CS for SB 414 Second Engrossed 2009414e2 1 A bill to be entitled 2 An act relating to the conveyance of bodies into, 3 within, or out of the state; amending s. 406.61, F.S.; 4 authorizing an accredited entity to convey plastinated 5 bodies or parts of bodies into, within, or out of the 6 state for exhibition and educational purposes; 7 requiring that the entity provide prior notification 8 and documentation to the anatomical board; providing 9 an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 406.61, Florida Statutes, is amended to 14 read: 15 406.61 Selling, buying, or conveying bodies outside state 16 prohibited; exceptions, penalty.—Any person who sellsshall sell17 or buysbuyany body or parts of bodies as described in this 18 chapter or any person except a recognized Florida medical or 19 dental school who transmitsshall transmitor conveysconveyor 20 causescauseto be transmitted or conveyed such body or parts of 21 bodies to any place outside this state commitsis guilty ofa 22 misdemeanor of the first degree, punishable as provided in ss. 23 775.082 and 775.083. However, nothing in this chapter shall be 24 construed as prohibiting the anatomical board from transporting 25 human specimens outside the state for educational or scientific 26 purposes or as prohibiting the transport of bodies, parts of 27 bodies, or tissue specimens in furtherance of lawful 28 examination, investigation, or autopsy conducted pursuant to s. 29 406.11. Any person, institution, or organization that conveys 30 bodies or parts of bodies into or out of the state for medical 31 education or research purposes shall notify the anatomical board 32 of such intent and receive approval from the board. Any entity 33 accredited by the American Association of Museums may transport 34 plastinated bodies or parts of bodies into, within, or out of 35 the state for exhibition and public educational purposes without 36 the consent of the board if the accredited entity: 37 (1) Notifies the board of the intended conveyance and the 38 duration and location of the exhibition at least 30 days before 39 the intended conveyance. 40 (2) Submits to the board a description of the bodies or 41 parts of bodies and the name and address of the company from 42 whom the bodies or parts of bodies were acquired. 43 (3) Submits to the board documentation that each body was 44 donated by the decedent or his or her next of kin for purposes 45 of plastination to the company from whom the bodies were 46 acquired and that such company has a donation form on file for 47 the body, or until January 2012, in lieu of such documentation 48 for plastinated bodies exhibited in Florida by an entity 49 accredited by the American Association of Museums before July 1, 50 2009, the company may provide an affidavit stating that such 51 bodies or parts of bodies were legally acquired and the 52 providing company has acquisition documentation on file for each 53 body. 54 Section 2. This act shall take effect July 1, 2009.
