1 A bill to be entitled
2 An act relating to animal control or cruelty
3 ordinances; amending s. 828.27, F.S.; requiring a
4 county or municipality enacting an ordinance relating
5 to animal control or cruelty to impose a surcharge on
6 the civil penalty for violations of the ordinance;
7 specifying use of the proceeds of the surcharge;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (b) of subsection (4) of section
13 828.27, Florida Statutes, is amended to read:
14 828.27 Local animal control or cruelty ordinances;
15 penalty.—
16 (4)
17 (b) The governing body of a county or municipality enacting
18 an ordinance relating to animal control or cruelty shall may
19 impose and collect a surcharge of up to $5 upon each civil
20 penalty imposed for each violation of the an ordinance relating
21 to animal control or cruelty. The proceeds from such surcharges
22 shall be used to pay the costs of training for animal control
23 officers, to subsidize the costs of the spaying or neutering of
24 dogs and cats whose owners voluntarily submit their animals for
25 sterilization, and to pay other costs of administering the
26 ordinance.
27 Section 2. This act shall take effect July 1, 2009.
