Florida Senate - 2009 CS for SB 418 By the Committee on Finance and Tax; and Senator Sobel 593-05710-09 2009418c1 1 A bill to be entitled 2 An act relating to enterprise zones; creating s. 3 290.0078, F.S.; authorizing the cities of Hollywood, 4 Hallandale Beach, Pembroke Park, and West Park to 5 jointly apply to the Office of Tourism, Trade, and 6 Economic Development for designation of a single 7 enterprise zone; providing an application deadline; 8 providing requirements for the area of the enterprise 9 zone; requiring the office to establish the effective 10 date of the enterprise zone; providing for the 11 creation of the Energy Economic Zone Pilot Program by 12 Office of Tourism, Trade, and Economic Development; 13 providing powers and duties of the office relating to 14 the pilot program; providing for the designation of a 15 pilot program community and providing guidelines and 16 requirements for the conduct of the program within the 17 community; providing for reports by the office; 18 providing an effective date. 19 20 Be It Enacted by the Legislature of the State of Florida: 21 22 Section 1. Section 290.0078, Florida Statutes, is created 23 to read: 24 290.0078 Joint enterprise zone designation for the City of 25 Hollywood, the City of Hallandale Beach, the City of Pembroke 26 Park, and the City of West Park.—The City of Hollywood, the City 27 of Hallandale Beach, the City of Pembroke Park, and the City of 28 West Park may jointly apply to the Office of Tourism, Trade, and 29 Economic Development for designation of a single enterprise zone 30 encompassing an area not to exceed 20 square miles. The 31 application must be submitted by December 31, 2009, and must 32 comply with the requirements of s. 290.0055. Notwithstanding the 33 provisions of s. 290.0065 limiting the total number of 34 enterprise zones designated and the number of enterprise zones 35 within a population category, the Office of Tourism, Trade, and 36 Economic Development may designate a single enterprise zone 37 under this section. The Office of Tourism, Trade, and Economic 38 Development shall establish the initial effective date of the 39 enterprise zone designated pursuant to this section. However, 40 the state incentives identified in s. 290.007 are not available 41 within the enterprise zone authorized by this section until July 42 1, 2012. 43 Section 2. (1)(a) The Office of Tourism, Trade, and 44 Economic Development, within the Executive Office of the 45 Governor, shall create the Energy Economic Zone Pilot Program to 46 develop a model to help communities encourage and attain 47 renewable electric energy generation, the manufacture of 48 products that contribute to energy conservation, green jobs, and 49 energy-efficient land development designs. The office shall 50 consult with the state land planning agency and the Florida 51 Energy and Climate Commission in developing and administering 52 the pilot program. 53 (b) Sarasota County and Broward County may apply to the 54 office for designation as the pilot program community. The 55 governing board of the pilot program community shall adopt a 56 strategic plan for development and redevelopment in the energy 57 economic zone. The plan must include multimodal development and 58 land use patterns to reduce reliance on automobiles, encourage 59 certified green building developments and renewable energy 60 systems, encourage demonstrations of creating green jobs, and 61 show indications of how local financial and regulatory 62 incentives will be used in the energy economic zone area. 63 (c) The office shall provide the pilot program community 64 and businesses in the energy economic zone technical assistance 65 in identifying and qualifying for eligible grants and credits in 66 job creation, energy, and other areas. 67 (2)(a) The office shall submit an interim report by 68 February. 15, 2010, to the Governor, the President of the 69 Senate, and the Speaker of the House of Representatives 70 regarding the status of the pilot program and any 71 recommendations for statutory changes to accomplish the goals of 72 the pilot program community, including whether it would be 73 beneficial to provide financial incentives similar to those 74 offered an enterprise zone. 75 (b) The office shall submit a final report to the same 76 officers by February 15, 2012, evaluating whether the pilot 77 program has demonstrated any success in development and 78 redevelopment in the energy economic zone incorporating 79 renewable energy generation systems, low-impact design, and 80 energy-efficient land use patterns, and shall recommend whether 81 the program should be expanded for use by other local 82 governments and whether state policies should be revised to 83 encourage the goals of the program. 84 Section 3. This act shall take effect July 1, 2009.
