2An act relating to delivery vehicles; amending s.
3316.2126, F.S.; defining the term "seasonal delivery
4personnel"; authorizing the use of golf carts, modified
5carts, low-speed vehicles, and utility vehicles by
6seasonal delivery personnel during a certain timeframe;
7defining the term "golf cart"; providing an effective
8date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsection (3) of section 316.2126, Florida
13Statutes, is renumbered as subsection (4), and a new subsection
14(3) is added to that section to read:
15     316.2126  Authorized use of golf carts, modified carts,
16low-speed vehicles, and utility vehicles by municipalities and
17state employees, state park volunteers, and state park
18visitors.--
19     (3)(a)  As used in this subsection, "seasonal delivery
20personnel" means employees of a licensed commercial delivery
21service when delivering express envelopes and packages, with a
22maximum size of 130 inches for the combined length and girth and
23weighing not more than 150 pounds, for that service during the
24time period specified in paragraph (b).
25     (b)  Seasonal delivery personnel are authorized to use golf
26carts, modified carts, low-speed vehicles, and utility vehicles
27as defined in s. 320.01 upon any public road with a speed limit
28of up to 35 miles per hour for the purpose of delivering goods
29sent through a delivery service. As used in this subsection, the
30term "golf cart" means a motor vehicle as defined in s.
31320.01(22), but also includes such vehicles modified with a
32cargo platform or bin to transport parcels or with a hitch to
33tow a trailer. Such vehicles must be marked in some manner with
34the name of the delivery service. A trailer may be pulled by the
35vehicle. Vehicles used pursuant to this subsection may be
36operated after sunset if, in addition to the safety requirements
37in s. 316.212(6), they are equipped with suitable headlamps and
38taillamps. This authorization applies to deliveries made from
39midnight October 15 until midnight December 31 of each year.
40     Section 2.  This act shall take effect July 1, 2009.
