A bill to be entitled
2An act relating to prescribed drugs; amending ss. 465.003
3and 465.019, F.S.; authorizing the use of an institutional
4formulary system in a Class I institutional pharmacy at
5which, with certain exceptions, all medicinal drugs are
6administered from individual prescription containers to
7the patient and medicinal drugs are not dispensed on the
8premises; amending s. 627.4239, F.S.; revising the
9definition of the term "standard reference compendium" for
10purposes of regulating the insurance coverage of drugs
11used in the treatment of cancer; providing an effective
12date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Subsection (7) of section 465.003, Florida
17Statutes, is amended to read:
18     465.003  Definitions.--As used in this chapter, the term:
19     (7)  "Institutional formulary system" means a method
20whereby the medical staff evaluates, appraises, and selects
21those medicinal drugs or proprietary preparations which in the
22medical staff's clinical judgment are most useful in patient
23care, and which are available for dispensing by a practicing
24pharmacist in a Class I or Class II institutional pharmacy.
25     Section 2.  Subsection (6) of section 465.019, Florida
26Statutes, is amended to read:
27     465.019  Institutional pharmacies; permits.--
28     (6)  In a Class I or Class II institutional pharmacy, an
29institutional formulary system may be adopted with approval of
30the medical staff for the purpose of identifying those medicinal
31drugs and proprietary preparations that may be dispensed by a
32practicing pharmacist the pharmacists employed in such an
33institutional pharmacy institution. A facility with a Class I or
34Class II institutional permit which is operating under the
35formulary system shall establish policies and procedures for the
36development of the system, in accordance with the joint
37standards of the American Hospital Association and American
38Society of Hospital Pharmacists, for the use utilization of an
39institutional a hospital formulary system, which formulary shall
40be approved by the medical staff.
41     Section 3.  Paragraph (b) of subsection (1) of section
42627.4239, Florida Statutes, is amended to read:
43     627.4239  Coverage for use of drugs in treatment of
44cancer.--
45     (1)  DEFINITIONS.--As used in this section, the term:
46     (b)  "Standard reference compendium" means an authoritative
47compendium identified by the Secretary of the United States
48Department of Health and Human Services and recognized by the
49federal Centers for Medicare and Medicaid Services:
50     1.  The United States Pharmacopeia Drug Information;
51     2.  The American Medical Association Drug Evaluations; or
52     3.  The American Hospital Formulary Service Drug
53Information.
54     Section 4.  This act shall take effect July 1, 2009.
