10 | Be It Enacted by the Legislature of the State of Florida: |

12 | Section 1. Subsection (3) of section 316.2126, Florida |
13 | Statutes, is renumbered as subsection (4), and a new subsection |
14 | (3) is added to that section to read: |
15 | 316.2126 Authorized use of golf carts, modified carts, |
16 | low-speed vehicles, and utility vehicles by municipalities and |
17 | state employees, state park volunteers, and state park |
18 | visitors.-- |
19 | (3)(a) As used in this subsection, "seasonal delivery |
20 | personnel" means employees of a licensed commercial delivery |
21 | service when delivering express envelopes and packages, with a |
22 | maximum size of 130 inches for the combined length and girth and |
23 | weighing not more than 150 pounds, for that service during the |
24 | time period specified in paragraph (b). |
25 | (b) Seasonal delivery personnel are authorized to use golf |
26 | carts, modified carts, low-speed vehicles, and utility vehicles |
27 | as defined in s. 320.01 upon any public road with a speed limit |
28 | of up to 35 miles per hour for the purpose of delivering goods |
29 | sent through a delivery service. As used in this subsection, the |
30 | term "golf cart" means a motor vehicle as defined in s. |
31 | 320.01(22), but also includes such vehicles modified with a |
32 | cargo platform or bin to transport parcels or with a hitch to |
33 | tow a trailer. Such vehicles must be marked in some manner with |
34 | the name of the delivery service. A trailer may be pulled by the |
35 | vehicle. Vehicles used pursuant to this subsection may be |
36 | operated after sunset if, in addition to the safety requirements |
37 | in s. 316.212(6), they are equipped with suitable headlamps and |
38 | taillamps. This authorization applies to deliveries made from |
39 | midnight October 15 until midnight December 31 of each year. |
40 | Section 2. This act shall take effect July 1, 2009. |
