House Comm: WD . 04/15/2009 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on General Government Appropriations (Dean) recommended the following: 1 Senate Amendment to Amendment (484100) 2 3 4 Delete lines 50 - 75 5 and insert: 6 (7) A residential or commercial irrigation user that 7 installs and operates a smart irrigation controller is exempt 8 from any day-of-the-week watering restrictions imposed by the 9 applicable local government and water management district if the 10 smart irrigation controller is approved by the local government 11 after consultation with the water management district; is 12 installed by a licensed contractor; allows for irrigation 13 schedule adjustments, including run times and required cycles 14 based on soil moisture requirements; is remotely monitored by a 15 private company, local government, or water management district 16 that is able to remotely modify the settings for irrigation 17 cycles and run times; and has a notice posted at the residence 18 or commercial facility in plain view from the nearest roadway 19 stating, “Irrigating with Smart Irrigation Controller,” and the 20 address of the parcel. The smart irrigation controller user 21 remains subject to all other irrigation restrictions. A 22 qualifying smart irrigation user shall lose the day-of-the-week 23 watering exemption if the user fails to remain in compliance 24 with the exemption conditions. A “smart irrigation controller” 25 means a device that assesses the available plant soil moisture 26 in order to optimize an irrigation system and minimize the use 27 of water, and is weather or soil-sensor based. This subsection 28 does not require a local government to approve a smart 29 irrigation controller or require a property owner to install a 30 smart irrigation controller.
