A bill to be entitled
2An act relating to delivery vehicles; amending s.
3316.2126, F.S.; defining the term "seasonal delivery
4personnel"; authorizing the use of golf carts, modified
5carts, low-speed vehicles, and utility vehicles by
6seasonal delivery personnel during a certain timeframe;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (3) of section 316.2126, Florida
12Statutes, is renumbered as subsection (4), and a new subsection
13(3) is added to that section to read:
14     316.2126  Authorized use of golf carts, modified carts,
15low-speed vehicles, and utility vehicles by municipalities and
16state employees, state park volunteers, and state park
17visitors.--
18     (3)(a)  As used in this subsection, "seasonal delivery
19personnel" means employees of a delivery service when delivering
20goods for that service during the time period specified in
21paragraph (b).
22     (b)  Seasonal delivery personnel are authorized to use golf
23carts, modified carts, low-speed vehicles, and utility vehicles
24as defined in s. 320.01 upon any public road with a speed limit
25of up to 35 miles per hour for the purpose of delivering goods
26sent through a delivery service. Such vehicles must be marked in
27some manner with the name of the delivery service. A trailer may
28be pulled by the vehicle. Vehicles used pursuant to this
29subsection may be operated after sunset if, in addition to the
30safety requirements in s. 316.212(6), they are equipped with
31suitable headlights and tail lights. This authorization applies
32to deliveries made from midnight October 15 until midnight
33December 31 of each year.
34     Section 2.  This act shall take effect July 1, 2009.
