5 | examination fee shall be deposited into the Highway Safety |
6 | Operating Trust Fund. The conducting a physical examination of |
7 | the vehicle shall include, but not be limited to, verification |
8 | of the vehicle identification number and verification of the |
9 | bill of sale or title for major components to assure its |
10 | identity. In addition to all other fees charged, a sum of $1 |
11 | shall be paid for the issuance of an original or duplicate |
12 | certificate of title to cover the cost of materials used for |
13 | security purposes. |
14 | (5) All fees collected pursuant to subsection (3) shall be |
15 | paid into the Nongame Wildlife Trust Fund. For fiscal years |
16 | 2009-2010 through 2014-2015 only, $21 Twenty-one dollars of each |
17 | fee for each applicable original certificate of title and each |
18 | applicable duplicate copy of a certificate of title, after |
19 | deducting the service charges imposed by s. 215.20, shall be |
20 | deposited into the State Transportation Trust Fund. Beginning |
21 | July 1, 2015, $42 of each fee for each applicable original |
22 | certificate of title and each applicable duplicate copy of a |
23 | certificate of title, after deducting the service charges |
24 | imposed by s. 215.20, shall be deposited into the State |
25 | Transportation Trust Fund. All other fees collected by the |
26 | department under this chapter shall be paid into the General |
27 | Revenue Fund. |
28 | Section 3. Subsection (5) of section 320.03, Florida |
29 | Statutes, is amended to read: |
30 | 320.03 Registration; duties of tax collectors; |
31 | International Registration Plan.-- |
32 | (5) A fee of $1 50 cents shall be charged, in addition to |
33 | the fees required under s. 320.08, on every license registration |
34 | sold to cover the costs of the Florida Real Time Vehicle |
35 | Information System. The fees collected hereunder shall be |
36 | distributed as follows: 75 cents 25 cents into the Highway |
37 | Safety Operating Trust Fund, which shall be used to fund the |
38 | Florida Real Time Vehicle Information System and may be used to |
39 | fund the general operations of the department, and 25 cents into |
40 | the Highway Safety Operating Trust Fund to be used exclusively |
41 | to fund the Florida Real Time Vehicle Information System. The |
42 | only use of this latter portion of the fee shall be to fund the |
43 | Florida Real Time Vehicle Information System equipment, |
44 | software, and networks used in the offices of the county tax |
45 | collectors as agents of the department and the ancillary |
46 | technology necessary to integrate the Florida Real Time Vehicle |
47 | Information System with other tax collection systems. The |
48 | department shall administer this program upon consultation with |
49 | the Florida Tax Collectors, Inc., to ensure that each county tax |
50 | collector's office will be technologically equipped and |
51 | functional for the operation of the Florida Real Time Vehicle |
52 | Information System. Any of the designated revenue collected to |
53 | support functions of the county tax collectors and not used in a |
54 | given year will remain exclusively in the trust fund as a |
55 | carryover to the following year. |
56 | Section 4. Paragraph (a) of subsection (1) of section |
57 | 320.04, Florida Statutes, is amended to read: |
58 | 320.04 Registration service charge.-- |
59 | (1)(a) There shall be a service charge of $5 $2.50 for |
60 | each application which is handled in connection with original |
61 | issuance, duplicate issuance, or transfer of any license plate, |
62 | mobile home sticker, or validation sticker or with transfer or |
63 | duplicate issuance of any registration certificate. There may |
64 | also be a service charge of up to $1 for the issuance of each |
65 | license plate validation sticker, vessel decal, and mobile home |
66 | sticker issued from an automated vending facility or printer |
67 | dispenser machine which shall be payable to and retained by the |
68 | department to provide for automated vending facilities or |
69 | printer dispenser machines used to dispense such stickers and |
70 | decals by each tax collector's or license tag agent's employee. |
71 | Section 5. Subsection (3) of section 320.05, Florida |
72 | Statutes, is amended to read: |
73 | 320.05 Records of the department; inspection procedure; |
74 | lists and searches; fees.-- |
75 | (3)(a) The department is authorized, upon application of |
76 | any person and payment of the proper fees, to prepare and |
77 | furnish lists containing motor vehicle or vessel information in |
78 | such form as the department may authorize, to search the records |
79 | of the department and make reports thereof, and to make |
80 | photographic copies of the department records and attestations |
81 | thereof. |
82 | (b) Fees therefor shall be charged and collected as |
83 | follows: |
84 | 1. For providing lists of motor vehicle or vessel records |
85 | for the entire state, or any part or parts thereof, divided |
86 | according to counties, a sum computed at a rate of not less than |
87 | 1 cent nor more than 5 cents per item. |
88 | 2. For providing noncertified photographic copies of motor |
89 | vehicle or vessel documents, $1 per page. |
90 | 3. For providing noncertified photographic copies of |
91 | micrographic records, $1 per page. |
92 | 4. For providing certified copies of motor vehicle or |
93 | vessel records, $3 per record. |
94 | 5. For providing noncertified computer-generated printouts |
95 | of motor vehicle or vessel records, 50 cents per record. |
96 | 6. For providing certified computer-generated printouts of |
97 | motor vehicle or vessel records, $3 per record. |
98 | 7. For providing electronic access to motor vehicle, |
99 | vessel, and mobile home registration data requested by tag, |
100 | vehicle identification number, title number, or decal number, 50 |
101 | cents per item. |
102 | 8. For providing electronic access to driver's license |
103 | status report by name, sex, and date of birth or by driver |
104 | license number, 50 cents per item. |
105 | 9. For providing lists of licensed mobile home dealers and |
106 | manufacturers and recreational vehicle dealers and |
107 | manufacturers, $15 per list. |
108 | 10. For providing lists of licensed motor vehicle dealers, |
109 | $25 per list. |
110 | 11. For each copy of a videotape record, $15 per tape. |
111 | 12. For each copy of the Division of Motor Vehicles |
112 | Procedures Manual, $25. |
113 | (c) Fees collected pursuant to paragraph (b) shall be |
114 | deposited into the Highway Safety Operating Trust Fund. |
115 | (d) The department shall furnish such information without |
116 | charge to any court or governmental entity. |
117 | (e) When motor vehicle, vessel, or mobile home |
118 | registration data is provided by electronic access through a tax |
119 | collector's office, the appropriate fee provided in paragraph |
120 | (b) must be collected and deposited pursuant to paragraph (c) a |
121 | fee for the electronic access is not required to be assessed. |
122 | However, at the tax collector's discretion, a fee equal to or |
123 | less than the fee charged by the department for such information |
124 | may be assessed by the tax collector for the electronic access. |
125 | Notwithstanding paragraph (c), any funds collected by the tax |
126 | collector as a result of providing such access shall be retained |
127 | by the tax collector. |
128 | Section 6. Paragraph (b) of subsection (1) and paragraph |
129 | (b) of subsection (3) of section 320.06, Florida Statutes, as |
130 | amended by chapter 2009-14, Laws of Florida, are amended to |
131 | read: |
132 | 320.06 Registration certificates, license plates, and |
133 | validation stickers generally.-- |
134 | (1) |
135 | (b) Registration license plates bearing a graphic symbol |
136 | and the alphanumeric system of identification shall be issued |
137 | for a 10-year 6-year period. At the end of that 10-year 6-year |
138 | period, upon renewal, the plate shall be replaced. The |
139 | department shall extend stagger the scheduled implementation of |
140 | the 6-year license plate replacement date from a 6-year period |
141 | to a 10-year period for any plate issued after July 1, 2009 |
142 | cycle. The fee for such replacement is $20 $12, $2 of which |
143 | shall be paid each year before the plate is replaced, to be |
144 | credited towards the next $20 $12 replacement fee. The fees |
145 | shall be deposited into the Highway Safety Operating Trust Fund. |
146 | A credit or refund shall not be given for any prior years' |
147 | payments of such prorated replacement fee if the plate is |
148 | replaced or surrendered before the end of the 10-year 6-year |
149 | period, except that a credit may be given when a registrant is |
150 | required by the department to replace a license plate under s. |
151 | 320.08056(8)(a). With each license plate, there shall be issued |
152 | a validation sticker showing the owner's birth month, license |
153 | plate number, and the year of expiration or the appropriate |
154 | renewal period if the owner is not a natural person. The |
155 | validation sticker shall be placed on the upper right corner of |
156 | the license plate. Such license plate and validation sticker |
157 | shall be issued based on the applicant's appropriate renewal |
158 | period. The registration period is a period of 12 months, the |
159 | extended registration period is a period of 24 months, and all |
160 | expirations shall occur based on the applicant's appropriate |
161 | registration period. A vehicle with an apportioned registration |
162 | shall be issued an annual license plate and a cab card that |
163 | denote the declared gross vehicle weight for each apportioned |
164 | jurisdiction in which the vehicle is authorized to operate. |
165 | (3) |
166 | (b) An additional fee of $1.50 50 cents shall be collected |
167 | and deposited into the Highway Safety Operating Trust Fund on |
168 | each motor vehicle registration or motor vehicle renewal |
169 | registration issued in this state in order that all license |
170 | plates and validation stickers be fully treated with |
171 | retroreflective material. |
172 | Section 7. Subsections (3) and (5) of section 320.0607, |
173 | Florida Statutes, are amended to read: |
174 | 320.0607 Replacement license plates, validation decal, or |
175 | mobile home sticker.-- |
176 | (3) Except as provided in subsection (2), in all such |
177 | cases, upon filing of an application accompanied by a fee of $20 |
178 | $10 plus applicable service charges, the department shall issue |
179 | a replacement plate, sticker, or decal as the case may be if it |
180 | is satisfied that the information reported in the application is |
181 | true. The replacement fee shall be deposited into the Highway |
182 | Safety Operating Trust Fund. |
183 | (5) Upon the issuance of an original license plate, the |
184 | applicant shall pay a fee of $20 $10 to be deposited in the |
185 | Highway Safety Operating Trust Fund. |
186 | Section 8. Subsection (1) of section 320.072, Florida |
187 | Statutes, is amended to read: |
188 | 320.072 Additional fee imposed on certain motor vehicle |
189 | registration transactions.-- |
190 | (1) A fee of $200 $100 is imposed upon the initial |
191 | application for registration pursuant to s. 320.06 of every |
192 | motor vehicle classified in s. 320.08(2), (3), and (9)(c) and |
193 | (d). |
194 | Section 9. Paragraphs (a), (b), and (d) of subsection (1) |
195 | and subsections (2) through (9) of section 320.08, Florida |
196 | Statutes, are amended to read: |

266 | 2. The truck tractor is used primarily for the hauling of |
267 | forestry products, and is also used for the hauling of |
268 | associated forestry harvesting equipment used by the owner of |
269 | the truck tractor. |
270 | (n) A truck tractor or heavy truck, not operated as a for- |
271 | hire vehicle, which is engaged exclusively in transporting raw, |
272 | unprocessed, and nonmanufactured agricultural or horticultural |
273 | products within a 150-mile radius of its home address, shall be |
274 | eligible for a restricted license plate for a fee of $130 $65 |
275 | flat, if such vehicle's declared gross vehicle weight is less |
276 | than 44,000 pounds; or $480 $240 flat, if such vehicle's |
277 | declared gross vehicle weight is 44,000 pounds or more and such |
278 | vehicle only transports: |
279 | 1. From the point of production to the point of primary |
280 | manufacture; |
281 | 2. From the point of production to the point of assembling |
282 | the same; or |
283 | 3. From the point of production to a shipping point of |
284 | either a rail, water, or motor transportation company. |

286 | Such not-for-hire truck tractors and heavy trucks used |
287 | exclusively in transporting raw, unprocessed, and |
288 | nonmanufactured agricultural or horticultural products may be |
289 | incidentally used to haul farm implements and fertilizers when |
290 | delivered direct to the growers. The department may require any |
291 | such documentation deemed necessary to determine eligibility |
292 | prior to issuance of this license plate. For the purpose of this |
293 | paragraph, "not-for-hire" means the owner of the motor vehicle |
294 | must also be the owner of the raw, unprocessed, and |
295 | nonmanufactured agricultural or horticultural product, or the |
296 | user of the farm implements and fertilizer being delivered. |
297 | (5) SEMITRAILERS, FEES ACCORDING TO GROSS VEHICLE WEIGHT; |
298 | SCHOOL BUSES; SPECIAL PURPOSE VEHICLES.-- |
299 | (a)1. A semitrailer drawn by a GVW truck tractor by means |
300 | of a fifth-wheel arrangement: $20 $10 flat per registration year |

310 | (c) A school bus used exclusively to transport pupils to |
311 | and from school or school or church activities or functions |
312 | within their own county: $60 $30 flat. |
313 | (d) A wrecker, as defined in s. 320.01(40), which is used |
314 | to tow a vessel as defined in s. 327.02(39), a disabled, |
315 | abandoned, stolen-recovered, or impounded motor vehicle as |
316 | defined in s. 320.01(38), or a replacement motor vehicle as |
317 | defined in s. 320.01(39): $60 $30 flat. |
318 | (e) A wrecker, as defined in s. 320.01(40), which is used |
319 | to tow any motor vehicle, regardless of whether or not such |

385 | and 50 percent shall be deposited in the General Revenue Fund. |
386 | Section 11. Section 320.0804, Florida Statutes, is amended |
387 | to read: |
388 | 320.0804 Surcharge on license tax; transportation trust |
389 | fund.--There is hereby levied and imposed on each license tax |
390 | imposed under s. 320.08, except those set forth in s. |
391 | 320.08(11), a surcharge in the amount of $4 $2, which shall be |
392 | collected in the same manner as the license tax. Of this amount, |
393 | $2 shall be and deposited into the State Transportation Trust |
394 | Fund and $2 shall be deposited into the General Revenue Fund. |
395 | This surcharge shall apply to registration periods beginning |
396 | July 1, 1991. |

425 | (35) FLORIDA GOLF LICENSE PLATES.-- |
426 | (a) The Department of Highway Safety and Motor Vehicles |
427 | shall develop a Florida Golf license plate as provided in this |
428 | section. The word "Florida" must appear at the bottom of the |
429 | plate. The Dade Amateur Golf Association, following consultation |
430 | with the PGA TOUR, the Florida Sports Foundation, the LPGA, and |
431 | the PGA of America may submit a revised sample plate for |
432 | consideration by the department. |
433 | (b) The department shall distribute the Florida Golf |
434 | license plate annual use fee to the Dade Amateur Golf |
435 | Association, a s. 501(c)(3) organization Florida Sports |
436 | Foundation, a direct-support organization of the Office of |
437 | Tourism, Trade, and Economic Development. The license plate |
438 | annual use fees are to be annually allocated as follows: |
439 | 1. Up to 10 5 percent of the proceeds from the annual use |
440 | fees may be used by the Dade Amateur Golf Association Florida |
441 | Sports Foundation for the administration of the Florida Junior |
442 | Youth Golf Program. |
443 | 2. The Dade Amateur Golf Association shall receive the |
444 | first $80,000 in proceeds from the annual use fees for the |
445 | operation of youth golf programs in Miami-Dade County. |
446 | Thereafter, 15 percent of the proceeds from the annual use fees |
447 | shall be provided to the Dade Amateur Golf Association for the |
448 | operation of youth golf programs in Miami-Dade County. |
449 | 3. The remaining proceeds from the annual use fees shall |
450 | be available for grants to nonprofit organizations to operate |
451 | youth golf programs and for marketing the Florida Golf license |
452 | plates. All grant recipients, including the Dade Amateur Golf |
453 | Association, shall be required to provide to the Dade Amateur |
454 | Golf Association Florida Sports Foundation an annual program and |
455 | financial report regarding the use of grant funds. Such reports |
456 | shall be made available to the public. |
457 | (c) The Dade Amateur Golf Association shall Florida Sports |
458 | Foundation may establish a Florida Junior Youth Golf Council |
459 | Program. The Florida Junior Youth Golf Council Program shall |
460 | assist organizations for the benefit of youth, introduce young |
461 | people to golf, instruct young people in golf, teach the values |
462 | of golf, and stress life skills, fair play, courtesy, and self- |
463 | discipline. |
464 | (d) The Dade Amateur Golf Association Florida Sports |
465 | Foundation shall establish a seven-member Florida Junior Golf |
466 | Council committee to offer advice regarding the distribution of |
467 | the annual use fees for grants to nonprofit organizations. The |
468 | council advisory committee shall consist of one member from a |
469 | group serving youth, one member from a group serving disabled |
470 | youth, and five members at large. |
471 | Section 16. Paragraph (b) of subsection (4) of section |
472 | 320.084, Florida Statutes, is amended to read: |
473 | 320.084 Free motor vehicle license plate to certain |
474 | disabled veterans.-- |

476 | (b) There shall be a service charge in accordance with the |
477 | provisions of s. 320.04 for each initial application or renewal |
478 | of registration and an additional sum of $1.50 50 cents on each |
479 | license plate and validation sticker as provided in s. |
480 | 320.06(3)(b). |
481 | Section 17. Subsection (1) of section 320.642, Florida |
482 | Statutes, is amended to read: |
483 | 320.642 Dealer licenses in areas previously served; |
484 | procedure.-- |
485 | (1) Any licensee who proposes to establish an additional |
486 | motor vehicle dealership or permit the relocation of an existing |
487 | dealer to a location within a community or territory where the |
488 | same line-make vehicle is presently represented by a franchised |
489 | motor vehicle dealer or dealers shall give written notice of its |
490 | intention to the department. Such notice shall state: |
491 | (a) The specific location at which the additional or |
492 | relocated motor vehicle dealership will be established. |
493 | (b) The date on or after which the licensee intends to be |
494 | engaged in business with the additional or relocated motor |
495 | vehicle dealer at the proposed location. |
496 | (c) The identity of all motor vehicle dealers who are |
497 | franchised to sell the same line-make vehicle with licensed |
498 | locations in the county or any contiguous county to the county |
499 | where the additional or relocated motor vehicle dealer is |
500 | proposed to be located. |
501 | (d) The names and addresses of the dealer-operator and |
502 | principal investors in the proposed additional or relocated |
503 | motor vehicle dealership. |

505 | Immediately upon receipt of such notice the department shall |
506 | cause a notice to be published in the Florida Administrative |
507 | Weekly. The published notice shall state that a petition or |
508 | complaint by any dealer with standing to protest pursuant to |
509 | subsection (3) must be filed not more than 30 days from the date |
510 | of publication of the notice in the Florida Administrative |
511 | Weekly. The published notice shall describe and identify the |
512 | proposed dealership sought to be licensed, and the department |
513 | shall cause a copy of the notice to be mailed to those dealers |
514 | identified in the licensee's notice under paragraph (c). The |
515 | licensee shall pay a fee of $75 and a service charge of $2.50 |
516 | for each publication. Proceeds from the fee and service charge |
517 | shall be deposited into the Highway Safety Operating Trust Fund. |
518 | Section 18. Subsection (1) of section 322.12, Florida |
519 | Statutes, is amended to read: |
520 | 322.12 Examination of applicants.-- |
521 | (1) It is the intent of the Legislature that every |
522 | applicant for an original driver's license in this state be |
523 | required to pass an examination pursuant to this section. |
524 | However, the department may waive the knowledge, endorsement, |
525 | and skills tests for an applicant who is otherwise qualified and |
526 | who surrenders a valid driver's license from another state or a |
527 | province of Canada, or a valid driver's license issued by the |
528 | United States Armed Forces, if the driver applies for a Florida |
529 | license of an equal or lesser classification. Any applicant who |
530 | fails to pass the initial knowledge test will incur a $10 $5 fee |
531 | for each subsequent test, to be deposited into the Highway |
532 | Safety Operating Trust Fund. Any applicant who fails to pass the |
533 | initial skills test will incur a $20 $10 fee for each subsequent |
534 | test, to be deposited into the Highway Safety Operating Trust |
535 | Fund. A person who seeks to retain a hazardous-materials |
536 | endorsement, pursuant to s. 322.57(1)(d), must pass the |
537 | hazardous-materials test, upon surrendering his or her |
538 | commercial driver's license, if the person has not taken and |
539 | passed the hazardous-materials test within 2 years preceding his |
540 | or her application for a commercial driver's license in this |
541 | state. |
542 | Section 19. Subsection (9) and paragraph (a) of subsection |
543 | (11) of section 322.20, Florida Statutes, are amended to read: |
544 | 322.20 Records of the department; fees; destruction of |
545 | records.-- |
546 | (9) The department may, upon application, furnish to any |
547 | person, from the records of the Division of Driver Licenses, a |
548 | list of the names, addresses, and birth dates of the licensed |
549 | drivers of the entire state or any portion thereof by age group. |
550 | In addition, the department may furnish to the courts, for the |
551 | purpose of establishing jury selection lists, the names, |
552 | addresses, and birth dates of the persons of the entire state or |
553 | any portion thereof by age group having identification cards |
554 | issued by the department. Each person who requests such |
555 | information shall pay a fee, set by the department, of 5 cents 1 |
556 | cent per name listed, except that the department shall furnish |
557 | such information without charge to the courts for the purpose of |
558 | jury selection or to any state agency or to any state attorney, |
559 | sheriff, or chief of police. Such court, state agency, state |
560 | attorney, or law enforcement agency may not sell, give away, or |
561 | allow the copying of such information. Noncompliance with this |
562 | prohibition shall authorize the department to charge the |
563 | noncomplying court, state agency, state attorney, or law |
564 | enforcement agency the appropriate fee for any subsequent lists |
565 | requested. The department may adopt rules necessary to implement |
566 | this subsection. |
567 | (11)(a) The department is authorized to charge the |
568 | following fees for the following services and documents: |
569 | 1. For providing a transcript of any one individual's |
570 | driver history record or any portion thereof for the past 3 |
571 | years or for searching for such record when no record is found |
572 | to be on file....$10.00 $2.10 |
573 | 2. For providing a transcript of any one individual's |
574 | driver history record or any portion thereof for the past 7 |
575 | years or for searching for such record when no record is found |

586 | 7. For assisting persons in searching any one individual's |
587 | driver record at a terminal located at the department's general |
588 | headquarters in Tallahassee....$2.00 |
589 | Section 20. Paragraphs (a) through (d) of subsection (1) |
590 | and subsection (8) of section 322.21, Florida Statutes, are |
591 | amended, and subsection (9) is added to that section, to read: |
592 | 322.21 License fees; procedure for handling and collecting |
593 | fees.-- |
594 | (1) Except as otherwise provided herein, the fee for: |
595 | (a) An original or renewal commercial driver's license is |
596 | $74 $67, which shall include the fee for driver education |
597 | provided by s. 1003.48; however, if an applicant has completed |
598 | training and is applying for employment or is currently employed |
599 | in a public or nonpublic school system that requires the |
600 | commercial license, the fee shall be the same as for a Class E |
601 | driver's license. A delinquent fee of $10 $1 shall be added for |
602 | a renewal made not more than 12 months after the license |
603 | expiration date. |
604 | (b) An original Class E driver's license is $30 $27, which |
605 | shall include the fee for driver's education provided by s. |
606 | 1003.48; however, if an applicant has completed training and is |
607 | applying for employment or is currently employed in a public or |
608 | nonpublic school system that requires a commercial driver |
609 | license, the fee shall be the same as for a Class E license. |
610 | (c) The renewal or extension of a Class E driver's license |
611 | or of a license restricted to motorcycle use only is $22 $20, |
612 | except that a delinquent fee of $10 $1 shall be added for a |
613 | renewal or extension made not more than 12 months after the |
614 | license expiration date. The fee provided in this paragraph |
615 | shall include the fee for driver's education provided by s. |
616 | 1003.48. |
617 | (d) An original driver's license restricted to motorcycle |
618 | use only is $30 $27, which shall include the fee for driver's |
619 | education provided by s. 1003.48. |
620 | (8) Any person who applies for reinstatement following the |
621 | suspension or revocation of the person's driver's license shall |
622 | pay a service fee of $35 following a suspension, and $60 |
623 | following a revocation, which is in addition to the fee for a |
624 | license. Any person who applies for reinstatement of a |
625 | commercial driver's license following the disqualification of |
626 | the person's privilege to operate a commercial motor vehicle |
627 | shall pay a service fee of $60, which is in addition to the fee |
628 | for a license. The department shall collect all of these fees at |
629 | the time of reinstatement. The department shall issue proper |
630 | receipts for such fees and shall promptly transmit all funds |
631 | received by it as follows: |
632 | (a) Of the $35 fee received from a licensee for |
633 | reinstatement following a suspension, the department shall |
634 | deposit $15 in the General Revenue Fund and $20 in the Highway |
635 | Safety Operating Trust Fund. |
636 | (b) Of the $60 fee received from a licensee for |
637 | reinstatement following a revocation or disqualification, the |
638 | department shall deposit $35 in the General Revenue Fund and $25 |
639 | in the Highway Safety Operating Trust Fund. |

641 | If the revocation or suspension of the driver's license was for |
642 | a violation of s. 316.193, or for refusal to submit to a lawful |
643 | breath, blood, or urine test, an additional fee of $130 $115 |
644 | must be charged. However, only one $130 $115 fee may be |
645 | collected from one person convicted of violations arising out of |
646 | the same incident. The department shall collect the $130 $115 |
647 | fee and deposit the fee into the Highway Safety Operating Trust |
648 | Fund at the time of reinstatement of the person's driver's |
649 | license, but the fee may not be collected if the suspension or |
650 | revocation is overturned. If the revocation or suspension of the |
651 | driver's license was for a conviction for a violation of s. |
652 | 817.234(8) or (9) or s. 817.505, an additional fee of $180 is |
653 | imposed for each offense. The department shall collect and |
654 | deposit the additional fee into the Highway Safety Operating |
655 | Trust Fund at the time of reinstatement of the person's driver's |
656 | license. |
657 | (9)(a) An applicant requesting a review authorized in s. |
658 | 322.222, s. 322.2615, s. 322.2616, s. 322.27, or s. 322.64 must |
659 | pay a filing fee of $25 to be deposited into the Highway Safety |
660 | Operating Trust Fund. |
661 | (b) An applicant petitioning the department for a hearing |
662 | authorized in s. 322.271 must pay a filing fee of $12 to be |
663 | deposited into the Highway Safety Operating Trust Fund. |
664 | Section 21. Subsection (2) of section 322.29, Florida |
665 | Statutes, is amended to read: |
666 | 322.29 Surrender and return of license.-- |
667 | (2) The provisions of subsection (1) to the contrary |
668 | notwithstanding, no examination is required for the return of a |
669 | license suspended under s. 318.15 or s. 322.245 unless an |
670 | examination is otherwise required by this chapter. Every person |
671 | applying for the return of a license suspended under s. 318.15 |
672 | or s. 322.245 shall present to the department certification from |
673 | the court that he or she has complied with all obligations and |
674 | penalties imposed on him or her pursuant to s. 318.15 or, in the |
675 | case of a suspension pursuant to s. 322.245, that he or she has |
676 | complied with all directives of the court and the requirements |
677 | of s. 322.245 and shall pay to the department a nonrefundable |
678 | service fee of $60 $47.50, of which $37.50 shall be deposited |
679 | into the General Revenue Fund and $22.50 $10 shall be deposited |
680 | into the Highway Safety Operating Trust Fund. If reinstated by |
681 | the clerk of the court or tax collector, $37.50 shall be |
682 | retained and $22.50 $10 shall be remitted to the Department of |
683 | Revenue for deposit into the Highway Safety Operating Trust |
684 | Fund. However, the service fee is not required if the person is |
685 | required to pay a $35 fee or $60 fee under the |
