       The Committee on Community Affairs (Altman) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 166 - 179
    4  and insert:
    5         (3)The department is directed to develop rules and
    6  standards that provide the minimum scientific methodologies,
    7  data, or tools that shall be used by a county or municipal
    8  government to support the request for an exemption as provided
    9  for in subsection (4).
   10         (4)A county or municipal government, upon application to
   11  the department, may seek to have specific geographic areas
   12  exempted from the requirements of sections 369.405 and 369.406
   13  by demonstrating that activities within such areas will not
   14  impact the springshed in a manner that leads to new or continued
   15  degradation.
   16         (5)Pursuant to subsection (4), the department may approve
   17  or deny an application for an exemption, or may modify the
   18  boundaries of the specific geographic areas for which an
   19  exemption is sought. The ruling of the department on the
   20  applicant's request shall constitute a final agency action
   21  subject to review pursuant to ss. 120.569 and 120.57.
