  repairing, restoring, or replacing the common elements to pre
   22  loss conditions and for payment needed by the association for
   23  any deductibles or increase in the association’s casualty
   24  insurance premiums.
