3     Amendment (with title amendment)
4     Remove lines 105-1047 and insert:
5examination fee shall be deposited into the Highway Safety
6Operating Trust Fund. The conducting a physical examination of
7the vehicle shall include, but not be limited to, verification
8of the vehicle identification number and verification of the
9bill of sale or title for major components to assure its
10identity. In addition to all other fees charged, a sum of $1
11shall be paid for the issuance of an original or duplicate
12certificate of title to cover the cost of materials used for
13security purposes.
14     (5)  All fees collected pursuant to subsection (3) shall be
15paid into the Nongame Wildlife Trust Fund. For fiscal years
162009-2010 through 2014-2015 only, $21 Twenty-one dollars of each
17fee for each applicable original certificate of title and each
18applicable duplicate copy of a certificate of title, after
19deducting the service charges imposed by s. 215.20, shall be
20deposited into the State Transportation Trust Fund. Beginning
21July 1, 2015, $42 of each fee for each applicable original
22certificate of title and each applicable duplicate copy of a
23certificate of title, after deducting the service charges
24imposed by s. 215.20, shall be deposited into the State
25Transportation Trust Fund. All other fees collected by the
26department under this chapter shall be paid into the General
27Revenue Fund.
28     Section 3.  Subsection (5) of section 320.03, Florida
29Statutes, is amended to read:
30     320.03  Registration; duties of tax collectors;
31International Registration Plan.--
32     (5)  A fee of $1 50 cents shall be charged, in addition to
33the fees required under s. 320.08, on every license registration
34sold to cover the costs of the Florida Real Time Vehicle
35Information System. The fees collected hereunder shall be
36distributed as follows: 75 cents 25 cents into the Highway
37Safety Operating Trust Fund, which shall be used to fund the
38Florida Real Time Vehicle Information System and may be used to
39fund the general operations of the department, and 25 cents into
40the Highway Safety Operating Trust Fund to be used exclusively
41to fund the Florida Real Time Vehicle Information System. The
42only use of this latter portion of the fee shall be to fund the
43Florida Real Time Vehicle Information System equipment,
44software, and networks used in the offices of the county tax
45collectors as agents of the department and the ancillary
46technology necessary to integrate the Florida Real Time Vehicle
47Information System with other tax collection systems. The
48department shall administer this program upon consultation with
49the Florida Tax Collectors, Inc., to ensure that each county tax
50collector's office will be technologically equipped and
51functional for the operation of the Florida Real Time Vehicle
52Information System. Any of the designated revenue collected to
53support functions of the county tax collectors and not used in a
54given year will remain exclusively in the trust fund as a
55carryover to the following year.
56     Section 4.  Paragraph (a) of subsection (1) of section
57320.04, Florida Statutes, is amended to read:
58     320.04  Registration service charge.--
59     (1)(a)  There shall be a service charge of $5 $2.50 for
60each application which is handled in connection with original
61issuance, duplicate issuance, or transfer of any license plate,
62mobile home sticker, or validation sticker or with transfer or
63duplicate issuance of any registration certificate. There may
64also be a service charge of up to $1 for the issuance of each
65license plate validation sticker, vessel decal, and mobile home
66sticker issued from an automated vending facility or printer
67dispenser machine which shall be payable to and retained by the
68department to provide for automated vending facilities or
69printer dispenser machines used to dispense such stickers and
70decals by each tax collector's or license tag agent's employee.
71     Section 5.  Subsection (3) of section 320.05, Florida
72Statutes, is amended to read:
73     320.05  Records of the department; inspection procedure;
74lists and searches; fees.--
75     (3)(a)  The department is authorized, upon application of
76any person and payment of the proper fees, to prepare and
77furnish lists containing motor vehicle or vessel information in
78such form as the department may authorize, to search the records
79of the department and make reports thereof, and to make
80photographic copies of the department records and attestations
81thereof.
82     (b)  Fees therefor shall be charged and collected as
83follows:
84     1.  For providing lists of motor vehicle or vessel records
85for the entire state, or any part or parts thereof, divided
86according to counties, a sum computed at a rate of not less than
871 cent nor more than 5 cents per item.
88     2.  For providing noncertified photographic copies of motor
89vehicle or vessel documents, $1 per page.
90     3.  For providing noncertified photographic copies of
91micrographic records, $1 per page.
92     4.  For providing certified copies of motor vehicle or
93vessel records, $3 per record.
94     5.  For providing noncertified computer-generated printouts
95of motor vehicle or vessel records, 50 cents per record.
96     6.  For providing certified computer-generated printouts of
97motor vehicle or vessel records, $3 per record.
98     7.  For providing electronic access to motor vehicle,
99vessel, and mobile home registration data requested by tag,
100vehicle identification number, title number, or decal number, 50
101cents per item.
102     8.  For providing electronic access to driver's license
103status report by name, sex, and date of birth or by driver
104license number, 50 cents per item.
105     9.  For providing lists of licensed mobile home dealers and
106manufacturers and recreational vehicle dealers and
107manufacturers, $15 per list.
108     10.  For providing lists of licensed motor vehicle dealers,
109$25 per list.
110     11.  For each copy of a videotape record, $15 per tape.
111     12.  For each copy of the Division of Motor Vehicles
112Procedures Manual, $25.
113     (c)  Fees collected pursuant to paragraph (b) shall be
114deposited into the Highway Safety Operating Trust Fund.
115     (d)  The department shall furnish such information without
116charge to any court or governmental entity.
117     (e)  When motor vehicle, vessel, or mobile home
118registration data is provided by electronic access through a tax
119collector's office, the appropriate fee provided in paragraph
120(b) must be collected and deposited pursuant to paragraph (c) a
121fee for the electronic access is not required to be assessed.
122However, at the tax collector's discretion, a fee equal to or
123less than the fee charged by the department for such information
124may be assessed by the tax collector for the electronic access.
125Notwithstanding paragraph (c), any funds collected by the tax
126collector as a result of providing such access shall be retained
127by the tax collector.
128     Section 6.  Paragraph (b) of subsection (1) and paragraph
129(b) of subsection (3) of section 320.06, Florida Statutes, as
130amended by chapter 2009-14, Laws of Florida, are amended to
131read:
132     320.06  Registration certificates, license plates, and
133validation stickers generally.--
134     (1)
135     (b)  Registration license plates bearing a graphic symbol
136and the alphanumeric system of identification shall be issued
137for a 10-year 6-year period. At the end of that 10-year 6-year
138period, upon renewal, the plate shall be replaced. The
139department shall extend stagger the scheduled implementation of
140the 6-year license plate replacement date from a 6-year period
141to a 10-year period for any plate issued after July 1, 2009
142cycle. The fee for such replacement is $20 $12, $2 of which
143shall be paid each year before the plate is replaced, to be
144credited towards the next $20 $12 replacement fee. The fees
145shall be deposited into the Highway Safety Operating Trust Fund.
146A credit or refund shall not be given for any prior years'
147payments of such prorated replacement fee if the plate is
148replaced or surrendered before the end of the 10-year 6-year
149period, except that a credit may be given when a registrant is
150required by the department to replace a license plate under s.
151320.08056(8)(a). With each license plate, there shall be issued
152a validation sticker showing the owner's birth month, license
153plate number, and the year of expiration or the appropriate
154renewal period if the owner is not a natural person. The
155validation sticker shall be placed on the upper right corner of
156the license plate. Such license plate and validation sticker
157shall be issued based on the applicant's appropriate renewal
158period. The registration period is a period of 12 months, the
159extended registration period is a period of 24 months, and all
160expirations shall occur based on the applicant's appropriate
161registration period. A vehicle with an apportioned registration
162shall be issued an annual license plate and a cab card that
163denote the declared gross vehicle weight for each apportioned
164jurisdiction in which the vehicle is authorized to operate.
165     (3)
166     (b)  An additional fee of $1.50 50 cents shall be collected
167and deposited into the Highway Safety Operating Trust Fund on
168each motor vehicle registration or motor vehicle renewal
169registration issued in this state in order that all license
170plates and validation stickers be fully treated with
171retroreflective material.
172     Section 7.  Subsections (3) and (5) of section 320.0607,
173Florida Statutes, are amended to read:
174     320.0607  Replacement license plates, validation decal, or
175mobile home sticker.--
176     (3)  Except as provided in subsection (2), in all such
177cases, upon filing of an application accompanied by a fee of $20
178$10 plus applicable service charges, the department shall issue
179a replacement plate, sticker, or decal as the case may be if it
180is satisfied that the information reported in the application is
181true. The replacement fee shall be deposited into the Highway
182Safety Operating Trust Fund.
183     (5)  Upon the issuance of an original license plate, the
184applicant shall pay a fee of $20 $10 to be deposited in the
185Highway Safety Operating Trust Fund.
186     Section 8.  Subsection (1) of section 320.072, Florida
187Statutes, is amended to read:
188     320.072  Additional fee imposed on certain motor vehicle
189registration transactions.--
190     (1)  A fee of $200 $100 is imposed upon the initial
191application for registration pursuant to s. 320.06 of every
192motor vehicle classified in s. 320.08(2), (3), and (9)(c) and
193(d).
194     Section 9.  Paragraphs (a), (b), and (d) of subsection (1)
195and subsections (2) through (9) of section 320.08, Florida
196Statutes, are amended to read:
197     320.08  License taxes.--Except as otherwise provided
198herein, there are hereby levied and imposed annual license taxes
199for the operation of motor vehicles, mopeds, motorized bicycles
200as defined in s. 316.003(2), and mobile homes, as defined in s.
201320.01, which shall be paid to and collected by the department
202or its agent upon the registration or renewal of registration of
203the following:
204     (1)  MOTORCYCLES AND MOPEDS.--
205     (a)  Any motorcycle: $20 $10 flat.
206     (b)  Any moped: $10 $5 flat.
207     (d)  An ancient or antique motorcycle: $20 $10 flat.
208     (2)  AUTOMOBILES FOR PRIVATE USE.--
209     (a)  An ancient or antique automobile, as defined in s.
210320.086, or a street rod, as defined in s. 320.0863: $15 $7.50
211flat.
212     (b)  Net weight of less than 2,500 pounds: $29 $14.50 flat.
213     (c)  Net weight of 2,500 pounds or more, but less than
2143,500 pounds: $45 $22.50 flat.
215     (d)  Net weight of 3,500 pounds or more: $65 $32.50 flat.
216     (3)  TRUCKS.--
217     (a)  Net weight of less than 2,000 pounds: $29 $14.50 flat.
218     (b)  Net weight of 2,000 pounds or more, but not more than
2193,000 pounds: $45 $22.50 flat.
220     (c)  Net weight more than 3,000 pounds, but not more than
2215,000 pounds: $65 $32.50 flat.
222     (d)  A truck defined as a "goat," or any other vehicle when
223used in the field by a farmer or in the woods for the purpose of
224harvesting a crop, including naval stores, during such
225harvesting operations, and which is not principally operated
226upon the roads of the state: $15 $7.50 flat. A "goat" is a motor
227vehicle designed, constructed, and used principally for the
228transportation of citrus fruit within citrus groves or for the
229transportation of crops on farms, and which can also be used for
230the hauling of associated equipment or supplies, including
231required sanitary equipment, and the towing of farm trailers.
232     (e)  An ancient or antique truck, as defined in s. 320.086:
233$15 $7.50 flat.
234     (4)  HEAVY TRUCKS, TRUCK TRACTORS, FEES ACCORDING TO GROSS
235VEHICLE WEIGHT.--
236     (a)  Gross vehicle weight of 5,001 pounds or more, but less
237than 6,000 pounds: $90 $45 flat.
238     (b)  Gross vehicle weight of 6,000 pounds or more, but less
239than 8,000 pounds: $130 $65 flat.
240     (c)  Gross vehicle weight of 8,000 pounds or more, but less
241than 10,000 pounds: $152 $76 flat.
242     (d)  Gross vehicle weight of 10,000 pounds or more, but
243less than 15,000 pounds: $174 $87 flat.
244     (e)  Gross vehicle weight of 15,000 pounds or more, but
245less than 20,000 pounds: $262 $131 flat.
246     (f)  Gross vehicle weight of 20,000 pounds or more, but

260     (m)  Notwithstanding the declared gross vehicle weight, a
261truck tractor used within a 150-mile radius of its home address
262shall be eligible for a license plate for a fee of $480 $240
263flat if:
264     1.  The truck tractor is used exclusively for hauling
265forestry products; or
266     2.  The truck tractor is used primarily for the hauling of
267forestry products, and is also used for the hauling of
268associated forestry harvesting equipment used by the owner of
269the truck tractor.
270     (n)  A truck tractor or heavy truck, not operated as a for-
271hire vehicle, which is engaged exclusively in transporting raw,
272unprocessed, and nonmanufactured agricultural or horticultural
273products within a 150-mile radius of its home address, shall be
274eligible for a restricted license plate for a fee of $130 $65
275flat, if such vehicle's declared gross vehicle weight is less
276than 44,000 pounds; or $480 $240 flat, if such vehicle's
277declared gross vehicle weight is 44,000 pounds or more and such
278vehicle only transports:
279     1.  From the point of production to the point of primary
280manufacture;
281     2.  From the point of production to the point of assembling
282the same; or
283     3.  From the point of production to a shipping point of
284either a rail, water, or motor transportation company.

286Such not-for-hire truck tractors and heavy trucks used
287exclusively in transporting raw, unprocessed, and
288nonmanufactured agricultural or horticultural products may be
289incidentally used to haul farm implements and fertilizers when
290delivered direct to the growers. The department may require any
291such documentation deemed necessary to determine eligibility
292prior to issuance of this license plate. For the purpose of this
293paragraph, "not-for-hire" means the owner of the motor vehicle
294must also be the owner of the raw, unprocessed, and
295nonmanufactured agricultural or horticultural product, or the
296user of the farm implements and fertilizer being delivered.
297     (5)  SEMITRAILERS, FEES ACCORDING TO GROSS VEHICLE WEIGHT;
298SCHOOL BUSES; SPECIAL PURPOSE VEHICLES.--
299     (a)1.  A semitrailer drawn by a GVW truck tractor by means
300of a fifth-wheel arrangement: $20 $10 flat per registration year
301or any part thereof.
302     2.  A semitrailer drawn by a GVW truck tractor by means of
303a fifth-wheel arrangement: $100 $50 flat per permanent
304registration.
305     (b)  A motor vehicle equipped with machinery and designed
306for the exclusive purpose of well drilling, excavation,
307construction, spraying, or similar activity, and which is not
308designed or used to transport loads other than the machinery
309described above over public roads: $65 $32.50 flat.
310     (c)  A school bus used exclusively to transport pupils to
311and from school or school or church activities or functions
312within their own county: $60 $30 flat.
313     (d)  A wrecker, as defined in s. 320.01(40), which is used
314to tow a vessel as defined in s. 327.02(39), a disabled,
315abandoned, stolen-recovered, or impounded motor vehicle as
316defined in s. 320.01(38), or a replacement motor vehicle as
317defined in s. 320.01(39): $60 $30 flat.
318     (e)  A wrecker, as defined in s. 320.01(40), which is used
319to tow any motor vehicle, regardless of whether or not such
320motor vehicle is a disabled motor vehicle as defined in s.
321320.01(38), a replacement motor vehicle as defined in s.
322320.01(39), a vessel as defined in s. 327.02(39), or any other
323cargo, as follows:
324     1.  Gross vehicle weight of 10,000 pounds or more, but less
325than 15,000 pounds: $174 $87 flat.
326     2.  Gross vehicle weight of 15,000 pounds or more, but less
327than 20,000 pounds: $262 $131 flat.
328     3.  Gross vehicle weight of 20,000 pounds or more, but less
329than 26,000 pounds: $372 $186 flat.
330     4.  Gross vehicle weight of 26,000 pounds or more, but less
331than 35,000 pounds: $480 $240 flat.

358     (9)  RECREATIONAL VEHICLE-TYPE UNITS.--
359     (a)  A travel trailer or fifth-wheel trailer, as defined by
360s. 320.01(1)(b), that does not exceed 35 feet in length: $40 $20

362     (b)  A camping trailer, as defined by s. 320.01(1)(b)2.:

373     Section 10.  Subsection (2) of section 320.0801, Florida
374Statutes, is amended to read:
375     320.0801  Additional license tax on certain vehicles.--
376     (2)  In addition to the license taxes imposed by s. 320.08
377and by subsection (1), there is imposed an additional surcharge
378of $10 $5 on each commercial motor vehicle having a gross
379vehicle weight of 10,000 pounds or more, which surcharge must be
380paid to the department or its agent upon the registration or
381renewal of registration of the commercial motor vehicle.
382Notwithstanding the provisions of s. 320.20, 50 percent of the
383revenues collected from the surcharge imposed in this subsection
384shall must be deposited into the State Transportation Trust Fund
385and 50 percent shall be deposited in the General Revenue Fund.
386     Section 11.  Section 320.0804, Florida Statutes, is amended
387to read:
388     320.0804  Surcharge on license tax; transportation trust
389fund.--There is hereby levied and imposed on each license tax
390imposed under s. 320.08, except those set forth in s.
391320.08(11), a surcharge in the amount of $4 $2, which shall be
392collected in the same manner as the license tax. Of this amount,
393$2 shall be and deposited into the State Transportation Trust
394Fund and $2 shall be deposited into the General Revenue Fund.
395This surcharge shall apply to registration periods beginning
396July 1, 1991.
397     Section 12.  Subsection (1) of section 320.08048, Florida
398Statutes, is amended to read:
399     320.08048  Sample license plates.--
400     (1)  The department is authorized, upon application and
401payment of a $20 $10 fee per plate, to provide one or more
402sample regular issuance license plates or specialty license
403plates based upon availability.
404     Section 13.  Paragraph (c) of subsection (2) of section
405320.0805, Florida Statutes, as amended by chapter 2009-14, Laws
406of Florida, is amended to read:
407     320.0805  Personalized prestige license plates.--
408     (2)  Each request for specific numbers or letters or
409combinations thereof shall be submitted annually to the
410department on an application form supplied by the department,
411accompanied by the following tax and fees:
412     (c)  A processing fee of $5 $2, to be deposited into the
413Highway Safety Operating Trust Fund.
414     Section 14.  Paragraph (b) of subsection (3) of section
415320.08056, Florida Statutes, as amended by chapter 2009-14, Laws
416of Florida, is amended to read:
417     320.08056  Specialty license plates.--
418     (3)  Each request must be made annually to the department,
419accompanied by the following tax and fees:
420     (b)  A processing fee of $5 $2, to be deposited into the
421Highway Safety Operating Trust Fund.
422     Section 15.  Subsection (35) of section 320.08058, Florida
423Statutes, is amended to read:
424     320.08058  Specialty license plates.--
425     (35)  FLORIDA GOLF LICENSE PLATES.--
426     (a)  The Department of Highway Safety and Motor Vehicles
427shall develop a Florida Golf license plate as provided in this
428section. The word "Florida" must appear at the bottom of the
429plate. The Dade Amateur Golf Association, following consultation
430with the PGA TOUR, the Florida Sports Foundation, the LPGA, and
431the PGA of America may submit a revised sample plate for
432consideration by the department.
433     (b)  The department shall distribute the Florida Golf
434license plate annual use fee to the Dade Amateur Golf
435Association, a s. 501(c)(3) organization Florida Sports
436Foundation, a direct-support organization of the Office of
437Tourism, Trade, and Economic Development. The license plate
438annual use fees are to be annually allocated as follows:
439     1.  Up to 10 5 percent of the proceeds from the annual use
440fees may be used by the Dade Amateur Golf Association Florida
441Sports Foundation for the administration of the Florida Junior
442Youth Golf Program.
443     2.  The Dade Amateur Golf Association shall receive the
444first $80,000 in proceeds from the annual use fees for the
445operation of youth golf programs in Miami-Dade County.
446Thereafter, 15 percent of the proceeds from the annual use fees
447shall be provided to the Dade Amateur Golf Association for the
448operation of youth golf programs in Miami-Dade County.
449     3.  The remaining proceeds from the annual use fees shall
450be available for grants to nonprofit organizations to operate
451youth golf programs and for marketing the Florida Golf license
452plates. All grant recipients, including the Dade Amateur Golf
453Association, shall be required to provide to the Dade Amateur
454Golf Association Florida Sports Foundation an annual program and
455financial report regarding the use of grant funds. Such reports
456shall be made available to the public.
457     (c)  The Dade Amateur Golf Association shall Florida Sports
458Foundation may establish a Florida Junior Youth Golf Council
459Program. The Florida Junior Youth Golf Council Program shall
460assist organizations for the benefit of youth, introduce young
461people to golf, instruct young people in golf, teach the values
462of golf, and stress life skills, fair play, courtesy, and self-
463discipline.
464     (d)  The Dade Amateur Golf Association Florida Sports
465Foundation shall establish a seven-member Florida Junior Golf
466Council committee to offer advice regarding the distribution of
467the annual use fees for grants to nonprofit organizations. The
468council advisory committee shall consist of one member from a
469group serving youth, one member from a group serving disabled
470youth, and five members at large.
471     Section 16.  Paragraph (b) of subsection (4) of section
472320.084, Florida Statutes, is amended to read:
473     320.084  Free motor vehicle license plate to certain
474disabled veterans.--

476     (b)  There shall be a service charge in accordance with the
477provisions of s. 320.04 for each initial application or renewal
478of registration and an additional sum of $1.50 50 cents on each
479license plate and validation sticker as provided in s.
480320.06(3)(b).
481     Section 17.  Subsection (1) of section 320.642, Florida
482Statutes, is amended to read:
483     320.642  Dealer licenses in areas previously served;
484procedure.--
485     (1)  Any licensee who proposes to establish an additional
486motor vehicle dealership or permit the relocation of an existing
487dealer to a location within a community or territory where the
488same line-make vehicle is presently represented by a franchised
489motor vehicle dealer or dealers shall give written notice of its
490intention to the department. Such notice shall state:
491     (a)  The specific location at which the additional or
492relocated motor vehicle dealership will be established.
493     (b)  The date on or after which the licensee intends to be
494engaged in business with the additional or relocated motor
495vehicle dealer at the proposed location.
496     (c)  The identity of all motor vehicle dealers who are
497franchised to sell the same line-make vehicle with licensed
498locations in the county or any contiguous county to the county
499where the additional or relocated motor vehicle dealer is
500proposed to be located.
501     (d)  The names and addresses of the dealer-operator and
502principal investors in the proposed additional or relocated
503motor vehicle dealership.
504
505Immediately upon receipt of such notice the department shall
506cause a notice to be published in the Florida Administrative
507Weekly. The published notice shall state that a petition or
508complaint by any dealer with standing to protest pursuant to
509subsection (3) must be filed not more than 30 days from the date
510of publication of the notice in the Florida Administrative
511Weekly. The published notice shall describe and identify the
512proposed dealership sought to be licensed, and the department
513shall cause a copy of the notice to be mailed to those dealers
514identified in the licensee's notice under paragraph (c). The
515licensee shall pay a fee of $75 and a service charge of $2.50
516for each publication. Proceeds from the fee and service charge
517shall be deposited into the Highway Safety Operating Trust Fund.
518     Section 18.  Subsection (1) of section 322.12, Florida
519Statutes, is amended to read:
520     322.12  Examination of applicants.--
521     (1)  It is the intent of the Legislature that every
522applicant for an original driver's license in this state be
523required to pass an examination pursuant to this section.
524However, the department may waive the knowledge, endorsement,
525and skills tests for an applicant who is otherwise qualified and
526who surrenders a valid driver's license from another state or a
527province of Canada, or a valid driver's license issued by the
528United States Armed Forces, if the driver applies for a Florida
529license of an equal or lesser classification. Any applicant who
530fails to pass the initial knowledge test will incur a $10 $5 fee
531for each subsequent test, to be deposited into the Highway
532Safety Operating Trust Fund. Any applicant who fails to pass the
533initial skills test will incur a $20 $10 fee for each subsequent
534test, to be deposited into the Highway Safety Operating Trust
535Fund. A person who seeks to retain a hazardous-materials
536endorsement, pursuant to s. 322.57(1)(d), must pass the
537hazardous-materials test, upon surrendering his or her
538commercial driver's license, if the person has not taken and
539passed the hazardous-materials test within 2 years preceding his
540or her application for a commercial driver's license in this
541state.
542     Section 19.  Subsection (9) and paragraph (a) of subsection
543(11) of section 322.20, Florida Statutes, are amended to read:
544     322.20  Records of the department; fees; destruction of
545records.--
546     (9)  The department may, upon application, furnish to any
547person, from the records of the Division of Driver Licenses, a
548list of the names, addresses, and birth dates of the licensed
549drivers of the entire state or any portion thereof by age group.
550In addition, the department may furnish to the courts, for the
551purpose of establishing jury selection lists, the names,
552addresses, and birth dates of the persons of the entire state or
553any portion thereof by age group having identification cards
554issued by the department. Each person who requests such
555information shall pay a fee, set by the department, of 5 cents 1
556cent per name listed, except that the department shall furnish
557such information without charge to the courts for the purpose of
558jury selection or to any state agency or to any state attorney,
559sheriff, or chief of police. Such court, state agency, state
560attorney, or law enforcement agency may not sell, give away, or
561allow the copying of such information. Noncompliance with this
562prohibition shall authorize the department to charge the
563noncomplying court, state agency, state attorney, or law
564enforcement agency the appropriate fee for any subsequent lists
565requested. The department may adopt rules necessary to implement
566this subsection.
567     (11)(a)  The department is authorized to charge the
568following fees for the following services and documents:
569     1.  For providing a transcript of any one individual's
570driver history record or any portion thereof for the past 3
571years or for searching for such record when no record is found
572to be on file....$10.00 $2.10
573     2.  For providing a transcript of any one individual's
574driver history record or any portion thereof for the past 7
575years or for searching for such record when no record is found
576to be on file....$14.00 $3.10
577     3.  For providing a certified copy of a transcript of the
578driver history record or any portion thereof for any one
579individual....$3.10
580     4.  For providing a certified photographic copy of a
581document, per page....$1.00
582     5.  For providing an exemplified record....$15.00
583     6.  For providing photocopies of documents, papers,
584letters, clearances, or license or insurance status reports, per
585page....$0.50
586     7.  For assisting persons in searching any one individual's
587driver record at a terminal located at the department's general
588headquarters in Tallahassee....$2.00
589     Section 20.  Paragraphs (a) through (d) of subsection (1)
590and subsection (8) of section 322.21, Florida Statutes, are
591amended, and subsection (9) is added to that section, to read:
592     322.21  License fees; procedure for handling and collecting
593fees.--
594     (1)  Except as otherwise provided herein, the fee for:
595     (a)  An original or renewal commercial driver's license is
596$74 $67, which shall include the fee for driver education
597provided by s. 1003.48; however, if an applicant has completed
598training and is applying for employment or is currently employed
599in a public or nonpublic school system that requires the
600commercial license, the fee shall be the same as for a Class E
601driver's license. A delinquent fee of $10 $1 shall be added for
602a renewal made not more than 12 months after the license
603expiration date.
604     (b)  An original Class E driver's license is $30 $27, which
605shall include the fee for driver's education provided by s.
6061003.48; however, if an applicant has completed training and is
607applying for employment or is currently employed in a public or
608nonpublic school system that requires a commercial driver
609license, the fee shall be the same as for a Class E license.
610     (c)  The renewal or extension of a Class E driver's license
611or of a license restricted to motorcycle use only is $22 $20,
612except that a delinquent fee of $10 $1 shall be added for a
613renewal or extension made not more than 12 months after the
614license expiration date. The fee provided in this paragraph
615shall include the fee for driver's education provided by s.
6161003.48.
617     (d)  An original driver's license restricted to motorcycle
618use only is $30 $27, which shall include the fee for driver's
619education provided by s. 1003.48.
620     (8)  Any person who applies for reinstatement following the
621suspension or revocation of the person's driver's license shall
622pay a service fee of $35 following a suspension, and $60
623following a revocation, which is in addition to the fee for a
624license. Any person who applies for reinstatement of a
625commercial driver's license following the disqualification of
626the person's privilege to operate a commercial motor vehicle
627shall pay a service fee of $60, which is in addition to the fee
628for a license. The department shall collect all of these fees at
629the time of reinstatement. The department shall issue proper
630receipts for such fees and shall promptly transmit all funds
631received by it as follows:
632     (a)  Of the $35 fee received from a licensee for
633reinstatement following a suspension, the department shall
634deposit $15 in the General Revenue Fund and $20 in the Highway
635Safety Operating Trust Fund.
636     (b)  Of the $60 fee received from a licensee for
637reinstatement following a revocation or disqualification, the
638department shall deposit $35 in the General Revenue Fund and $25
639in the Highway Safety Operating Trust Fund.
640
641If the revocation or suspension of the driver's license was for
642a violation of s. 316.193, or for refusal to submit to a lawful
643breath, blood, or urine test, an additional fee of $130 $115
644must be charged. However, only one $130 $115 fee may be
645collected from one person convicted of violations arising out of
646the same incident. The department shall collect the $130 $115
647fee and deposit the fee into the Highway Safety Operating Trust
648Fund at the time of reinstatement of the person's driver's
649license, but the fee may not be collected if the suspension or
650revocation is overturned. If the revocation or suspension of the
651driver's license was for a conviction for a violation of s.
652817.234(8) or (9) or s. 817.505, an additional fee of $180 is
653imposed for each offense. The department shall collect and
654deposit the additional fee into the Highway Safety Operating
655Trust Fund at the time of reinstatement of the person's driver's
656license.
657     (9)(a)  An applicant requesting a review authorized in s.
658322.222, s. 322.2615, s. 322.2616, s. 322.27, or s. 322.64 must
659pay a filing fee of $25 to be deposited into the Highway Safety
660Operating Trust Fund.
661     (b)  An applicant petitioning the department for a hearing
662authorized in s. 322.271 must pay a filing fee of $12 to be
663deposited into the Highway Safety Operating Trust Fund.
664     Section 21.  Subsection (2) of section 322.29, Florida
665Statutes, is amended to read:
666     322.29  Surrender and return of license.--
667     (2)  The provisions of subsection (1) to the contrary
668notwithstanding, no examination is required for the return of a
669license suspended under s. 318.15 or s. 322.245 unless an
670examination is otherwise required by this chapter. Every person
671applying for the return of a license suspended under s. 318.15
672or s. 322.245 shall present to the department certification from
673the court that he or she has complied with all obligations and
674penalties imposed on him or her pursuant to s. 318.15 or, in the
675case of a suspension pursuant to s. 322.245, that he or she has
676complied with all directives of the court and the requirements
677of s. 322.245 and shall pay to the department a nonrefundable
678service fee of $60 $47.50, of which $37.50 shall be deposited
679into the General Revenue Fund and $22.50 $10 shall be deposited
680into the Highway Safety Operating Trust Fund. If reinstated by
681the clerk of the court or tax collector, $37.50 shall be
682retained and $22.50 $10 shall be remitted to the Department of
683Revenue for deposit into the Highway Safety Operating Trust
684Fund. However, the service fee is not required if the person is
685required to pay a $35 fee or $60 fee under the
