Florida Senate - 2009 SB 308 By Senator Ring 32-00022B-09 2009308__ 1 A bill to be entitled 2 An act relating to childhood vaccinations; requiring 3 that health care providers disclose information about 4 childhood vaccinations to a minor's parent or legal 5 guardian before vaccinating the minor; requiring the 6 Department of Health to develop a standardized form; 7 prohibiting a health care provider from administering 8 a vaccination to a minor until after the minor's 9 parent or guardian signs the form; requiring that the 10 parent or legal guardian sign the form within a 11 certain time; requiring certain health care providers 12 to provide information about childhood vaccines to 13 patients who are pregnant; requiring the department to 14 create and maintain a website; providing an effective 15 date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. (1) Before vaccinating a minor, a health care 20 provider who is licensed in this state and who, as a part of his 21 or her scope of practice, administers childhood vaccinations 22 shall consult with and disclose to the parent or legal guardian 23 of the minor information about any childhood vaccinations that 24 may be administered, including, but not limited to: 25 (a) Information contained in the vaccine package insert 26 which details the vaccine ingredients and contraindications. 27 (b) Potential side effects of the vaccine. 28 (c) The efficacy of the vaccine. 29 (d) Risks associated with the disease that the vaccination 30 is intended to prevent. 31 (e) Options that are available with regard to the 32 administration of the vaccination, including the timing or 33 combination of multiple vaccinations. 34 (2) The Department of Health shall develop and provide to 35 each health care provider who is licensed in this state and who, 36 as a part of his or her scope of practice, administers childhood 37 vaccinations a standardized form indicating that the health care 38 provider has fulfilled the requirements in subsection (1). The 39 form shall be kept with the minor's permanent medical record. 40 The health care provider may not vaccinate a minor until after 41 the minor's parent or legal guardian signs the standardized 42 form. The parent or legal guardian of a minor shall sign and 43 date the standardized form: 44 (a) Immediately after the consultation; or 45 (b) At any time after the consultation when the parent or 46 guardian believes that he or she is adequately informed about 47 the vaccinations, but before the child is admitted to a licensed 48 child care facility in this state or enrolled in prekindergarten 49 through grade 12 of a public or private school in this state. 50 (3) A health care provider who is licensed in this state 51 and who, as a part of his or her scope of practice, renders 52 prenatal care to pregnant women shall provide information about 53 childhood vaccines to each patient who is in her 30th week of 54 pregnancy. 55 (4) The Department of Health shall create and maintain a 56 website that contains information regarding each childhood 57 vaccination and the standardized form described in subsection 58 (2). 59 Section 2. This act shall take effect July 1, 2009.
