A bill to be entitled
2An act relating to specialty license plates; providing a
3short title; amending ss. 320.08056 and 320.08058, F.S.;
4creating a Let's Go Surfing license plate and a Florida
5Horse Park license plate; establishing annual use fees for
6the plates; providing for the distribution of use fees
7received from the sale of such plates; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  This act may be cited as the "Erik Jersted
13Memorial Act."
14     Section 2.  Paragraphs (qqq) and (rrr) are added to
15subsection (4) of section 320.08056, Florida Statutes, to read:
16     320.08056  Specialty license plates.--
17     (4)  The following license plate annual use fees shall be
18collected for the appropriate specialty license plates:
19     (qqq)  Let's Go Surfing license plate, $25.
20     (rrr)  Florida Horse Park license plate, $25.
21     Section 3.  Subsections (69) and (70) are added to section
22320.08058, Florida Statutes, to read:
23     320.08058  Specialty license plates.--
24     (69)  LET'S GO SURFING LICENSE PLATES.--
25     (a)  The department shall develop a Let's Go Surfing
26license plate as provided in this section. Let's Go Surfing
27license plates must bear the colors and design approved by the
28department. The word "Florida" must appear at the top of the
29plate, and the words "Let's Go Surfing" must appear at the
30bottom of the plate.
31     (b)  The license plate annual use fees shall be distributed
32to East Coast Surfing Hall of Fame and Museum, Inc., to fund
33activities, programs, and projects to promote Florida's surfing-
34related tourism, preserve Florida's surfing history and
35heritage, preserve Florida's surf and shores, and honor
36lifeguards who patrol Florida's surf and shores to protect
37beach-goers, surfers, and others. East Coast Surfing Hall of
38Fame and Museum, Inc., may retain all revenue from the annual
39use fees until all startup costs for developing and establishing
40the plate have been recovered. Thereafter, up to 10 percent of
41the annual use fee revenue may be used for administration,
42promotion, and marketing of the plate, including the annual
43audit and compliance affidavit costs.
44     (70)  FLORIDA HORSE PARK LICENSE PLATES.--
45     (a)  The department shall develop a Florida Horse Park
46license plate as provided in this section. The plate must bear
47the colors and design approved by the department. The word
48"Florida" must appear at the top of the plate, and the words
49"Discover Florida's Horses" must appear at the bottom of the
50plate.
51     (b)  The annual use fees shall be distributed to the
52Florida Agriculture Center and Horse Park Authority created by
53s. 570.952, which shall retain all proceeds until all startup
54costs for developing and establishing the plate have been
55recovered. Thereafter, the proceeds shall be used as follows:
56     1.  A maximum of 5 percent of the proceeds from the annual
57use fees may be used for the administration of the Florida Horse
58Park license plate program.
59     2.  A maximum of 5 percent of the proceeds may be used to
60promote and market the license plate.
61     3.  The remaining proceeds shall be used by the authority
62to promote the Florida Agriculture Center and Horse Park located
63in Marion County; to support continued development of the park,
64including the construction of additional educational facilities,
65barns, and other structures; to provide improvements to the
66existing infrastructure at the park; and to provide for
67operational expenses of the Florida Agriculture Center and Horse
68Park.
69     Section 4.  This act shall take effect October 1, 2009.
