       The Committee on Criminal and Civil Justice Appropriations
       (Jones) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 787.07, Florida Statutes, is created to
    6  read:
    7         787.07Human smuggling.—
    8         (1)A person who transports into this state an individual
    9  who the person knows, or should know, is illegally entering the
   10  United States from another country commits a misdemeanor of the
   11  first degree, punishable as provided in s. 775.082 or s.
   12  775.083.
   13         (2)A person commits a separate offense for each individual
   14  he or she transports into this state in violation of this
   15  section.
   16         Section 2. This act shall take effect October 1, 2009.

   19         And the title is amended as follows:
   20         Delete everything before the enacting clause
   21  and insert:
   22                        A bill to be entitled                      
   23         An act relating to human smuggling; creating s.
   24         787.07, F.S.; providing that a person commits a
   25         misdemeanor if he or she transports an individual into
   26         this state from another country and knows, or should
   27         know, that the individual is illegally entering the
   28         United States; providing criminal penalties; providing
   29         an effective date.
