9 | Be It Enacted by the Legislature of the State of Florida: |

11 | Section 1. Subsection (3) of section 316.2126, Florida |
12 | Statutes, is renumbered as subsection (4), and a new subsection |
13 | (3) is added to that section to read: |
14 | 316.2126 Authorized use of golf carts, modified carts, |
15 | low-speed vehicles, and utility vehicles by municipalities and |
16 | state employees, state park volunteers, and state park |
17 | visitors.-- |
18 | (3)(a) As used in this subsection, "seasonal delivery |
19 | personnel" means employees of a delivery service when delivering |
20 | goods for that service during the time period specified in |
21 | paragraph (b). |
22 | (b) Seasonal delivery personnel are authorized to use golf |
23 | carts, modified carts, low-speed vehicles, and utility vehicles |
24 | as defined in s. 320.01 upon any public road with a speed limit |
25 | of up to 35 miles per hour for the purpose of delivering goods |
26 | sent through a delivery service. Such vehicles must be marked in |
27 | some manner with the name of the delivery service. A trailer may |
28 | be pulled by the vehicle. Vehicles used pursuant to this |
29 | subsection may be operated after sunset if, in addition to the |
30 | safety requirements in s. 316.212(6), they are equipped with |
31 | suitable headlights and tail lights. This authorization applies |
32 | to deliveries made from midnight October 15 until midnight |
33 | December 31 of each year. |
34 | Section 2. This act shall take effect July 1, 2009. |
