2An act relating to spousal and child support; amending s.
361.075, F.S.; requiring specified findings if a deferred
4payment is ordered in an equitable distribution; providing
5for application of specified provisions; amending s.
661.13, F.S.; providing requirements for child support and
7income deduction orders relating to termination of child
8support; amending s. 61.14, F.S.; specifying how payments
9on alimony or spousal support judgments shall be applied;
10providing for enforcement of interest payments on child
11support and alimony or spousal support judgments;
12providing that interest not accrue on postjudgment
13interest; amending s. 61.30, F.S.; specifying a definition
14relating to payment of child support varying from the
15guideline amount whenever any of the children are required
16by court order to spend a substantial amount of time with
17either parent; requiring specified findings in order for a
18court to impute income beyond minimum wage; prohibiting
19use of certain factors in imputing income beyond minimum
20wage unless a court makes specified findings; revising
21provisions relating to income tax calculations used in
22determining net income; deleting certain net income
23amounts from the child support guidelines schedule;
24providing that certain percentages used for combined
25monthly net income greater than the amount set out in the
26guidelines schedule shall not be used to determine child
27support beyond the amount necessary to satisfy the
28reasonable needs of the child or children; eliminating a
29reduction in the child care cost added to the basic
30support obligation; providing for determination of the
31total minimum child support need; providing for payment of
32a parent's share of the minimum total child support need;
33deleting provisions relating to adjustment of a minimum
34child support award relating to the Internal Revenue
35Service dependency exemption; providing for adjustment of
36a party's minimum child support award when application of
37the child support guidelines leaves the party with a net
38income lower than the federal poverty guidelines; revising
39the percentage of overnight time-sharing that is
40considered significant for certain purposes; allowing a
41court to order a party to execute a waiver of the Internal
42Revenue Service dependency exemption for a child for good
43cause shown; amending s. 409.2563, F.S.; revising
44provisions relating to a presumption of minimum wage
45earning capacity for purposes of administrative support
46orders; amending s. 742.08, F.S.; providing for
47enforcement of interest payments on support judgments;
48providing that interest shall not accrue on postjudgment
49interest; providing an effective date.

51Be It Enacted by the Legislature of the State of Florida:
52
53     Section 1.  Subsection (10) of section 61.075, Florida
54Statutes, is amended to read:
55     61.075  Equitable distribution of marital assets and
56liabilities.--
57     (10)  To do equity between the parties, the court may, in
58lieu of or to supplement, facilitate, or effectuate the
59equitable division of marital assets and liabilities, order a
60monetary payment in a lump sum or in installments paid over a
61fixed period of time. If deferred payment is ordered, the court
62shall require security and a reasonable rate of interest, or
63otherwise recognize the time value of money, in any such
64deferred distribution scheme, absent good cause. The court shall
65make written findings of fact relating to any deferred payment,
66security or lack thereof, and interest or lack thereof. Nothing
67in this section shall preclude application of any provision of
68chapter 55 to any subsequent default.
69     Section 2.  Paragraph (a) of subsection (1) of section
7061.13, Florida Statutes, is amended to read:
71     61.13  Support of children; parenting and time-sharing;
72powers of court.--
73     (1)(a)  In a proceeding under this chapter, the court may
74at any time order either or both parents who owe a duty of
75support to a child to pay support to the other parent or, in the
76case of both parents, to the person with custody in accordance
77with the child support guidelines schedule in s. 61.30.
78     1.  All child support orders and income deduction orders
79entered on or after October 1, 2009, shall provide for the
80following:
81     a.  Termination of child support upon a child's 18th
82birthday, unless the court finds or has previously found that s.
83743.07(2) applies or unless otherwise agreed to by the parties.
84     b.  A schedule, based upon the record existing at the time
85of the order, stating the amount of the monthly child support
86obligation for all the minor children at the time of the order
87and the amount of child support that will be owed for the
88remaining children for whom child support will continue when any
89child is no longer entitled to receive child support under this
90subparagraph.
91     c.  The month and year that the reduction or termination of
92child support becomes effective.
93     2.  Notwithstanding subparagraph 1., the court initially
94entering an order requiring one or both parents to make child
95support payments has continuing jurisdiction after the entry of
96the initial order to modify the amount and terms and conditions
97of the child support payments when the modification is found
98necessary by the court in the best interests of the child, when
99the child reaches majority, when there is a substantial change
100in the circumstances of the parties, when s. 743.07(2) applies,
101or when a child is emancipated, marries, joins the armed
102services, or dies. The court initially entering a child support
103order has continuing jurisdiction to require the obligee to
104report to the court on terms prescribed by the court regarding
105the disposition of the child support payments.
106     Section 3.  Paragraph (d) of subsection (6) of section
10761.14, Florida Statutes, is amended, and subsection (12) is
108added to that section, to read:
109     61.14  Enforcement and modification of support,
110maintenance, or alimony agreements or orders.--
111     (6)
112     (d)  The court shall hear the obligor's motion to contest
113the impending judgment within 15 days after the date of filing
114of the motion. Upon the court's denial of the obligor's motion,
115the amount of the delinquency and all other amounts that become
116due, together with costs and a service charge of up to $25,
117become a final judgment by operation of law against the obligor.
118The depository shall charge interest at the rate established in
119s. 55.03 on all judgments for support. Payments on judgments
120shall be applied first to the current child support due, then to
121any delinquent principal, and then to interest on the support
122judgment. Payments on alimony or spousal support judgments shall
123be applied first to the current alimony or spousal support due,
124then to any delinquent principal, and then to interest on the
125alimony or spousal support judgment.
126     (12)  Interest on child support and alimony or spousal
127support judgments shall be enforceable through all of the
128methods available to enforce the underlying support order,
129including contempt. Interest shall not accrue on postjudgment
130interest.
131     Section 4.  Paragraph (a) of subsection (1), paragraph (b)
132of subsection (2), paragraph (a) of subsection (3), and
133subsections (6), (7), (10), and (11) of section 61.30, Florida
134Statutes, are amended, and subsection (18) is added to that
135section, to read:
136     61.30  Child support guidelines; retroactive child
137support.--
138     (1)(a)  The child support guideline amount as determined by
139this section presumptively establishes the amount the trier of
140fact shall order as child support in an initial proceeding for
141such support or in a proceeding for modification of an existing
142order for such support, whether the proceeding arises under this
143or another chapter. The trier of fact may order payment of child
144support which varies, plus or minus 5 percent, from the
145guideline amount, after considering all relevant factors,
146including the needs of the child or children, age, station in
147life, standard of living, and the financial status and ability
148of each parent. The trier of fact may order payment of child
149support in an amount which varies more than 5 percent from such
150guideline amount only upon a written finding explaining why
151ordering payment of such guideline amount would be unjust or
152inappropriate. Notwithstanding the variance limitations of this
153section, the trier of fact shall order payment of child support
154which varies from the guideline amount as provided in paragraph
155(11)(b) whenever any of the children are required by court order
156or mediation agreement to spend a substantial amount of time
157with either parent as defined by subparagraph (11)(b)8. This
158requirement applies to any living arrangement, whether temporary
159or permanent.
160     (2)  Income shall be determined on a monthly basis for each
161parent as follows:
162
163     (b)1.  Income on a monthly basis shall be imputed to an
164unemployed or underemployed parent when such employment or
165underemployment is found by the court to be voluntary on that
166parent's part, absent a finding of fact by the court of physical
167or mental incapacity or other circumstances over which the
168parent has no control. In the event of such voluntary
169unemployment or underemployment, the employment potential and
170probable earnings level of the parent shall be determined based
171upon his or her recent work history, occupational
172qualifications, and prevailing earnings level in the community
173as provided in this paragraph; however, the court may refuse to
174impute income to a parent if the court finds it necessary for
175the parent to stay home with the child who is the subject of a
176child support calculation.
177     2.  In order for the court to impute income beyond minimum
178wage under subparagraph 1., the court must make specific
179findings of fact consistent with the requirements of this
180subparagraph. The party seeking to impute income has the burden
181to present competent, substantial evidence showing the
182following:
183     a.  That the unemployment or underemployment is voluntary.
184     b.  The amount and source of the imputed income, through
185evidence of income from available employment for which the party
186is suitably qualified by education, experience, current
187licensure, or geographic location, with due consideration being
188given to the parties' time-sharing schedule and their historical
189exercise of the time-sharing provided in the parenting plan or
190relevant order.
191     3.   There shall be a rebuttable presumption entitling the
192court to impute Florida minimum wage on a full-time basis to a
193parent, absent a finding by the court that:
194     a.  The parent has a physical or mental incapacity that
195renders the parent unemployable or underemployed;
196     b.  The parent needs to stay home to care for a child who
197is the subject of the child support calculation, thereby
198preventing the parent's employment or rendering the parent
199underemployed; or
200     c.  There are other circumstances over which the parent has
201no control, except for penal incarceration, that prevent the
202parent from earning an income.

204If evidence is produced that demonstrates that the parent is a
205resident of another state, that state's minimum wage law shall
206apply. In the absence of a state minimum wage, the federal
207minimum wage as determined by the United States Department of
208Labor shall apply.
209     4.  Unless the court makes the appropriate findings under
210sub-subparagraph 2.b., income may not be imputed beyond minimum
211wage requirements in subparagraph 3. based upon:
212     a.  Income records that are more than 5 years old at the
213time of the hearing or trial at which imputation is sought; or
214     b.  Income at a level that a party has never earned in the
215past, unless recently degreed, licensed, certified, relicensed,
216or recertified and thus qualified for, subject to geographic
217location, with due consideration of the parties' existing time-
218sharing schedule and their historical exercise of the time-
219sharing provided in the parenting plan or relevant order.
220     (3)  Net income is obtained by subtracting allowable
221deductions from gross income. Allowable deductions shall
222include:
223     (a)  Federal, state, and local income tax, which shall be
224calculated using gross income deductions, adjusted for actual
225filing status, personal and dependency exemptions, applicable
226deductions, earned income credits, child and dependent care
227credits, and other allowable tax credits and allowable
228dependents and income tax liabilities.
229     (6)  The following guidelines schedule shall be applied to
230the combined net income to determine the minimum child support
231need:

424For combined monthly net income less than the amount set out on
425the above guidelines schedule, the parent should be ordered to
426pay a child support amount, determined on a case-by-case basis,
427to establish the principle of payment and lay the basis for
428increased orders should the parent's income increase in the
429future. For combined monthly net income greater than the amount
430set out in the above guidelines schedule, the obligation shall
431be the minimum amount of support provided by the guidelines
432schedule plus the following percentages multiplied by the amount
433of income over $10,000:

438These percentages shall not be used to determine child support
439beyond the amount necessary to satisfy the reasonable needs of
440the child or children.
441     (7)  Child care costs incurred on behalf of the children
442due to employment, job search, or education calculated to result
443in employment or to enhance income of current employment of
444either parent shall be reduced by 25 percent and then shall be
445added to the basic obligation. After the adjusted child care
446costs are added to the basic obligation, any moneys prepaid by a
447parent for child care costs for the child or children of this
448action shall be deducted from that parent's child support
449obligation for that child or those children. Child care costs
450shall not exceed the level required to provide quality care from
451a licensed source for the children.
452     (10)  The total minimum child support need shall be
453determined by adding child care costs and health insurance costs
454to the minimum child support need. Each parent's actual dollar
455share of the total minimum child support need shall be
456determined by multiplying the minimum child support need by each
457parent's percentage share of the combined monthly net income.
458The resulting amount shall be paid by the parent having less
459than 20 percent of the overnight time-sharing to the parent
460having more than 80 percent of the overnight time-sharing.
461     (11)(a)  The court may adjust the total minimum child
462support award, or either or both parents' share of the total
463minimum child support award, based upon the following deviation
464factors:
465     1.  Extraordinary medical, psychological, educational, or
466dental expenses.
467     2.  Independent income of the child, not to include moneys
468received by a child from supplemental security income.
469     3.  The payment of support for a parent which regularly has
470been paid and for which there is a demonstrated need.
471     4.  Seasonal variations in one or both parents' incomes or
472expenses.
473     5.  The age of the child, taking into account the greater
474needs of older children.
475     6.  Special needs, such as costs that may be associated
476with the disability of a child, that have traditionally been met
477within the family budget even though the fulfilling of those
478needs will cause the support to exceed the presumptive amount
479established by the guidelines.
480     7.  Total available assets of the obligee, obligor, and the
481child.
482     8.  The impact of the Internal Revenue Service dependency
483exemption and waiver of that exemption. The court may order a
484parent to execute a waiver of the Internal Revenue Service
485dependency exemption if the paying parent is current in support
486payments.
487     8.9.  When application of the child support guidelines
488schedule requires a person to pay another person more than 55
489percent of his or her gross income for a child support
490obligation for current support resulting from a single support
491order or when the application of the child support guidelines
492leaves a party with a net income that is lower than the current
493federal poverty guidelines.
494     9.10.  The particular parenting plan, such as where the
495child spends a significant amount of time, but less than 20 40
496percent of the overnights, with one parent, thereby reducing the
497financial expenditures incurred by the other parent; or the
498refusal of a parent to become involved in the activities of the
499child.
500     10.11.  Any other adjustment which is needed to achieve an
501equitable result which may include, but not be limited to, a
502reasonable and necessary existing expense or debt. Such expense
503or debt may include, but is not limited to, a reasonable and
504necessary expense or debt which the parties jointly incurred
505during the marriage.
506     (b)  Whenever a particular parenting plan provides that
507each child spend a substantial amount of time with each parent,
508the court shall adjust any award of child support, as follows:
509     1.  In accordance with subsections (9) and (10), calculate
510the amount of support obligation apportioned to each parent
511without including day care and health insurance costs in the
512calculation and multiply the amount by 1.5.
513     2.  Calculate the percentage of overnight stays the child
514spends with each parent.
515     3.  Multiply each parent's support obligation as calculated
516in subparagraph 1. by the percentage of the other parent's
517overnight stays with the child as calculated in subparagraph 2.
518     4.  The difference between the amounts calculated in
519subparagraph 3. shall be the monetary transfer necessary between
520the parents for the care of the child, subject to an adjustment
521for day care and health insurance expenses.
522     5.  Pursuant to subsections (7) and (8), calculate the net
523amounts owed by each parent for the expenses incurred for day
524care and health insurance coverage for the child. Day care shall
525be calculated without regard to the 25-percent reduction applied
526by subsection (7).
527     6.  Adjust the support obligation owed by each parent
528pursuant to subparagraph 4. by crediting or debiting the amount
529calculated in subparagraph 5. This amount represents the child
530support which must be exchanged between the parents.
531     7.  The court may deviate from the child support amount
532calculated pursuant to subparagraph 6. based upon the deviation
533factors in paragraph (a), as well as the obligee parent's low
534income and ability to maintain the basic necessities of the home
535for the child, the likelihood that either parent will actually
536exercise the time-sharing schedule set forth in the parenting
537plan granted by the court, and whether all of the children are
538exercising the same time-sharing schedule.
539     8.  For purposes of adjusting any award of child support
540under this paragraph, "substantial amount of time" means that a
541parent exercises time-sharing visitation at least 20 40 percent
542of the overnights of the year.
543     (c)  A parent's failure to regularly exercise the court-
544ordered or agreed time-sharing schedule not caused by the other
545parent which resulted in the adjustment of the amount of child
546support pursuant to subparagraph (a)9.10. or paragraph (b) shall
547be deemed a substantial change of circumstances for purposes of
548modifying the child support award. A modification pursuant to
549this paragraph shall be retroactive to the date the noncustodial
550parent first failed to regularly exercise the court-ordered or
551agreed time-sharing schedule.
552     (18)  The court may, for good cause shown, order the parent
553otherwise entitled to the Internal Revenue Service dependency
554exemption for a child to execute a waiver of the dependency
555exemption.
556     Section 5.  Paragraph (a) of subsection (5) of section
557409.2563, Florida Statutes, is amended to read:
558     409.2563  Administrative establishment of child support
559obligations.--
560     (5)  PROPOSED ADMINISTRATIVE SUPPORT ORDER.--
561     (a)  After serving notice upon a parent in accordance with
562subsection (4), the department shall calculate that parent's
563child support obligation under the child support guidelines
564schedule as provided by s. 61.30, based on any timely financial
565affidavits received and other information available to the
566department. If either parent fails to comply with the
567requirement to furnish a financial affidavit, the department may
568proceed on the basis of information available from any source,
569if such information is sufficiently reliable and detailed to
570allow calculation of guideline schedule amounts under s. 61.30.
571If a parent receives public assistance and fails to submit a
572financial affidavit, the department may submit a financial
573affidavit for that parent pursuant to s. 61.30(15). If there is
574a lack of sufficient reliable information concerning a parent's
575actual earnings for a current or past period, there shall be a
576rebuttable presumption it shall be presumed for the purpose of
577establishing a support obligation that the parent had an earning
578capacity equal to the Florida federal minimum wage on a full-
579time basis during the applicable period, unless evidence is
580presented that the parent is a resident of another state, in
581which case that state's minimum wage shall apply. In the absence
582of a state minimum wage, the federal minimum wage as determined
583by the United States Department of Labor shall apply.
584     Section 6.  Section 742.08, Florida Statutes, is amended to
585read:
586     742.08  Default of support payments.--Upon default in
587payment of any moneys ordered by the court to be paid, the court
588may enter a judgment for the amount in default, plus interest,
589administrative costs, filing fees, and other expenses incurred
590by the clerk of the circuit court which shall be a lien upon all
591property of the defendant both real and personal. Interest on
592support judgments shall be enforceable through all of the
593methods available to enforce the underlying support order,
594including contempt. Interest shall not accrue on postjudgment
595interest. Costs and fees shall be assessed only after the court
596makes a determination of the nonprevailing party's ability to
597pay such costs and fees. In Title IV-D cases, any costs,
598including filing fees, recording fees, mediation costs, service
599of process fees, and other expenses incurred by the clerk of the
600circuit court, shall be assessed only against the nonprevailing
601obligor after the court makes a determination of the
602nonprevailing obligor's ability to pay such costs and fees. The
603Department of Revenue shall not be considered a party for
604purposes of this section; however, fees may be assessed against
605the department pursuant to s. 57.105(1). Willful failure to
606comply with an order of the court shall be deemed a contempt of
607the court entering the order and shall be punished as such. The
608court may require bond of the defendant for the faithful
609performance of his or her obligation under the order of the
610court in such amount and upon such conditions as the court shall
611direct.
612     Section 7.  This act shall take effect October 1, 2009.
