    2         An act relating to the conveyance of bodies into or
    3         out of the state; amending s. 406.61, F.S.;
    4         authorizing certain accredited entities to convey
    5         plastinated bodies or parts of bodies for certain
    6         purposes; requiring such accredited entities to
    7         provide prior notification to the anatomical board and
    8         submit certain information and documentation to the
    9         board; authorizing such accredited entities to submit
   10         an affidavit containing specified information in lieu
   11         of such documentation for certain plastinated bodies;
   12         providing for future expiration; providing an
   13         effective date.

   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Section 406.61, Florida Statutes, is amended to
   18  read:
   19         406.61 Selling, buying, or conveying bodies outside state
   20  prohibited; exceptions, penalty.—
   21         (1) Any person who sells shall sell or buys buy any body or
   22  parts of bodies as described in this chapter or any person
   23  except a recognized Florida medical or dental school who
   24  transmits shall transmit or conveys convey or causes cause to be
   25  transmitted or conveyed such body or parts of bodies to any
   26  place outside this state commits is guilty of a misdemeanor of
   27  the first degree, punishable as provided in ss. 775.082 and
   28  775.083. However, nothing in this chapter does not prohibit
   29  shall be construed as prohibiting the anatomical board from
   30  transporting human specimens outside the state for educational
   31  or scientific purposes or prohibit as prohibiting the transport
   32  of bodies, parts of bodies, or tissue specimens in furtherance
   33  of lawful examination, investigation, or autopsy conducted
   34  pursuant to s. 406.11. Any person, institution, or organization
   35  that conveys bodies or parts of bodies into or out of the state
   36  for medical education or research purposes shall notify the
   37  anatomical board of such intent and receive approval from the
   38  board.
   39         (2) Any entity accredited by the American Association of
   40  Museums may convey plastinated bodies or parts of bodies into or
   41  out of the state for exhibition and public educational purposes
   42  without the consent of the board if the accredited entity:
   43         (a) Notifies the board of the conveyance and the duration
   44  and location of the exhibition at least 30 days before the
   45  intended conveyance.
   46         (b) Submits to the board a description of the bodies or
   47  parts of bodies and the name and address of the company
   48  providing the bodies or parts of bodies.
   49         (c) Submits to the board documentation that each body was
   50  donated by the decedent or his or her next of kin for purposes
   51  of plastination and public exhibition, or, in lieu of such
   52  documentation, an affidavit stating that each body was donated
   53  directly by the decedent or his or her next of kin for such
   54  purposes to the company providing the body and that such company
   55  has a donation form on file for the body.
   56         (3) Notwithstanding paragraph (2)(c) and in lieu of the
   57  documentation or affidavit required under paragraph (2)(c), for
   58  a plastinated body that, before July 1, 2009, was exhibited in
   59  this state by any entity accredited by the American Association
   60  of Museums, such an accredited entity may submit an affidavit to
   61  the board stating that the body was legally acquired and that
   62  the company providing the body has acquisition documentation on
   63  file for the body. This subsection expires January 1, 2012.
   64         Section 2. This act shall take effect July 1, 2009.
