2 An act relating to the Plantation Acres Improvement
3 District, Broward County; providing legislative
4 intent; amending chapter 2002-367, Laws of Florida;
5 redesignating the board of supervisors as the board of
6 commissioners; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. It is the intent of the Legislature in enacting
11 this law to provide for a change in the designation of the
12 governing body of the Plantation Acres Improvement District from
13 a board of supervisors to a board of commissioners.
14 Section 2. Subsection (3) of section 4, subsections (2),
15 (3), and (4) of section 5, section 8, subsection (15) of section
16 9, section 43, and subsection (7) of section 52 of section 3 of
17 chapter 2002-367, Laws of Florida, are amended to read:
18 Section 4. Definitions.—Unless the context shall indicate
19 otherwise, the following words as used in this act shall have
20 the following meanings:
21 (3) “Board” means the board of commissioners supervisors of
22 the Plantation Acres Improvement District, or if such board
23 shall be abolished, the board, body, or commission succeeding to
24 the principal functions thereof or to whom the powers given by
25 this act to the board shall be given by law.
26 Section 5. Board of commissioners supervisors; election;
27 organization; terms of office; quorum; report and minutes.—
28 (2) Each commissioner supervisor, before entering upon his
29 or her official duties, shall take and subscribe to an oath of
30 office as prescribed in section 298.13, Florida Statutes.
31 (3) All commissioners supervisors shall hold office for the
32 terms for which they are elected or appointed and until their
33 successors shall be chosen and qualify. In case of a vacancy in
34 the office of any commissioner supervisor, the remaining
35 commissioner supervisor or commissioners supervisors (even
36 though less than a quorum) may fill such vacancy by appointment
37 of a new commissioner supervisor or commissioners supervisors
38 for the unexpired term of the commissioner supervisor who
39 vacated his or her office.
40 (4) As soon as practicable after each election, the board
41 shall organize by choosing one commissioner supervisor to be
42 chair and one to be vice chair of the board and by appointing a
43 recording secretary, who need not be a member of the board. In
44 the event an employee of the district serves as the board’s
45 recording secretary, an appointment to such office shall not be
46 necessary following an election.
47 Section 8. Compensation of board.—Each commissioner
48 supervisor shall be entitled to receive for his or her services
49 an amount not to exceed $300 per month. In addition, each
50 commissioner supervisor shall receive reasonable traveling
51 expenses for attending district business outside of the
52 district. Unless the board by resolution otherwise provides,
53 such traveling expenses shall not be in excess of the amounts
54 provided by law for state and county officials.
55 Section 9. Powers.—The district shall have, and the board
56 may exercise, any or all of the following powers:
57 (15) To employ engineers, attorneys, consultants, agents,
58 employees, and representatives as the board of commissioners
59 supervisors may from time to time determine necessary and to fix
60 their compensation and duties.
61 Section 43. Foreclosure of liens.—Any lien in favor of the
62 district arising under chapter 298, Florida Statutes, or under
63 this act may be foreclosed by the district by foreclosure
64 proceedings in the name of the district in the circuit court in
65 like manner as is provided in chapter 173, Florida Statutes, and
66 amendments thereto, and the provisions of said chapter shall be
67 applicable to such proceedings with the same force and effect as
68 if said provisions were expressly set forth in this act. Any act
69 required or authorized to be done by or on behalf of a city or
70 town in foreclosure proceedings under chapter 173, Florida
71 Statutes, may be performed by such officer or agent of the
72 district as the board of commissioners supervisors may
73 designate. Such foreclosure proceedings may be brought at any
74 time after the expiration of 1 year from the date any tax, or
75 installment thereof, becomes delinquent.
76 Section 52. Minimum charter requirements.—In accordance
77 with section 189.404(3), Florida Statutes, the following
78 subsections satisfy the minimum charter requirements of the
79 Plantation Acres Improvement District:
80 (7) The administrative duties of the board of commissioners
81 supervisors shall be as set forth in this act and chapter 298,
82 Florida Statutes, as they may be amended from time to time.
83 Section 3. This act shall take effect upon becoming a law.
