8 | Be It Enacted by the Legislature of the State of Florida: |

10 | Section 1. Subsection (4) of section 1009.23, Florida |
11 | Statutes, is amended to read: |
12 | 1009.23 Community college student fees.-- |
13 | (4) Each community college board of trustees shall |
14 | establish tuition and out-of-state fees, which may vary no more |
15 | than 10 percent below and 15 percent above the combined total of |
16 | the standard tuition and fees established in subsection (3), |
17 | provided that any amount from 10 to 15 percent above the |
18 | standard tuition and fees established in subsection (3) shall be |
19 | used only to support safety and security purposes. In order to |
20 | assess an additional amount for safety and security purposes, a |
21 | community college board of trustees must provide written |
22 | justification to the State Board of Education based on criteria |
23 | approved by the board of trustees, including, but not limited |
24 | to, criteria such as local crime data and information, and |
25 | strategies for the implementation of local safety plans. Should |
26 | a college decide to increase the tuition and fees, the funds |
27 | raised by increasing the tuition and fees must be expended |
28 | solely for additional safety and security purposes and shall not |
29 | supplant funding expended in the 1998-1999 budget for safety and |
30 | security purposes. |
31 | Section 2. This act shall take effect July 1, 2009. |
