5 | Section 1. Section 406.61, Florida Statutes, is amended to |
6 | read: |
7 | 406.61 Selling, buying, or conveying bodies outside state |
8 | prohibited; exceptions, penalty.-- |
9 | (1) Any person who sells shall sell or buys buy any body |
10 | or parts of bodies as described in this chapter or any person |
11 | except a recognized Florida medical or dental school who |
12 | transmits shall transmit or conveys convey or causes cause to be |
13 | transmitted or conveyed such body or parts of bodies to any |
14 | place outside this state commits is guilty of a misdemeanor of |
15 | the first degree, punishable as provided in ss. 775.082 and |
16 | 775.083. However, nothing in this chapter does not prohibit |
17 | shall be construed as prohibiting the anatomical board from |
18 | transporting human specimens outside the state for educational |
19 | or scientific purposes or prohibit as prohibiting the transport |
20 | of bodies, parts of bodies, or tissue specimens in furtherance |
21 | of lawful examination, investigation, or autopsy conducted |
22 | pursuant to s. 406.11. Any person, institution, or organization |
23 | that conveys bodies or parts of bodies into or out of the state |
24 | for medical education or research purposes shall notify the |
25 | anatomical board of such intent and receive approval from the |
26 | board. |
27 | (2) Any entity accredited by the American Association of |
28 | Museums may convey plastinated bodies or parts of bodies into or |
29 | out of the state for exhibition and public educational purposes |
30 | without the consent of the board if the accredited entity: |
31 | (a) Notifies the board of the conveyance and the duration |
32 | and location of the exhibition at least 30 days before the |
33 | intended conveyance. |
34 | (b) Submits to the board a description of the bodies or |
35 | parts of bodies and the name and address of the company |
36 | providing the bodies or parts of bodies. |
37 | (c) Submits to the board documentation that each body was |
38 | donated by the decedent or his or her next of kin for purposes |
39 | of plastination and public exhibition, or, in lieu of such |
40 | documentation, an affidavit stating that each body was donated |
41 | directly by the decedent or his or her next of kin for such |
42 | purposes to the company providing the body and that such company |
43 | has a donation form on file for the body. |
44 | (3) Notwithstanding paragraph (2)(c) and in lieu of the |
45 | documentation or affidavit required under paragraph (2)(c), for |
46 | a plastinated body that, before July 1, 2009, was exhibited in |
47 | this state by any entity accredited by the American Association |
48 | of Museums, such an accredited entity may submit an affidavit to |
49 | the board stating that the body was legally acquired and that |
50 | the company providing the body has acquisition documentation on |
51 | file for the body. This subsection expires January 1, 2012. |
52 | Section 2. This act shall take effect July 1, 2009. |
