A bill to be entitled
2An act relating to the Police Technology Trust Fund;
3creating s. 943.082, F.S.; creating the Police Technology
4Trust Fund within the Department of Law Enforcement;
5providing for administration of the trust fund and use of
6moneys therein; requiring balances to remain in the trust
7fund; providing for future review and termination or re-
8creation of the trust fund; providing a contingent
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 943.082, Florida Statutes, is created
14to read:
15     943.082  Police Technology Trust Fund.--
16     (1)  The Police Technology Trust Fund is created within the
17department. Funds credited to the trust fund shall consist of
18revenues collected from the court costs imposed under s.
19938.135. The trust fund shall be administered by the department
20and used to allocate funds to public county or municipal law
21enforcement agencies to purchase and maintain technology
22equipment to be used in their law enforcement activities.
23Equipment that may be purchased and maintained with grants under
24this section may include, but is not limited to, in-car cameras
25and personal digital recorders to record encounters with
26suspects. The fee collected for each offense shall be
27distributed only to the law enforcement agency responsible for
28the arrest for that offense.
29     (2)  Notwithstanding s. 216.301 and pursuant to s. 216.351,
30any balance in the trust fund at the end of any fiscal year
31shall remain in the trust fund and be available for carrying out
32the purposes of the trust fund.
33     (3)  Pursuant to the provisions of s. 19(f)(2), Art. III of
34the State Constitution, the trust fund shall, unless terminated
35sooner, be terminated on July 1, 2013. Prior to its scheduled
36termination, the trust fund shall be reviewed as provided in s.
37215.3206(1) and (2).
38     Section 2.  This act shall take effect October 1, 2009, if
39House Bill 503 or similar legislation is adopted in the same
40legislative session or an extension thereof and becomes law.
